Regarding the complaint from Ms***, we have already responded directly to Ms***, in writing, on 1/13/via email (see attached) before she filed the Revdex.com complaintIt is important to note that: Ms*** did leave out of the complaint she filed with the Revdex.com that she was not
going to be able to honor the contractually agreed deadline to pay the security depositDespite how/ when she viewed the property (of which we had no foreknowledge), the deposit was still due as agreed on the application agreement - a separate short and specific term she initialed when she submitted her applicationMs*** was never asked to wire the deposit funds, as we do not accept wired fundsShe was given three payment options (in writing): electronic cash payment (this is not wiring but a service to which we pay and subscribe to offer more convenience to our customers), paying online with her bank account (or credit card), or overnight mailing the deposit in the form of a money order or cashier's check to our mailing addressMs*** never told me that she was concerned about "wiring" the funds or I would have explained to her then it was not one of the payment options. Ms*** did tell me she was not comfortable in paying the deposit since she had not met anyone representing our company and because we had not returned her numerous phone callsBoth of these "issues" are not a reason to not pay on time, but they were a surprise to me, as we thought Ms***, an outside broker who shows some of the properties we manage, had physically shown herThe "not returning phone calls" also concerned me, as that is not how we operateI never once became defensive during this phone call, quite the opposite, as I apologized profusely to Ms*** in my disappoint to hear that Ms*** and our staff may not have followed company protocolMs*** said she would not have the money until the 18th or 19th because she had not received any return calls from usBased on that, I initially told her she could have an extension until the 18th, at the latest, to pay the deposit, although not hearing from us did not truly offer a reason of her not having the funds available by the 2-day deadline (which was 1/14/2017)After I pulled all the call records to find that Ms*** called our office only three times within three minutes (after she briefly spoke with Sandy who told her she does not receive and process applications) on 1/5/but never left one message, I retracted the deposit payment extension to the 18th, as that offer was only based on thinking our staff had not performed in returning messagesAs I explained to Ms***, via email on 1/13/2017, our system does not notify us of hacalls, but rather we are only notified when a caller has left a messageIf Ms*** had problems with our voicemail service, she could have emailed us on 1/5/or shortly thereafterThe first and only time Ms*** claimed to have a problem with being able to leave a voicemail message was on 1/13/2017, after I notified her that we had received no notification she had called because she had not left a message. I never once called or implied Ms*** was lying or a liarTo the contrary, I suggested that perhaps Ms*** got our property confused with another property managed by another companyWe have prospective tenants confuse our properties with other properties quite often, which is why I suggested that may have happenedPerhaps it was me pointing out certain facts such as the actual time it took to process her application and that she had not been calling us for two weeks that led her to believe I was implying she lied, but that's simply her perception, not reality. It was around 5pm on Friday, 1/13/2017, when Ms*** told me she was at work and could she call me laterI explained to her that I was at work and my work day ended at 5pm, so she would not be able to reach me after 5pmHowever, I told her I would research the matter and try to figure out when we could arrange for someone to meet her at the property and I would send an email to herThe fact that our company is listed as an accredited member of the Revdex.com, which Ms*** would have seen when she went to file the complaint and could have seen earlier had she been concerned enough to check, should have relieved any concern she had about our company being a scam. Ms*** saw fit to make a personal attack on me and my character, but I know the truth so I do not need to defend such nonsenseAlthough I did identify myself as the Broker to Ms***, she must not understand the role I have with the company. In summary, after Ms*** left a voicemail message giving more details of her "viewing the property" and related calls to Ms***, I explained that I would deal with that situation separately with Ms***, as it did not impact or affect Ms***'s application to lease the property, etcAlthough we did not have to honor Ms***'s request to meet us at the property before she would pay the deposit, we did offer, on Friday, 1/13/2017, to meet her at the property on 1/14/(Saturday) or 1/16/(Monday) with the understanding she would have to pay the deposit on the same day we met herIf she met us on Monday, that was giving her days to pay the deposit after application approval instead of the contractually agreed days, so we were certainly extending her an opportunityHowever, her response was, that she, "cannot drop everything to meet at a time that is convenient for a company who is clearly not interested in doing the right thing." I thought that was an interesting response since we were willing to extend ourselves in two ways beyond what was requiredThe reality is Ms*** did not have the funds available to pay the deposit in the agreed time frame so she withdrew Per the signed application, application fees are non-refundable There is no merit to Ms***'s complaint or reasoning for requesting a refund, so it is being denied Thank you for this opportunity to respond
