When we last spoke with Mr. [redacted] we explained to him that signing as a P.O.A for his wife was the same as if she signed herself. He was very sympathetic with our position and told our representative that he would try to convince his wife to sign on her own. Even though we are under no obligation...

to do so, in the best interest of good customer relations, we will be rescinding our agreement with Mr [redacted] as P.O.A. for his wife and we are in the process of both faxing and mailing a rescission letter to New York State. Hopefully this will satisfy the client.

Our company notified [redacted] and her son/POA [redacted] that [redacted] had money with NY State Unclaimed Funds. We explained that we charge a 15% fee on the money that is recovered but nothing is due until we receive the check from the state. We also explained that we offer an additional...

service to our clients. This involves a more intense search for assets that have not been turned over to New York State as Unclaimed Property. The search is free but if we find any assets that have not been turned over as Unclaimed Property than the fee is 35% of the value of the asset. Again, nothing is owed until we have the check in our hands. These additional searches don't always uncover additional funds and we typically find additional assets for 1 in every 10 of our clients. We sent the paperwork to Mr. [redacted] and he in turn took the paperwork to his mother and had her sign both the authorization and fee agreement for New York State Unclaimed Funds and the authorization and fee agreement for the additional search. We received the paperwork back on 2/10/16, submitted the New York State paperwork to Unclaimed Funds and started the additional search. On 2/23/16 we notified Mr. [redacted] that we had located an old insurance policy in his mother's name. He explained that his mother had come to live with them and subsequently went into a nursing home and they had no idea she had an old policy. We explained that this was an item uncovered through the additional search and the fee would be 35% of the cash value of the policy which was $5037.62. We told him he could keep the policy in place or he could surrender the policy for the cash value. We also explained that the New York State Unclaimed Funds would still be coming. Mr. [redacted] said he would like to surrender the policy and we sent him the appropriate paperwork to do so. We received all the necessary paperwork back, signed by [redacted], and submitted it to surrender the policy. On 3/29/16 we informed Mr. [redacted], through his wife, that we received the check for the insurance policy and the check was for $5090.54. We told them our fee would be $1781.68. They stated that they don't have that kind of money and we explained to them that we could hold the check for them until the insurance check had cleared. On 3/30/16 they called back and said they would send the check from [redacted]'s account. After not receiving the check for 9 days we called back and they said they couldn't pay it out of [redacted]'s account. We mentioned that they could use it to buy [redacted] some needed personal items, since they stated they use their own money to do this, or even do a pre·paid burial if they had not done so. They then consulted with their attorney and he told them to write the check out of their personal account. At no time did we suggest that they hide the money.  On 4/14/16 we received the check for the fee and sent out the check for the policy surrender. We also explained that the funds from New York State Unclaimed Funds would still be coming. We also received a letter with the check, copy enclosed, thanking us and apologizing for any misunderstanding. We were very surprised to receive this complaint and we believe it is just a misunderstanding of the fees. Occasionally we are able to locate other assets, not deemed Unclaimed to New York State, before we actually receive the funds from the State and we believe this is where the confusion comes in. We areworking on procedures going forward to limit the confusion with the fees including the possibility of delaying our additional search until the New York State Funds have come in. We have subsequently received the checks for [redacted] from New York State Unclaimed Funds. We have also realized that the check Mr. [redacted] sent us for the fee was dated 2014 instead of 2016 and cannot be deposited As of this date we have not informed Mr. [redacted] until we have answered this complaint. Please also find attached copies of pertinent letters and documents. Thank you.I spoke with Mr. [redacted] yesterday, 4/28/16, in regards to the last check we had received for him from New York State and the complaint he filed with the Revdex.com. He said he called the Revdex.com at the suggestion of his lawyer just to make sure we were a legitimate company and when he did he was assured we were legitimate. He was also told by a representative at the Revdex.com, according to him, that it was ok that we were charging a 35% fee on the old insurance policy we had found and that the 15% fee only applied to funds that had been turned over to New York State as Unclaimed Property. He said he fully understands both checks and the difference in the fees. I believe some of the confusion came into play because he had spoken with a representative at the Revdex.com and his wife was the one that sent in the written complaint.
