Please be advised that I am in-house legal counsel for Quincy Retirement Community d/b/a Quincy Village ("Quincy Village')Quincy Village is in receipt of your letter dated Friday, October 23, 2015, whereby you state that you received a Complaint about its billing or collection issues from [redacted] [redacted] I would like to address the issues in that Complaint.By way of a brief background, [redacted] 's husband, [redacted] , was a resident of Quincy Village’s skilled nursing facility from October 18, until he passed away on December 19, Subsequent to [redacted] admission to Quincy Village, a [redacted] application was filed on his behalfThat application was approved in July of 2014; however, [redacted] had a substantial penalty invoked from November 23, through June 14, due to transferring assets for less than fair market value, Specifically, the penalty was due to real property being titled from "Tenants in Common" to "Joint Tenants with Rights of Survivorship" and $8,worth of cash withdrawals for a vacationThe retitling of the house gave [redacted] daughter a type of ownership whereby she had a right of survivorship in the real propertyAs a result, when [redacted] passed away, his daughter received full ownership of the real property without having to go through the probate process[redacted] family appealed the penalty period in July of Collection efforts were stopped as the family waited for a hearing on the appealThe appeal (along with the past due balance) went unresolved for a yearIn June of 2015, after a hearing, the Bureau of Hearings and Appeals finally denied the appealAs a result, [redacted] owed Quincy Village an outstanding balance of $63,for the care and services provided to him during the penalty period in which [redacted] would not pay due to the aforeMentioned transfer of assets.In August of 2015, Quincy Village agreed to accept $60,as settlement inthis matterOn September 1, 2015, Quincy Village received a check in the amount of $60,as full and final settlementAs the entire balance was not paid full, a portion of the balance ($3,482.84) needed to be written offThe issue is that write offs can only be processed once a month in Quincy's billing systemThe write off for [redacted] ’s balance was not able to be processed in SeptemberIt was completed in OctoberHowever, as the facility only sends out its invoices once a month, the invoice showing that the balance is now zero on [redacted] account will not be sent out until mid November when all of the October invoices get mailed out to residents and their families [redacted] will receive the invoice in a few weeksShe can be assured that the balance is Zero oil the account.Quincy waited well over a year to receive payment on this account which had a very substantial balanceCollection efforts were halted during this time period as the family appealed the decision of the [redacted] While it is sympathetic to [redacted] concerns, it respectfully requests that she wait a few more weeks to receive the final bill showing a zero balance
