interested party. On 6/16/15 we received a call from the interested party referencing trailers we had just posted on line with an asking price of $8,500.00. Our ads clearly state the terms of sale and that any offer even at the listed price is subject to our client (Banks) review and approval. The interested party stated he had seen the ads and wanted to go and look at the units. Arrangements were made and about an hour later he called and stated he had inspected all of the trailers. After making several offers his final offer was $8,245.00. He wanted to wait and see if the bank would take this offer and stated he was willing to wait to hear back from us. At no time did he say or imply that he was staying in a hotel to await an answer. We advised him we would submit the offer but it was up to the bank and we would call him once we heard back from them. The following day 06/17/15 we received word that the bank had turned down the interested party offer and had asked us to raise the advertised price to $11,500 for they felt the units were worth more. As of that time no one had made an offer at the current advertised price of$8,500. We notified interested party that his offer was not accepted. We explained that the bank decided to raise their asking price to $11,500.00. He felt this was ridiculous for he had taken his time to drive over and look at them and then waited 24hrs to hear back from us. He said he understood and the call ended. Again at this point he had made no reverence that he was staying in a hotel during this time and waiting by the phone for our call otherwise we would have told him not to. The following day 06/18/15 he called and spoke to the manager of the department and stated he drove over 200 miles, stayed overnight (first time he mentioned this) and offered $8,500. He was later told that the bank didn't accept his offer and now they wanted $11,500. She reviewed the notes and stated you didn't offer $8,500.00 but $8,245.00 however, if you are now she would note the account however the price was currently $11,500 per the banks request. She explained the terms of sale as stated in our ads and that sometimes this can happen that's why we state it in the ads. He stated he understood this but still didn't like it. He stated he was calling the Revdex.com to talk to them. He felt even though it states the terms of sale in the ads he felt we should have told him before he went to go look at it. He said he would even pay $9,000 if they would take it now. We advised the bank of his offer and his feelings. He called back later that afternoon but we had not heard back from the bank. The following day 06/19/15 we let him know we had not heard back from the bank and were awaiting their call. He stated he was still in NJ and would now offer $9,500. We said we would let the bank know. He requested to be notified ASAP for he was staying in NJ until he heard from us for he really wanted the trailer. We called back later that day and advised him they would not accept his offer of $9,500 at this time. They countered at $10,000 and he turned their counter offer down. He wanted to know if he offered $10,000 how long it would take to get title and once explained he decided not to change his offer. About 10 days later they the bank approved any offer at $9,500. We called him and he said he would have to check with the guy to see if he was still interested. We followed up twice but each time was advised a decision had not been made. We let him know we appreciated his interest however if they didn't want it now we would then sell to the next party in line. This was the last call we had with the interested party. In conclusion: At all times we were honest with the interested party in how the process worked and the terms of sale. We understand his frustration with the price increase of the product but that's why we clearly state the terms of sale in the advertising we do. Had we know up front that he was driving 250 miles and staying overnight locally to await a response from the bank we would have told him not to, only come look and make your offer but don't stay. However he didn't disclose this until towards the end of our discussions with him. It latter appears in our conversations that he wasn't even the party interested in purchasing the unit but someone else he knew. While we sympathize with this interested party we feel we were honest and up front with all of our discussions and dealings on this deal. Had he been the same neither of us would be addressing this subject. His desired settlement is not a reasonable request all things considered.
