Mr.** approached me one day while I was servicing a property near his home. Mr.** and I are disciples from the same church. Having been referred by fellow disciples from church, he invited me to meet with the Subdivision Trustee Board Members...

to discuss possible plans for installation of landscaping. He said he would be in contact with me with a date that we could meet. The meeting took place May 16, 2015 at the [redacted] it was attended by Ms. [redacted] Ms. [redacted] Mr.[redacted] Ms. [redacted] and Ms. [redacted]
Prior to the meeting, Mr.** took me around the subdivision to show me the common grounds and areas needing landscaping. I came prepared to the meeting with an estimate of the costs to mow the common ground areas of the subdivision. During the meeting they asked me to propose an estimate for landscaping at two entrance areas. We also talked about a plan to mow the common ground areas of the subdivision. During that meeting I gave them details about how I operate as a business. Their first statement to me at that meeting was, we've had some problems here and the number one problem that we have is installation of landscaping from previous landscapers. They would install the new landscaping, but did not have a system in which they could water so we lost a lot of landscaping over the years.
After the Trustee Board reviewed my contract for mowing services on a Bi-weekly basis, they accepted mowing contract with no changes. However, they refused to sign the contract. I disagreed with the trustee board at that time about not signing a yearly contract, because I also served in the capacity as a trustee on the board in my community. We never entered into any contracts without a signature for services that were to be provided. The board members for the Subdivision stated at that time that they only wanted to do a month-to-month billing for the services provided. Services were to start immediately. At that point I had one question for the board, who do I send invoices to? The board agreed at that time to send the invoices via email to Mr. **
My contract attached does not call for any pruning or weeding.
After going back-and-forth on many other details, the question came up about watering the plants; I stated at that time that my cost for watering the plants would be $65 per hour. At that time the trustee board did not question the cost they questioned the frequency. Trustee Ms. ** stated that we might even have to water more frequent in the months of July and August due to possible heat.
During the meeting there was a list of plants provided by Ms. [redacted] We talked about the plants listed that she wanted to see at the entrance monument areas. At that time, I informed the board that we might have to increase the watering, because these plants require more watering when you have excessive heat & temperatures in the 90's daily. They agreed, and stated we will start with a watering schedule of twice a week to all areas. Having plenty of experience in dealing with annual plants and taking into consideration there is no irrigation system. I proposed the landscape estimate based on the watering schedule that the trustee board chooses. In addition, I added some annual flowers, to the landscape beds; this was at no cost to the Subdivision.
After the initial meeting, I received a phone call on a few days later from Mr.** telling me, the board had accepted my landscape proposal. Mr.** stated at the end of the conversation that they were going to pay for the landscaping immediately and I should receive a check paid in full in about two days. I did receive a full payment for the landscaping to be done at the three monuments to the entrances of the [redacted]. Due to R & B Landscaping's schedule it was approximately 3 1/2 weeks before installation began on the landscaping. Therefore, there was plenty of time doing those 3 1/2 weeks for the trustee board to contact me to make any necessary changes to the landscape proposed. I have since come to realize the emailed Landscape proposal sent to Mr.** was never forwarded to the other trustees for review and concurrence.
To-date, everything that I planted is still there and doing well.
I'm not sure the Trustee Board understands what the agreed month-to-month services were supposed to be. In a verbal conversation with Mr.**, he stated that he turned in the landscape proposal to be paid by the City & Village Tax Office Management Company for the [redacted] without reviewing it with the board members. He stated, "I thought everybody was getting what they wanted."
We were not informed about dissatisfaction with the landscaping for approximately three weeks after the installation. At that time it was told by one Trustee, Ms.**-D that they wanted some annual planted within the landscaping scope. I stated earlier that I provided some annuals to the landscape proposal at no cost to the [redacted] Monument areas. I proposed a landscaping estimate in a timely manner, emailed it to Mr.** (Trustee), performed the job, and waited for about 3 1/2 weeks to install the plant material. I then received a call being dissatisfied two weeks about the landscaping is not timely enough in responding about being completely dissatisfied about a landscaping job.

13. What is this yellow stuff in my mulch?
This is a very common Yellow Slime Mold. It is not dangerous, though it may not be attractive. When the mulch traps moisture in the soil, it encourages the growth of this mold. If you want to remove it, pick the entire piece up, being careful not to break it apart. This might release the spores into the air, starting the life cycle of the slime mold again. Dispose of it in a plastic bag, to prevent the spores from spreading further.
A 25% refund is not warranted in this matter.
