We sold [redacted] a used Mahindra with a loader attachment, Quick attach bale spear and Snow bucket on April 17, Our salesman, [redacted] , handled the sale [redacted] was here a week or so before the sale with a friend to test drive and look over the tractor and loaderHe agreed to purchase the tractor on this visit and gave us a down paymentOn April 17, [redacted] met [redacted] at Quinlan’s Equipment to handle the delivery on a Sundayduring non-business hoursThis is not a practice but [redacted] agreed to do this since a Sunday delivery worked out best for JustinWhen delivering the tractor and loading up the implements, [redacted] discovered that the tractor quick attach was not the standard size and would not properly fit into the bale spear or snow bucketAfter discussing the issue with Justin, [redacted] agreed to send him at no charge the parts to weld to his loader so that the loader would be compatible with industry standard size quick attach attachmentsAt the time of sale this was acceptable to [redacted] and he agreed to proceed with the saleHe even signed a sales contract stating this conditionFabrication and fabrication costs were not discussed at the time of retail saleWe were under the assumption that [redacted] would be fixing the quick attach items to the tractor on his own as many farmers have welding equipment and handle minor fabrication jobs in their own shopWe ordered the quick attach brackets, and had them direct shipped to the customerThere was a delay in getting the parts from the manufacturerUpon receipt of the brackets, the customer contacted [redacted] and stated he would still need a bracket for the back of the original bucket so that it too would fit the new loader bracketsAlthough this was not part of the original agreement, [redacted] agreed for Quinlan’s Equipment to supply this part which has a list price of $and a dealer cost of $After further conversations over a combination of telephone calls and e-mail messages, [redacted] and [redacted] agreed that [redacted] would obtain this part locally and handle the cost of welding it to the back of the bucket In exchange for this Quinlan’s would handle the welding of the quick attach plates to the tractor loader [redacted] agreed to this since the price of the part and estimated fabrication costs provided by our shop was a similar amount [redacted] stated it would be an inconvenience to get his tractor to our store for fabricating so [redacted] agreed to pay a similar price for repair work done by Justin’s friend DeanWe do not generally agree to pay for labor that is not done in our shop but did so in this situation for customer convenience purposes because he is located a good distance north of our storeIt was assumed that the price would be close to the amount discussed and It was agreed that we would get an estimate from the repair shop prior to the work startingWe never heard from [redacted] or Justin’s friend with a quoteIn June we received invoice # totaling $from Northern T&T Machine Incin Iron River, MichiganI called T&T machine and talked to DeanI also spoke with JustinI stated that we never received a quote for the work and that we were not in agreement to pay this billAfter speaking with [redacted] We decided that in fairness we should at least send a check to cover the quick attach plate for the back of the bucketI called [redacted] again and told him that we would only be sending a check for $because we never received a quote and the reasoning behind us covering the fabricating instead of the bucket bracket was out of convenience for the customer and the costs were thought to be a wash [redacted] pleaded his caseIn the name of customer satisfaction I agreed to send a check for $to Northern T&T to help him with the billAt the time of the phone conversation [redacted] seemed satisfied with thisWe also obtained and sent [redacted] a service manual at his request free of chargeAttached is the original sale contract dated 4/17/that was signed by JustinOn this contract there is a note stating *Will provide a quick attach end plate for Mahindra tractor & ship to customerWe fulfilled our end of the agreementThe agreement also has a box checked stating the machine is sold used as-is [redacted] was given a copy of this agreementNowhere on the agreement does it state that Quinlan’s Equipment will supply a weld on quick attach bracket for a bucket or pay any of the fabrication expensesEven though it was not in the agreement we have already paid $toward fabrication costs out of goodwill toward the customerPlease advise what we need to do to have this case closed and removed from our recordThank you, [redacted] Quinlan’s EquipmentHwy SouthAntigo, WI715-627-
