[redacted] , Apologies for the delayed response We thought this issue had already been resolved because the customer was refunded his security deposit This is in response to [redacted] pursuance of the application fee, after his security deposit was already given back to him, for an apartment which he made the decision not to take We now view this as a fraudulent complaint We have signed documentation that he received a full refund of his security deposit Applicants acknowledge that application fees are non-refundable when they sign at the bottom of the application form Furthermore he agreed to take the room in the apartment, then later re-negged on this decision and therefore backed out after he had met and was approved by the landlord Typically in this situation an applicant would forfeit their security deposit Please see attached: -a copy of the application (the bottom paragraph before the applicant's signature) which Guillermo filled out -a copy of the deposit agreement signed and dated in the bottom right hand corner acknowledging the applicant received the deposit Management [redacted]

Regarding the complaint ID ***, we do not feel this is a valid complaint since we have email correspondence proving that we tried to schedule a time for the applicant (*** ***) to stop by the office and pick up her refund She indicated that she was still in New York, but wanted a

This is not an applicant but in fact the mother of the applicant who would be moving into the specified listing. Upon applying they were instructed to do the amounts stated but any additional charges (outlined on our offices Deposit Agreement) can be incurred given the application of another party,...

additional securities requested by the landlord, etc. They were never informed the exact move in date was set for the [redacted] as we would never guarantee an exact move in date for any client pending approval (which was given to them in a timely manner on our offices behalf). A landlord can take time to view files and the applicant should be mindful that this is out of our control. We mentioned the [redacted] would be a date we can shoot for but they should have flexibility given it's an incomplete room file and the soon to be tenant was living in the home of his mother. This applicant's refund is still being processed at this time and they will be scheduled as soon as possible. In the meant time, they're chosen to lash out by making this complaint which is extremely unnecessary given communication is through and close to completion. Nevertheless, we appreciate there business and truly wish all parties the best.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.On Aug [redacted] I filed a complain with Bway Apartment howeverhso much back and forth they finally agreed to pay me my refund.Today I picked up a check for my full deposit and unless check returnsunsufficient this case can be closed.
