I am rejecting this response because:
First, payment on my part requires that the contractor's work be performed in a good and workmanlike manner.  It is undisputed and they even acknowledge that the pool is damaged.  The contractor claims that it is the manufacturer's responsibility without ever bringing the manufacturer on site to inspect the damage.  Further, the contractor does not provide the warranty for the pool, the manufacturer does.  The contractor's "claim" that the damage is covered by the warranty does not bind the manufacturer in any way.  Realistically, the manufacturer will likely identify the damage as being caused by improper installation on the part of the contractor or its subcontractors.  In addition to not bringing the manufacturer on site to inspect the pool, the contractor refuses to provide the warranty information that would allow for us to contact the manufacturer directly regarding the damage and getting the pool inspected/repaired.  The refusal to provide this warranty information further leads me to believe that the manufacturer will reject any warranty claim because the damages were caused by the contractor and/or subcontractors.  I will then be stuck in the middle between a contractor saying it is the manufacturer's responsibility and the manufacturer saying it is the contractors fault.  The depth and location of some of the scratches along with the contractors refusal to address the issue with the manufacturer brings into question whether an effective, long lasting repair can even be done.  Finally, the contractor has never provided accurate invoices as to what is allegedly still owed.  It is my position that only $900 remains due and I have correspondence from the contractor which supports my position.  Despite this correspondence, the last invoice I received from the contractor reflects $1500 due. I will not pay on an erroneous invoice or make a payment that is not acknowledged as being all that is due. Final resolution to this issue will only occur with the manufacturer, contractor and myself physically reviewing the pool installation and damage.  If the manufacturer acknowledges that the warranty covers the damage at no additional charge to myself, a timeframe is established as to when the pool will be repaired and a correct "final" invoice is presented from the contractor, I will write a check for $900 at that time.  As it presently stands, THE CONTRACTOR HAS NOT PROVIDED THE ORIGINAL CONTRACTED SERVICES, A NEW UNDAMAGED POOL FOR MY FAMILY.

After installation was completed we tried to buff out some of the scratches. After a point we realized that the warranty would cover the remainder of the damage. The consumer would still need to pay in full before the warranty would apply. We have completed our end of the contracted work.
