The undersigned is in receipt of your letter dated March 18, 2015, in regards to *** ** *** *** (“Complaint”)Please accept this letter as the Firm’s (“Firm”) formal response theretoA review of our file reflects our Firm was engaged
by *** ***, LLC to collect monies due on accountA judgment was entered against the complainant and thereafter a payment arrangement was entered into to pay the judgment balancePer the parties’ agreement, an automatic monthly recurring payment was drafted (“EFT") from the Complainant's banking account.On February 4, 2015, the complainant contacted the office and advised he wished to cancel the monthly payment arrangement and pay the balance due on that dateThe full payment was drafted from his account and the monthly payment arrangement deleted from our collection platform.Due to an employee’s clerical error, the recurring EFT payments were not cancelled with the payment vendorAlthough the payment was drafted, it was returned to *** ***'s account within one business day as he advised the bank the draft was not authorizedThe Firm did not receive the $payment as claimed by *** *** and received written confirmation form the vendor the EFT was “revoked” See attached.He thereafter contacted our office and advised the Firm of the payment issueThe Firm apologized for the error and the inconvenience and paid the overdraft bank charges($38.00) which he incurred as a result of our actionMitchell R,

I am rejecting this response because:
The real issue here goes beyond the fact that it was returned the next day. I wound up over drafted and it put my bank account in the negative to the extent that my paycheck could not even make it whole and I went the entire day without a bite to eat and that evening I could not buy groceries. I wound up not being able to eat a bite of food for over 24 hours. In addition to this I was devastated mentally by this being taken out of my account and spent this entire morning that I should have been at work at my bank trying to sort this matter out and putting through a 'dispute payment' claim. When you add up the stress, sleepless night, lost wages, going hungry all in the name of their employees incompetence...I believe being compensated $200 to cover all of this is a bargain. I demand a check made to me for $200 to cover this nightmare.

A review of our file reflects our Firm was engaged by Midland Funding, LLC to collect monies due on account. A judgment was entered against the complainant and thereafter a payment arrangement was entered into to pay the judgment balance. Per the parties' agreement, an automatic monthly recurring payment was drafted ("EFT") from the Complainant's banking account.On February 4, 2015, the complainant contacted the office and advised he wished to cancel the monthly payment arrangement and pay the balance due on that date. The full payment was drafted from his account and the monthly payment arrangement deleted from our collection platform.
Due to an employee's clerical error, the recurring EFT payments were not cancelled with the payment vendor. Although the payment was drafted, it was returned to Mr. Smith's account within one business day as he advised the bank the draft was not authorized. The Firm did not receive the $200.00 payment as claimed by Mr. Smith and received written confirmation form the vendor the EFT was "revoked" See attached.
He thereafter contacted our office and advised the Firm of the payment issue. The Firm apologized for the error and the inconvenience and paid the overdraft bank charges($38.00) which he incurred as a result of our action.
