Initial Business Response /* (1000, 5, 2015/12/24) */
To our recollection, this vehicle did indeed have some very minor cosmetic concerns, and we made 2 attempts for repairs, which cost the dealership directly. Both attempts were unsatisfactory to the customer. Being a black vehicle and new paints...

that are available, it would be very difficult if not impossible to produce a perfect end product. The vehicle did have 256 miles on it when purchased, which means it had been driven some. Therefore it may have some minor cosmetic flaws. We feel our efforts have gone beyond reasonable action. Customer has even come back to the dealership to "trade out" of the vehicle, but this is not possible at this time. The dealership will make no offer of a price reduction or credit toward the purchase of the vehicle and no further repairs or attempts to repair these concerns will me made, and will be limited to honoring the requirements of the warranties offered on the vehicle. thank you.

Initial Business Response /* (1000, 5, 2016/01/07) */
The complaint has been reviewed. the sale price of the vehicle was fair and reasonable. And the trade in valuation was generous. I'm also quite sure that there can be differing opinions of bank representatives on values of items. We had no...

problem getting this vehicle financed for this customer with our lenders. If the customer felt like personal bank financing was going to be better, then that route should have been taken at the time of purchase, not after the fact. We feel that this deal was fair, and all documents are properly signed by all parties. Everything is clearly spelled out in the contracts, the trade has been sold (for a net loss by the way) therefore, at this point in time we feel that there is no action necessary on behalf of the dealership, other than honoring the warranties that are currently in place on the vehicle.
Initial Consumer Rebuttal /* (3000, 7, 2016/01/08) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The car we purchased was financed at 22484. This was AFTER a 3500 trade in. We are not arguing that was trade-in value they gave us was generous, however, that means they sold us the vehicle for 25984 when a BRAND NEW 2015 Kia Sorento suggested retail is 24200. This car is used with 52000 miles. Suggested retail on the certified pre-owned 2014 Kia Sorento we were sold is between 18900 and 21100. We were not looking to refinance just yet, our loan officers were simply looking into the matter for us. They were so shocked to see what happened that they told us they would never shop here and suggested we contact the Revdex.com. Certified pre-owned and tiny warranty aside, the price of the car was jacked up and they made it look like a good deal by giving us a higher trade in. I do believe they took advantage of our inexperience. They lost our business and any business they hoped we would bring in by referrals. They never even MENTIONED selling price until we were in signing, and we almost backed out. They assured us everything was fine and that they were actually going to LOSE money on our sale, which is just plain untrue and misleading. I just wish we would have caught this sooner (Lesson learned).
Final Business Response /* (4000, 12, 2016/01/21) */
The Consumer's response has been reviewed. The Consumer agreed to the sales price, which is reflected in the documents executed by the Consumer at the time of the sale. It is unclear where the Consumer obtained the estimates regarding the vehicle's value, but vehicle valuations and suggested retail prices are opinions and may vary from vehicle to vehicle. Actual valuations may vary based upon market conditions, specifications, vehicle condition and other circumstances pertinent to the particular vehicle, the transaction, or the parties to the transaction. Furthermore, the suggested retail price noted by the Consumer is consistent with the price the Consumer paid for the vehicle. The amount financed includes additional optional products purchased by the Consumer, and the terms of the sale and financing are clearly set forth in the contract. We worked with the Consumer to reach the terms they agreed to, and unfortunately have no control over the Consumer's efforts to refinance the vehicle. We maintain that the deal was fair and clear, and continue to feel that no action is necessary on behalf of the dealership, other than honoring the warranties that are currently in place on the vehicle.

Response:
Upon my review of all the sales documents it clearly shows that all terms were clearly reviewed with the customer(s). Including the price of the vehicle, the trade in allowance and finance rate. The negative equity in the trade, of course has to be refinanced and included in the deal. We have an addendum posted on all our new vehicles, which clearly indicates the additional dealer mark up we have. As far as the claim of being taken advantage of because "being two women" is preposterous at best. Our demographic of customers is predominantly women. And besides that's unethical and illegal, and we DO NOT operate that way. As far as any dealer saying it was the worst deal they've seen: I'd say they haven't seen this deal correctly. Looks like as a dealer, after paying the salesperson a minimum commission, I LOST $106.95 on the deal. I see no grounds for any type of complaint here. No settlement will be considered or entertained.
I would however be glad to supply the customer(s) with our attorney information if they'd like to discuss further.
