I am writing to explain my decision not to have you finish the work at my house. I have been very upset and have sought counsel on this situation. I want to explain why I have made this decision. These are the facts:

1. Initially I decided to hire you because of your wife [redacted] recommendation. She showed me a home where you were working. The mistake in the kitchen cabinets' size was blamed on Lowe's. I did not think anything of it at the time, but now I do.

2. I was reluctant to hire you because you refused to give me an estimate. However, I thought I would give you a try and see how things went.

3. After you painted my kitchen, the fence replacement and front porch redo were discussed. I asked you if you could do these jobs, and you assured me that you could, so we moved forward.

4. Next we discussed window and front door replacements. I asked you if you could do these jobs and you again said that you could. Nine windows and a front door were ordered. At one point I asked you if the molding around the doors and windows had to be removed for measurement, but you said no.

5. For the fence and window replacement, I budgeted $10,000. Excluding the cost of windows, to date I have spent $6,115.38 on your time and materials. The windows cost $3991.97. The total is $10,107.35, which is over my budget.

6. I contacted you to let you know that I had run out of money and to discuss the hours you worked. I also let you know that I no longer needed your services. We did not have a contract and you refused to give me an estimate. You had cost me too much money, way more than I had budgeted.

I wrote down the times that I had for you but you said they were wrong. When you came to my house, I calmly asked you to discuss the bill and you became very defensive and angry and said that I was accusing you of putting other clients' receipts on my bill, which I did not do. I restated calmly that I wanted to discuss the charges on the bill, and you again became angry and hostile and said I was accusing you of dishonesty, which I did not do. Frankly, I found your behavior unprofessional and intimidating. I should not have paid your last bill, but I did. You stated that you did not care about me; you just wanted your money.

7. After paying your final bill, I contacted two independent businesses to provide estimates to complete the work. The first contractor came over and the first thing that he noticed (and measured) was the front porch. It is not to code and will have to be rebuilt.

He measured the interior and exterior of all of the windows that you installed. His conclusion was that all of the windows are too small for the openings, many of the exterior openings were cut too wide for the windows, and the windows were not fastened securely, were not shimmed or caulked, and were not level.

8. The second contractor arrived at the same conclusion. He stated that it was the worst window installation that he had ever seen. Normal window replacement takes about 2 hours per window, including trim. You spent most of a day on the inside of one of the tall windows next to the French doors.

9. It will take three days with a crew of 4 men and will cost $5,000 to fix what you did. All windows have to be removed and replaced correctly. The front door that you measured without removing the trim is the wrong size. I have paid for the door and gotten it stained. The contractor is not sure he can make it work and I may have to buy another front door.

10. I purchased a light fixture and asked if you could install it. You said you could. After working with it for 45 minutes, you gave up in frustration and left for the day. I asked you if I should hire an electrician and you said no. However, I eventually hired an electrician to install it. It took him 15 minutes.

11. I had a fence company owner come over to give me an estimate on completing the fence. He looked at what you had done and remarked on the wide horizontal boards used to frame the fence. These wide boards give easy access to anyone who might want to enter my yard and are not what fence companies use to frame fences. It will cost $1000 to finish the one section of fence and the gate but will not correct the problem with the fence you built.

12. There is a deck contractor who is coming over on Tuesday to give me an estimate to correct my front porch that is now not at code. It will cost around $1000 to redo it.

It would be best at this time to sever all contact. Give me the same courtesy by not contacting me.

Desired Settlement: I would like to receive the money that I have paid so far, which is $10,107.35, plus the $5,000 that I have to spend for the window redo as well as the $1,000 for the front porch redo. This is a total of $16,107.35.

I mailed the original copy of the letter on 8/3/13. Defendant claims he did not receive the letter. On 8/7/13 I mailed the same letter to the defendant but sent it certified mail with a return receipt. I have not received the receipt. I do have a proof of mailing receipt from the USPS: it is #XXXX XXXX XXXX XXXX XXXX.

