R and B Builders Construction

R and B Builders was contracted to build an addition on to my house. The addition was to include a master bedroom, bathroom, walk in closet, and living room (including plumbing, and heating and air-conditioning ducts run). On the outside of the house we were suppose to have a deck built, a new driveway and walkway put in, a new roof put on and all new siding. The job was started in May of 2012 and contracted to be completed by end of August 2012. The job was paid for in full. When the job came to a complete standstill in October I had a conversation with the [redacted] of R and B Builders ([redacted]) as to what was going on. He informed me that his previous clients did not pay him and he used the money we had paid him to cover other expenses. He assured me that he would finish our job. At the end of October, the beginning of November we made an agreement with the [redacted] of R and B Builders to front him more money for the purchase of materials (that was already paid for) so that he could complete the job. The [redacted] of R and B Builders was suppose to continue to work on the weekends and complete the job by December 1st. He rarely showed on the weekends, and when he did it was for only a few hours. I wound up paying one of his worker to help my dad complete the job. My dad and this worker had to complete the deck and had to run the heating and air-conditioning duct work on their own. We had to hire additional companies to do the plumbing, electrical work and to do the driveway. The roofing and siding were never completed.Mr. [redacted] signed a new contract with us on November 10, 2012 that if he did not complete the job and pay back the additional money for materials by December 1, 2012 that he would pay us back the amount of $8027.40. (The amount he owed us for the unfinished work and additional money for materials.)I last talked to [redacted] in January when he agreed to make monthly payments back to me. He to this date has not paid us back a penny.
