writing in response to *** *** complaint As we told him in his security deposit letter, we did not return his security deposit because of early termination of his lease agreement We are surprised that he would say that his family rented a house and it was not a good experienceSince *** *** requested to renew his original lease for another year and recommend the house to a friend of theirs, which is now the current tenant, to rent from us.On July 21, the *** signed a one year rental agreement for our house at *** ** *** The lease fixed term was for 7/25/to 7/24/ They were responsible for the monthly $rent for the term of this agreement They moved out of the house by 1/31/ This means the *** were responsible for the rent balance of the lease term per the rental agreement.Last year we met with the ***, at their request, because they wanted to sign a new one year rental agreement, they did not want to go month-to-month They had already rented this property for one year, and according to the terms of their original lease, it would have become a month to month lease However, they requested the new one year agreement In the terms of the original lease, we would have increased the rent after the one year period, however we agreed to keep the rent the same due to a one year lease commitment that the tenant requested In regards to *** *** other comments/complaints, I feel there are many statements The previous tenant in this house was a friend of the ***, she still resides in our property The former tenant is the one that showed them the house, which they said they loved, and we met for the lease agreement, in which it states in the tenant inspection paragraph, that by signing they agree that the house is in satisfactory order We had cleaned the house before their move in and exterminated They wanted to bring their own appliances so the only appliance we had there was the built in microwave After *** *** gave his notice to vacate, he had several conversations with our property manager trying to get us to buy the appliances, we told him each time we did not have any interest in them He choose to leave them behind when they moved out.The plumbing issues were related to items (tampons etc) being flushed into the septic system We witnessed this first hand when the septic system was pumped out by a licensed professional Per the lease agreement, this is the tenants responsibility.In regards to the locks being changed and the break ins: it was not someone having a key The locks were changed when they moved in and again after they saw someone going in through the second story window The *** friend’s son was climbing up into the second story window to enter They knew the person breaking in and witnessed him doing it, he did not use the door.They expressed they loved the country setting, they had a very large yard According to the lease agreement, they were responsible for the upkeep of the yard We did have dead trees, due to the Ash Bore bugs that went through our county, and we did have to use the “cherry picker” to cut down the very large treesThey seemed happy that they were going to have more sun on their in ground pool The tree removal was a large job but, it is a very large yard, they had a lot of yard that was available to them The tree removal was done as quickly as possible. In regards to the tree hitting the roof, limbs were removed and yard cleaned the following day after a winter storm It was one spot in the roof, and was repaired by a licensed roofer for the winter until an entire new roof was put on when weather permitted.Unfortunately their cleaning job was not very good There were cobwebs all over the house it was dirty We did have to clean again before we could rent it out For some reason they had removed the hardware (door handle and latch) that keeps the storm door closed It is glass and in a strong wind must have flown open and broke the light outside the front door, which was not reported to us. The smoke detector had been removed by tenant Part of the lease is a smoke detector certification, which is signed by tenants It states that the smoke detector was installed and in working order upon move in It is their responsibility to test the detector monthly.The lease agreement states that within days we will send the tenant a security deposit return or explanation A letter was sent to the tenant explaining the non return of security deposit due to the early termination of the lease agreement, within the days after tenant vacating, per the lease agreement.I hope this addresses the issues at hand, if you have any further questions, please do not hesitate to contact us.Sincerely,Melisa L.Secretary/Treasurer
