First off there was never a discussion about problems with the subfloor, only positive talk about how the vinyl was glued down very well and how he can put the tile right on topI questioned this and talked about putting hardie backer down and he assured me it would be fine, that he had some thinset that would stick to anythingI have a witness that will testify to thisI have since researched this and experts say that you need to pull off a layer to assess the condition of layers below, (which he did not do) nor did he go in the crawl space to inspect the sub floorIt also stated that if the vinyl is over particle board or lauan, ( a form of cheap thin plywood) which is exactly what he put down in the dining areaBoth of these are not proper surfaces for laying tileIt states that vinyl flooring itself is not installed in a manner that would allow tile to go on topI have text messages where *** states he has done this many times with no problems, which I can't believeThe other tile job which he did right after this one is no more than feet from this one and he installed directly on the sub floor, it is in perfect condition stillI have numerous text messages from *** making excuses, first it was the grout, which the first bag was purchased months before the second one, then it was me not taking care of itWhen these excuses failed now he says it's the subfloor,( which after research is not the problem.) He admitted that he mixed the first bag of grout to thin to make it lastI paid for the materials, so this makes no sense, other than just laziness The last time *** was there he showed me where there were still loose tiles and said he would come back and do a section at a time, (I also have a witness to back this up also,) but he was booked for the next two weeks, which he knew by then the warranty would be upIt is such a shame that a contractor would out right lie just so he does not have to come back and repair his unsatisfactory workI love this tile, .it matches my bamboo flooring perfectly and to imply otherwise that I just want new flooring is just another poor excuse, and so unprofessional.....Since this about who is telling the truth and who is just a bold face liar, I am willing to take a polygraph and also pay out of my pocket for *** to take one alsoThis my response to his response, *** ***, dated 10-05-

I am rejecting this response because:
First off you were gone months to Calif and I had to wait for you to get back, so months should be added to the warrantyThen I would tell you to come when you were in between jobs, and you took advantage of that, by not coming for a month or twoThis job is your fault, you should have never put it on top of the vinylThe last time you were there you knew there were still loose tiles, and told me you would come back and do a section at a timeAgain I offer to pay for you to take a polygraph test, which you know you will fail, as to why you won't take oneYou knelt down and inspected the vinyl and said it is glued down very well so you could put the tile on top, saying you had thin set that would stick to anything, I have a witness to everything you have said and done, everytime you were hereIf you are not lying about anything then this case will be closedNobody is perfect and mistakes are made, but you need to make this completely rightA warranty is over when the job is completely right, you knew the last time you were here it was not completely right...If you take your car in to get fixed on the last day of the warranty and they don't finish it on that day, the warranty is still good the next day or until they fix it rightThey aren't going to give you back your car the next day still broke and tell you the warranty is up. Use your brain it's common sense

First is no company add or extend a warranty on contract( with out the client paying for a extend warranty) 2nd I have gave the client a one year warranty on laborNot many company offer a year warranty3rd The client still bring up the vinyl is the problemWhich it is not the problemHer cracking is on none vinyl areaThe last time I was up there I told her I fixed all supposed lose tile and cracked groutWhen I fixed these "so called" lose tileI didn't see anymoreThe lose tiles were only corners and not the whole tile4th a polygraph test will not stand in court of lawBut if she wish I will take one which will be in my favorBecause I'm not a liarI told her that yes it is ok to put tile on vinylI used a glue that you can buy at Home depot that helps the thin sett stick to the vinylI provide the glue with no cost to clientBecause I had some left over from a job I did a couple weeks before I did herI did the same thingPut tile on a vinyl floorI have not had any problems with that floorHer witness is her ex husband who lives with her and he wasn't there at the timeThe warranty is over when the year is up not when the client says it isThe last time I was at her house I told her I had fixed everything and she was happyAlso told her warranty was almost doneEven if you still have problems it called a signed contractThe client needs to use her common senseSo to make this right it is simple a contract is a contractShe said it and agreed to the termsI don't have to fix anything on her floorI have found out that she is suing my business for $Which didn't cost her that much for materials and laborIf I'M right when your suing someone you can't have any contact with them text, call or even a 2nd or 3rd partyThat including through the Revdex.comI.m asking the Revdex.com to send *** *** to court on behalf of Quintana EnterpriseNovember at 1:15pmI will write the Revdex.com one more time to let you guys now how things went in courtAfter that I will not be sending anymore lettersBecause I'm not going to continue to play this he said she said and back and forthThank you Quintana Enterprise

I have tried to make it right more then once. I have went up there more then once to fix the problem. I did everything right on the job. I have done many tile jobs and have never had a problem with one of the tile jobs. I don't like being called a lair. I take pride in my work and do a good job. I don't make excuses for something.
