Complaint: ***I am rejecting this response for these reasons:The plumbers should have installed the fixture I supplied or forewarned us that they were not going to install it, so we could ensure that proper steps were taken to mitigate issues related to the fixture's absenceThe plumbers did not tell me beforehand that they would not install the tile flangeI only discovered after the shower pan was installed that they did not install the tile flange
In reviewing the directions for tile flange installation, it's evident that the tiler could not install the tile flange; its installation requires access to the underside of the shower pan, which is not possible after the shower pan is set in place and in cement by the plumberThe tiler installed hardiboard and applied moisture barrier paint to the hardiboard prior to tiling, and then grouted and caulked the tileThe caulking failure may be related to the absence of the tile flange, according to the State Farm expert witness who is a construction engineer with whom I spoke
A Quality Plumbing plumber recently removed drywall behind the shower for us, and we took photos of the back of the tile shower wall where it meets the shower panThe photos show that the plumber did not install any moisture barrier in place of the tile flange, eitherThis means that as soon as the caulking is compromised, a leak occurs, and the leak immediately invades the house's wooden infrastructureAccording to my research, and according to the State Farm expert witness who is a construction engineer, the plumber should have installed a moisture barrier which would have funneled leaks through the caulking to the shower drainThis is the source of the moisture currently damaging our walls and ceiling.

The use of the rubber flange kit is recommended by the manufacturer not required. There are a number of reason we do not use them. The most common reason is they are VERY difficult to install without them falling off when the size of the framed opening is only big enough for the
shower base and does not take into account for the additional space the rubber seal takes. When you install the pan with the rubber seal it is taped and siliconed on and when you install the shower pan in the framed opening it is under stress and just falls off. We do not believe in using them because we don't feel like it can be installed well enough to be long lasting. Once the rubber bead was shown to us we did tell them to return it due to the concerns on our part. the homeowner I believe had the brother (brother-in-law) fly in from out of town for a couple of weeks to do the tile work on this project. Unfortunately the only communication I had about the tile flange was with the owner and not the tile setter. I did advise the owner to make sure that the shower pan was flatted blocked all the way around the perimeter and special precautions made to ensure a water tight seal. The tile contractors I work with have a very specific process they use with plumbing fixtures like this with no factory tile flange. I think where the break down in communication is, is that you have a homeowner acting as a general contractor and information was not accurately given to the tile setter. And possibly the tile setter does not have a history with working with these type of fixtures. if he had, he should have recognized the lack of factory flange and installed a proper seal
I have included a copy of the original proposal and a copy of the installation instructions for the Flexible Tile Flange Kit. Below is also an email that I sent to the owner

Quality PlumbingHello ***,
This is Bryan H*** and I was the estimator and project manager for your job
I remember the exchange that took place when the acrylic pan was installed. The shower pan was installed and after we installed the pan we were shown the flexible shower flange kit. Even if we had the flange we would not have installed it. These rubber seals are complete garbage and the installation of these just never works out. The only reason the manufacturer sells them is to be off the hook if there should be a leak. At that time I advised that the tile installer take special precautions to ensure a seal on the pan and that would not be our responsibility. The tile companies I work with would never use the rubber bead and have techniques they use to make a water tight seal that is much better and long lasting. I understand the high importance of a water tight seal where the tile wall touches the pan and I would never advise anyone that a water tight seal on the pan was not necessary
I would suggest you hire a good tile company to make a long lasting water tight seal. Quality Plumbing will not take responsibility for the installation error which was communicated to be the responsibility of the tile installer

Bryan