4. Regarding the replacement of the front stoop: Defendant told me that he was a general contractor. A general contractor knows city code and would follow city code in any construction. Defendant did not follow code in the construction of the front stoop because: "7. I did a search to see if you have a valid contractor's license in the State of Alaska and found no results for RPM Construction or for [redacted]. Alaska State Law requires that all contractors in the state have a license if more than $10,000 of time and materials is billed.

On 4/18/2002 RPM Construction, LLC had a contractor license no. XXXXX as a general contractor without residential contractor endorsement. The license expired on 12/31/2012 and has been in a lapsed status since 1/1/2013. The latest bond on file is no. [redacted] for $10,000 issued by Hartford Fire Insurance Company effective 5/20/2009. This bond was cancelled as of 5/1/2013 and there is a pending claim on file against this bond. "

5. The expenses paid to RPM Construction were itemized in the two previous letters sent to Defendant via Certified Mail, and are as follows:

I would not have asked the Defendant to do the work on my house if he had not assured me that he was a General Contractor and fully capable of completing any task. I trusted the Defendant's self proclaimed expertise as a General Contractor and he misled me.

6. Here is a quote from the two certified letters mailed to Defendant regarding the time worked: "10. At our last meeting I felt threatened because of your anger when I asked to discuss the bill, so I reluctantly paid the bill. I did not want to pay the bill because I questioned your hours and materials charges."

7. The defendant falsely represented himself as a Licensed General Contractor.

"7. I did a search to see if you have a valid contractor's license in the State of Alaska and found no results for RPM Construction or for [redacted]. Alaska State Law requires that all contractors in the state have a license if more than $10,000 of time and materials is billed.

The defendant did not correctly measure for the nine new windows and front door by removing all trim prior to measurement to acquire precise window and door sizes. Defendant damaged the interior drywall by tearing out the old windows and damaged vintage 1957 wooden exterior siding by tearing out the old windows.

Defendant did not follow code in the installation of the front stoop.

8) Photos of the damage done to my home (interior and exterior), text messages between Plaintiff and Defendant, and all invoices can be provided.

This is my response to the consumer asking me to pay $6,000.00 to cover costs of reinstalling 9 windows, a front door, and redoing the front stoop.

1) It was not necessary to remove all 9 windows and reinstall them. All windows were ordered correctly. I did not cut any holes in the home. All I did was take out the old windows, replace with new ones. It was the consumer's request to reuse interior moldings I removed. I even went so far as to reinstall old moldings on the new window so consumer could see how it would look. The consumer said that's what they wanted to do. All new windows were leveled and plumbed. The mouldings on all windows and door did not have to be removed to determine correct opening sizes.

2) The consumer is asking for money to reinstall front door. I did not take out the old door and did not install the new front door that consumer requested that I order for them. The front door that I ordered was used and installed for consumer by someone other than myself.

3) I requested and did not receive from the consumer an itemized accounting of the alleged extensive damage done to consumers home. I did no damage to the home and received no accounting from consumer.

4) I was requested by the consumer to replace the old painted decking on consumers front stoop with new composite decking. That is what I did. Nothing was ever mentioned about code issues by consumer.

5) The consumer documented that they paid me $12,957.52 in labor and materials. That is simply untrue. I provided to the consumer copies of all material invoices, which were paid, and separate invoices for labor which were paid.

6) What the consumer failed to mention in their complaint to you was they accused me of falsely charging for time worked. On July 2nd I worked 4.5 hours and was told by consumer I did not work because I had a doctors appointment. This is statement is false. On July 9th I documented I worked 8 hours and the consumer said I did not work because I had a meeting. This is also a false statement.

7) My original conversation with the consumer was I would charge them a rate of $45.00 per hour for labor and be reimbursed for all material invoices. This was agreed upon by both parties.

My position is I owe the consumer nothing.
