My position remains the same as I stated in my first response to this complaintWhile there have been a few days when the weather has been acceptable to painting my work crews have been on other jobs out of townToday it is raining and then a cold front is coming inI WILL paint the affected fence posts even though there was no charge for painting and I do not guarantee the painting in these weather conditions

I have spoken to Ms*** on the telephone on occasions and I explained that I would repaint the affected fence postsI do not charge for painting fence posts because there is no guarantee on the paint because of the adverse weather conditions in Texas on the painted metal surfaces and the results of those conditions
I have also explained to Ms*** and to her fiancé, ***, on different occasions that these affected posts need to be repainted when weather conditions are above degrees and the humidity must be below 50%It will be of absolutely no benefit to paint the affected posts while the weather is below freezing (as is the case since November through the present time)
I will repaint the affected posts at no charge when the weather permits

conversation about the color. We chose the color that would last the longest. The contract did not say that the fence would be made of rusted and unpainted posts and gate. To replace the rusted parts, buy equipment and take time off from work, it will easily cost $10,000. The attached email shows that we had talked about paint when we first talked and he said it would be taken care of ASAP!:
