Consumer sent the following clarification and documentation.  See attached.Consumer clarification letter copied and pasted below by Revdex.com staff 10/26/15.I inherited the home of my father upon his death. The home's address is [redacted]. The roof had a slight leak....

I hired a roofer my father had dealt with repairing his garage roof a year or so earlier. My father told me the roofer, Pedro Quintana, was expensive but did the work properly. The roofer told me he had discussed the leak with my father and that he already knew exactly what the problem was. He gave me the option to repair or replace the roof. He told me the roof was dose to 20 years old and the costs he quoted me led me to believe a replacement of the entire roof was in order. I asked the roofer three questions: Will you be doing the work. He told me yes. I asked him if he will be replacing the entire roof. He told me yes. Please note the contract reads, "tear off complete roof top". 1 asked him why the estimate was so expensive. He told me the reason was due to the cost of materials. Years earlier, my father told me the materials to replace the roof in the rear were special and [redacted] Page 2 quite expensive. Therefore, I accepted the roofer's explanation. I hired him based on the understanding that he knew the problem, he was going to do the work and the job would be a complete tear off of the existing roof. The roofer suggested he replace the roof as soon as possible. l asked him if it was ok to do this in the winter. He indicated yes. Only later did I learn one should not replace a roof in the winter! He completed the job 1/17/15. February 8 or 9/2015, my daughter called me at 1 or 2am. She told me the roof was leaking dramatically. I went over the house and saw copious amounts of water leaking from the top floor to the main floor—primarily through one wall and the ceiling of the living room. I had just rehabbed the house and water was all over the newly painted walls and the newly treated hardwood floors. I contacted the roofer and he came over that evening. He told me he would take care of everything. He assured me he would repair the roof and all damage inside the house. The next day he brought over a tarp and placed it over most of the the roof. He was present with his son Fillipe. As these two men spoke with my daughter, they told her that they subcontracted the job and were not present as promised. Within 24 hours the tarp blew off. The roofer was contacted about this but never returned to replace the tarp. I did not know what to do. Therefore, on 2/12/15, I contacted South Euclid City Hall and spoke with the head of the city's service department, [redacted]. Mr. [redacted] told me to call the roofer's insurance, [redacted] Insurance Agency (216-321-8033) to discuss the roof problem. I spoke with Alan [redacted]. Mr. [redacted] became irate and berated me for calling, indicating I had no business doing so. He told me [redacted] was absolutely incorrect for suggesting this. I called back Mr. [redacted] and told him this. He assured me he was correct, that he would call Mr. [redacted] and get back to me. Mr, [redacted] never called back, never returned my calls to him and he never [redacted] Page 3 answered my question regarding the definition of a complete roof tear off as he promised me he would. The roofer called me within a few hours of my call to Mr. [redacted]. I cannot repeat here the things he called me and said to me. You will notice he ultimately apologized for the incredible anger and rudeness he directed towards me. I did not hear from the roofer again until 4/22/15. His text message to me indicated he was planning to repair the roof within a week or so. For the next four months, I received excuse after excuse from him about why he has not come out yet to repair the roof. Even when rain water entered the roof he offered assurances of coming out and failed to do so. The roof was finally repaired 8/13/15. He told my daughter, "Don't tell your father the roof is two different colors" as if I would not be able to see this. You see, he was not able to find the same shingle used originally so he used a different color shingle. I do not know how this could happen. During his visit to see the damage in February, I asked him if he would be repairing the roof with the same materials. He told me absolutely and that he was going to purchase the materials the next day to ensure he would have the stock. He never did so. The roof now is multicolored. This is not the professional job I paid for. I spoke directly with the roofer before he left the job and told him were can handle this one of two ways. We can handle this between ourselves or I can hire an attorney. We chose to handle things ourselves. The roofer agreed to refund $4000.00 due to the fact that he did not engage a complete tear off as he had stated and that I thought I was paying for, he put me off so many times over the course of the summer, workmanship was obviously poor and the roof was not all one color as expected. On 8/13/15, as we stood outside the home in question, we drafted and [redacted] Page 4 signed an agreement. The roofer told me he would not be able to raise the necessary funds until October. I agreed to wait. We agreed upon meeting at the home 10/20/15. A copy of our agreement is enclosed. I sent the roofer a reminder 10/1/15. He never showed, never canceled and never sent the funds to me. The roofer never followed through with repairing the inside of the house. I hired a painter to repair the ceiling damage. His $170.82 receipt for payment is enclosed. The roofer also never completed his contractual statement to replace the entire roof. 1 hired another roofer to finish the job. This person's $1500 paid statement is enclosed. Please tell me what legal recourse I may have. This is a licensed contractor. As a licensed individual myself, I wonder if his actions constitute malpractice? Can he be held accountable by law and through his licensing agency for not following through completely with his original contract by not removing and replacing the entire roof as stated? Can he be held accountable for not remanding the agreed upon $4000 as promised? Finally, a question about the way he was paid. The contract is written on the corporate letterhead of Quintana and Son, Inc. He had me write three checks to Pedro Quintana personally though. Did Pedro Quintana commit fraud against the IRS? is his son, Fillipe also a culpable party? Finally, given I have been repeatedly victimized by this roofer, can legal action also include my legal fees to right this wrong? Thank you for your assistance in this most unpleasant manner. The entire situation has been emotionally very difficult for me. I lost my father, saw his home mistreated and damaged through negligence and was repeatedly lied to by this roofer, Pedro Quintana. I cannot express the degree of emotional upset this has caused me. [redacted] Page 5 I am sending text messages and emails between Quintana and myself to support what I have written. Ms. [redacted],I’m writing in response to the complaint made against my company on October 21, 2015 by Mr. [redacted], regarding his property at [redacted].  I made the mistake of feeling pressured into an agreement that I couldn’t fulfill at the time.  I will repay the $4,000.00 only, interest free, in $500.00 increments, every month starting February 28, 2015.Thank you for your time,Pedro J.
