After completing the pool project and calling for final inspection the city of Austin claimed to have not seen the underground electrical conduitThis inspection was called and the inspection card on site was signed as approved(I have copy of approved, signed inspection) However the city claims
to have no record of the inspectionA very difficult problem to find a resolution toThe licensed elect contractor of record subsequently hired an elect engineer to over see the projectA recommendation by the city of Austin as part of the resolutionThis entire process is very lengthy to get through the City of AustinIt has required several meetings months apart with various staff members.The potential meeting times were also limited and required several schedules to coincide to be effectiveAlso during this period our private Electrical engineer had to have hip replacement surgeryThis had complications including an infection that required hospitalization for an extended period of timeWith all of the elapsed time we then had our permit expire adding more paper work to the issueFinally with "underground electrical" approval from the city of Austin they required only a final electrical inspectionOur inspection was then turned down as new city codes have been adopted and the city refused to "grandfather" our permit in as it has with other permits that were renewed in the same time frame.The new code requires low voltage swimming pool lightsI have scheduled the lights to be replaced the week of May 1st.Regarding the pool leakThis was a leak in the auto fill system not the pool structureThis has been taken care of in a reasonable timely mannerThe client is requesting me to have a leak detection service check it againHowever as I have explained to the client, leak detection services will not respond unless pools are loosing a minimum of inches per dayThe client stated that she does not know if the pool is loosing any water at all I have asked her to simply shut off the auto fill line for days and check the water lossAt this point I think it may be that there is a lack of understanding as to the way leak detection worksI have re sent an explanation to her in an effort to explain the situationRegarding the other smaller itemsAll items have been taken care ofWe have gone beyond warranty repair on items like restaining the entire back patio,(when only a mall portion was discolored) adding a raised child proof latch at the pool fenceRepairing self closing mechanisms on a gate the we did not install and were not responsible for.I understand the clients reasonable frustration for the lengthy process to final the poolIt has been a once in a life time bad experience for both of usIt was very tempting to bring a construction law firm in with me when dealing with the city of Austin and all of the ridiculous delays and the poor system they have in placeHowever it would have extended things even longer.At this point the pool will have final inspection by May 14thAll items will be reviewed to ensure customer satisfaction.Regards,*** ***

I am rejecting this response because:Once again this response is rejected until the following previous mentioned items are complete to homeowners satisfaction or Mr. [redacted] pays $3,000 so homeowners can complete his project.1. Removal of excavated material  (Picture attached)2. Replace defective Spa Blower Motor3. Replace water hose nozzle4. Pay homeowner $380.81 for [redacted] invoice5. Figure out why water return lines are blowing air into the pool.  If it's the seals on the equipment as Mr. [redacted] stated by text, fix it!

The truth is there is no $ 2100 allowance in the contract for debris removal. The contract states all material to be left on site $2100 has been paid so far for removal. He is very close on the estimate for the remaining material. He just does not want to pay itin an effort to resolve the issue...

I have offered to PAY for the removal of debris however I asked that wait until I have extra time and money.his other 2 complaints are warrantee issues that have bee turned in to the manufacturer. His complaint about a Hose nozzle is entirely indicative of these complaints.  Not really dealing with a homeowner with any compassion or true understanding

I have emailed Rodney [redacted] and told him I will be there on March 23 to take care of all issues. Please understand I will be spending over $3000 to satisfy the client and keep my good standing with the Revdex.com. Also I am not in agreement with the client. My contract clearly states excavated material to remain on site.  However I will resolve the issue at my expense. [redacted]

After receiving Mr M[redacted]'s notice that his pool was seeping water slightly from the above ground raised pool wall I hired American Leak Detection to check the pool. Please see attached. The report stated that there was no plumbing leaks and that there were small hairline cracks in the plaster....

Rather than repair the leaks I went to the full extent of a total pool replaster. This ensured a cosmetically sound look in the pool costing me over $3000 rather than just hundreds had I patched the plaster. In short we went far beyond normal warranty requirements for the client. Regarding the statement that says I told him to go find someone else  . ABSOLUTLY FALSE. I WOULD NEVER, I HAVE NEVER,  IN MY LIFE MADE SUCH A STATEMENT TO A CLIENT. I consider this complaint untrue, unreasonable and absolutely unnecessary as a simple honest phone call to me and I will assist in the matter!!!!.  I have sent a message to the client stating I will be happy to consider assisting in the matter. I hope to hear back from him soon n order to put this to rest. Regards, Brian Q[redacted]

air into the pool. Ten months has now passed for this 30 day project.  Patience is wearing thin and we would like a resolution soon.  We are ready to move forward in getting our drip system completed as required by Comal County.  How much longer can Mr. [redacted] use his stall tactics.

I am rejecting this response because: I have not received an e-mail from Mr [redacted] and asked that he please post a copy to the Revdex.com website for my review. If Mr [redacted] would review previous attachments, one of his addendums states he would remove debris for $2120.00. I also want reimbursement of the LP gas plumbing($380.81), the replacement of spa blower motor which is defective, fix air blowing in return line to pool and payment for missing water nozzle.
