Initial Business Response / [redacted] (1000, 10, 2014/11/26) */ The customer contacted us about a stain the sidewalkWe were never contacted by an attorneyWe are unsure of how the original stain came to be on the sidewalkHowever, concrete is not covered under warrantyOur superintendent went out to the customer's home anyway and decided to take it upon himself to get this issue resolved for the customer, even though the issue was not covered under warrantyWe asked the customer to choose a concrete stain color and told the customer we would purchase the stain and have someone come out and stain the sidewalk to cover up the spill stain they were concerned aboutThe customer tooks three weeks to choose the stain colorOnce the customer finally chose the stain color, we purchased the stain and a sprayer the same dayWe sent one of our guys out to stain the sidewalkHe stained the sidewalk and, as a further courtesy to the customer, left the container of concrete stain and the sprayer on the customer's porch for himThe work is not incompleteWe did not have to stain their sidewalk in the first place, but we did as a courtesy to the customerI believe the customer is stating that the job is incomplete because we did not stain the porchHowever, we never agreed to stain the porchThe porch is not part of the sidewalkWe purchased and gave to the customer the leftover concrete stain and sprayerIf he wants his porch stained, he was given free equipment to do it with In reference to the customer's other complaints: - Professional painters do not stain sidewalks or any other type of concreteIt is not part of their job or skill setWe have never used a painted to stain concreteThe courtesy sidewalk staining was done by a qualified person and work checked by a supervisor -As far as the delayed home completion goes, no builder can guarantee a completion dateHome building, as with all other outdoor work, is completely dependent upon the weatherHowever, we actually closed this home early to accommodate the customer and their need to move in early -As for the complaint of moving into a dirty home, these customers needed to move into their home early and we did everything we could to accommodate themThey were aware that they were closing on and moving into their home without the finishing touches, like a final cleanWe do not typically allow customers to move in early, but we really went out of our way to help these customers -There were no dangerous furnace connections per the City of Oklahoma CityThis home passed all city inspections -There was one alcoholic container found in the home, not manyThe superintendent was made aware of this issueAny time a subcontractor is caught drinking on the job, they are fired immediatelyHowever, in this instance, it was unclear who the open container belonged toWe do not permit drinking of alcoholic beverages on the job and will always take action when it is clear who action should be taken against There are no unresolved issuesThe original issue of the complaint was not a valid issueConcrete is not covered under warrantyWe went out of our way to appease this customer even though it was not our responsibility per our home warrantyThere is nothing further to be done

We asked the customer to choose a concrete stain color and told the customer we would purchase the stain and have someone come out and stain the sidewalk to cover up the spill stain they were concerned about. There are no unresolved issues. The original issue of the complaint was not a valid issue. Concrete is not covered under warranty. We went out of our way to appease this customer even though it was not our responsibility per our home warranty. There is nothing further to be done.
