Initial Business Response /* (1000, 5, 2016/05/25) */
In response to Mr. [redacted]'s exaggerated complaint, we received payment for the upcoming remodel work on 1-30-2016 and planned on starting the remodel on 2-8-16. Prior to starting the remodel, Mr. [redacted] hired an insulation/mold abatement...

contractor to start their portion of work the first week of February, which was supposed to take approximately 3-5 days. That work was not completed until 3-2-16, and with my assistance helping out the insulation/mold abatement contractor complete their job. I also had to dispose of that contractors old insulation/debris (64 bags @55gal each) at my expense, in order to free up garage space for the material delivery. By this time, my time frame for the job had already been pushed out by almost 4 weeks. Mr. [redacted] told me throughout the previous weeks to take on other work as needed while waiting/working on his home. On 3-2-16, I started demo work on the home and already had materials ordered and delivered on 3-4-16. I kept Mr. [redacted] up to date on the house progress, either by phone or through text messaging. I continued work on the house, which included demo work, drywall hanging/finishing/skimming walls throughout the entire house during that phase of the remodel, and met with Mr. [redacted] in person on 3-24-16. I felt the remodel work was moving along quite well considering the delay I had, due to the other contractor putting me behind on the remodel. Mr. [redacted] NEVER expressed any concern about the state of the remodel or time frame of completion, during our face to face meeting. We discussed the remodel and some changes that were made and not included in the original contract, such as dividing walls being built in the basement and a half wall built around the stairwell to the basement instead of railing. Mr. [redacted] seemed happy with the progress and told me he'd see me in approximately thirty days. From the afternoon of 3-24-16 to 4-17-16, I was unable to speak with Mr. [redacted] or discuss any remodel issues with him due to him being in jail during that time. I continued work on his remodel as planned and ran into a few plumbing issues that had to be discussed with Mr. [redacted], along with some pest removal issues that needed addressed. Portions of the work had to be slowed down until I could discuss these issues with Mr. [redacted], which wasn't until 4-17-16 when I received a nasty message from him, as he was released from county jail. We exchanged several text messages and planned to meet the next day on 4-18-16. After a heated debate in person with Mr. [redacted] and his brother on 4-18-16, Mr. [redacted] signed a new contract with me and we "scheduled" to get the job done on 5-9-16 with the understanding that Mr. [redacted] would get the plumbing and pest issues resolved so I could complete the contract work on my end. Within a couple of hours after meeting with Mr. [redacted] and signing a new contract, the police show up and told me I wasn't allowed on the jobsite and that I need to pack up my tools and leave. I showed the police the new contract and told them that I had j[redacted] met with Mr. [redacted]. By this time Mr. [redacted] was calling my phone telling me to disregard the police, and at that time, the Officer requested to speak with Mr. [redacted] on my phone to resolve things, so I handed him my phone. Once the officer was done speaking to Mr. [redacted], his outward opinion to me was that I should j[redacted] walk away from the job, since Mr. [redacted] was causing unj[redacted]ifiable issues. I continued work on the house that day, after the police showed up, and spoke with Mr. [redacted] through text messaging discussing the police incident. I was pretty aggrevated at this point, but continued working on the house and texting with Mr. [redacted]. Then Mr. [redacted] suggested that I j[redacted] give him back $4000 dollars and all materials and walk away from the job. I told him several times that I have every intention of finishing the job and that I owed him nothing back considering all the work I had done on the house. The course of action he took with calling the police wasn't necessary I told him, considering I never abandoned the job and continued to work on the property, leaving all of my tools on the jobsite every single day since the start of the job. I only heard from Mr. [redacted] a few times between 4-18-16 and
5-2-16 and the plumbing and pest issues were never addressed during that time, which were holding up some of the work progress. I still continued working off and on during the next few weeks leading up to 5-9-16. I completed all the interior painting on the main floor, building dividing walls for the basement, cleaning and prepping the basement walls and rafters for paint, etc., and still Mr. [redacted] never sent anyone out to address the plumbing issues or pest issues as we discussed in our previous face to face meeting on 4-18-16. On 5-8-16 (Mothers Day), I received a threatening voicemail from a police office, so I called him back immediately to address the call. When speaking with the officer, he said that "its a felony to take money for a job and never start the work", which was inaccurate information given to the officer by Mr. [redacted] and Mr. [redacted]'s brother. At this time, I hadn't heard from Mr. [redacted] in several days and had no idea what was going on. I told the officer that I had a contract with Mr. [redacted] and that the job was "scheduled" to be done on 5-9-16. The officer said he was going to investigate Mr. [redacted]'s complaint and find out more information since I had a contract to be on the jobsite working. On 5-9-16, I went out to Mr. [redacted]'s house, only to find the locks had been changed by Mr. [redacted]'s brother and all my tools were locked up inside the house and had no access to them. I called the police out to the Mr. [redacted]'s house to meet with me and they told me that they were taking matter to the prosecutor since locking up my tools was considered "theft". So at this time, we are in litigation with Mr. [redacted] and his brother, and he is in "breach" of contract by locking me out of the property prior to the contract scheduled end date. Possible theft charges might be filed as well against Mr. [redacted] and his brother for locking up my tools and denying me access to them.
Initial Consumer Rebuttal /* (3000, 7, 2016/05/26) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The response from Ralph R[redacted] is total lies and deception. From 3/24/2016 till 4/18/2016,Ralph R[redacted] never stepped foot on the property for the remodel. He never showed up to perform any work whatsoever during that time period. He made a verbal commitment to me on 3/24/2016 that the remodel would be complete by 4/13/2016.I also have a text from him dated 3/19/2016 where I inquired about the remodel being done by 4/13/2016,Ralph R[redacted] responded by saying that no matter what,I will have it done by that date for you.Text arrived at my phone at 8:36 am CST.There was never any intention on R&R drywall to follow thru with their end of the deal.As far as for the locks being changed,my legal right as to being the homeowner is that I can change them whenever I want,he was never ever denied access to the house to work,he never went to the premises to work between 4/21/2016 to 5/9/2016,there were written instructions left on the front door for him to contact me so I could arrange for him to have entry, that contact was never made by him till 5/9/2016 at 12:22 pm CST,all he did was threaten me with police action at that time.I have all the phone voicemails and text messages from Ralph R[redacted] regarding this matter. If you think that Bill and Hilliary are crooked thiefs,Ralph and Tracy R[redacted] make them look like angels.Ralph R[redacted] breached the contract by non completion of the remodel by 5/9/2016.Asfar as to his allegations of plumbing and pest problems, there was never any communication relayed to me by him personally. All I want is or my toatal bill of $13250.00 refunded back.
