On Mother’s day, May 10th, my wife drove her car into the automated car at the Quality Mart #42 at 1465 River Ridge Rd. She drives a Mazda Miata and goes to this car wash a couple times a month to get gas and run it through the wash.
I was riding in the passenger seat and had removed the antenna before arriving at the car wash.
She pulled stratight into the wash area as directed and the machine started its routine. Suddenly, after a couple passes, it moved toward the rear of the car. Then the passenger side literally lifted up off the suspension some 4 to 5 inches. The machine that turns the ribbon type rags, abruptly stopped at the rear of the car.
I got out and saw the machine was stuck on the passenger side of the rear bumper. The post had pulled the bumper away from the body.
We inspected the damage with the store manager and found it had caved in the bumper, cracked the paint and cracked the lens in the passenger side taillight. We ultimately found that the machine’s malfunction did $1,429.94 of damage.
While we were at the store, a young lady approached us and shared that she was in line behind us when the accident occurred. She saw the whole thing and was frightened that the machine would damage her car as well. So she backed out and went into the store where they refunded her money. Shortly thereafter, she provided a written statement of her eyewitness account, which collaborates my and my wife’s.
I tried unsuccessfully for over a month to persuade Quality Mart that they were responsible for the damage. But they have refused to even return phone calls. When I texted Mr., the manager for all the Quality Marts, I got nothing but excuses.
Finally, on July 2nd, I asked just to tell me if they were going to take responsibility for the damage. His text reply was,
“Based on the information from the manufacturer and engineer opinions we don’t see how the machine could have caused the damage. We was dozens of cars everyday prior to and since your claim and have had absolutely no issues with our machine.”
