I purchased a racing rivet gun from Racing Rivets through *** in July 2017. I paid *** for the item purchased and *** purchased the item from Racing Rivets and had it dropped shipped to my home. The item came with a warranty. They rivet gun was not working properly, I contacted Racing Rivets and was asked to return the item for a warranty replacement. Once my item was returned, I confirmed with Racing Rivets it was received. Racing Rivets advised me *** has not paid there bill so therefore it was stolen property. I provided Racing Rivets the invoice where I paid *** for the item and provided a copy of the packing slip where it was dropped shipped to my home. Racing rivets will not release my rivet gun until *** pays their invoice in full. *** is no longer in business. Racing Rivets will not accept my invoice from ***, the packing slip or my bank statement showing where the money was taken out of my bank account for the item I purchased. I do not feel that I should be help liable for an issue with a company that is no longer in business when I paid for the product, but now I am left without anything as Racing Rivets will not return my product. This has been an ongoing issue since January 2020 and I have given Racing Rivets ample time to resolve this issue.

We have been working on this issue for quite some time as the reporting party has stated. As a company we do not offer any retail or direct to consumer dealings. The tool that is mentioned in the complaint needed to be fulfilled by the selling company (***). We as the creators of the tool, repair, service and cover any warranty issues but the billing and fulfilment of any accrued expenses is to be taken care of by the seller of the tool (***). Racingrivets.com has continuously attempted to contact *** about this issue AND their extremely past due invoices with no success. We are attempting to investigate this issue and have held onto the tool for evidence reasons on our company's behalf.
The tool stated in the complaint will be returned in the future without repairs being done. The tool was purchased in 2017 and has a 90 day warrant. The tool is not under any warranty coverage. We recommend the complaining party try to resolve this issue with ***. We wish them luck.

I am rejecting this response because: the statement made by the company is untrue. We have asked for the rivet gun to be returned to us on multiple occasions without repairs made and they have declined as they refer to it as “stolen property”. We also offered to pay for any repairs that may need to be completed in order for the rivet gun to work which they have also declined. We have also asked to purchase a new rivet gun and we were told they do not sell to the public. We want our rivet gun returned to us ASAP or we want a replacement. We will not settle until we have a tracking number showing where our rivet gun is shipping back to us.
