I am in receipt of the complaint against our company.  First I would like to say that we always give our tenants the chance to correct any issues that are found upon move out inspections.  This tenant was given the opportunity to correct the issues that were found on the initial inspection...

and chose not too.  I received a letter from an attorney with regards to this tenants move out charges and sent him copies of the tenants move in check list as well as bills for the work performed prior to the tenant moving in showing the condition of the home at move in as well as the bills for the necessary work that the tenant chose not to do.  In his own words, he knew about the damaged wall and if it truly was a ten dollar fix then the maintenance man would not have charged $200.  The tenant was told what items needed to be cleaned upon his walk through and he chose not to do the cleaning therefore a cleaning person had to be hired to do the cleaning.  Standard operating procedure is that carpets always have to be PROFESSIONALY cleaned the tenants can have it done and submit a receipt or we have it done and deduct it from the deposit. Prior to 2014 the rules stated that we would do it and deduct, procedures changed in 2014 so that tenants could choose to have it done and submit a receipt or we would have it done and deduct it, but professional carpet cleaning has always been a tenant charge. The cleaning charge was bid prior to any of the maintenance being done, the tenant was not charged for cleaning up after the maintenance people.  If the tenant had left the unit in the same condition it was in upon move in, subject to normal wear and tear (there was significant work done to the unit upon this tenants move out that he was not charged for such as painting walls, replacing filter, repairing windows etc all normal wear and tear) This tenant was only charged for the damage that occurred to the property during his tenancy and the necessary cleaning and carpet cleaning. I confirmed with the maintenance man that the $200 charge was for the wall repair and touch up paint not the closet casing paint therefore the $200 charge stands.  I am not stubborn or prideful, it makes no difference to me if the tenant does the work necessary upon move out or if I have to hire the work done. I do not benefit in the least from hiring the work done and would much rather allow the tenant to do the work if they choose which this tenant did not choose to do.  I can understand the tenants frustration as moving is always stressful but we always try to be as fair as possible with our tenants.
