The client is correct in that she requested to cancel her membership in August Because she requested to cancel her membership within our day cancellation window, her last payment was scheduled for 9/1/Our membership cancellation policy states (which she agreed to multiple times during the sign up process) that to terminate the membership agreement and stop all further payments, a $membership cancellation fee is required to be paidTo make things very clear to the member, I always ask for confirmation to charge the $cancellation feeAnd the client did not respond to my email requesting to confirm the payment for the cancellation feeThis is why her ACH membership payments were attempted to be charged and her cancellation fee was never paidTherefore, her membership was actually never cancelledThe reason I was unaware of the declined membership payments was due to a now known glitch in the merchant payment system we use to process ACH paymentsBecause of this glitch, we are no longer accepting any new ACH payments for membershipsACH payments are processed differently from our credit card paymentsOur membership payments are also set up to process automatically every month for the term of the agreement.I understand that the client wants to dispute the final membership cancellation fee amountBecause she never responded to my email asking for confirmation to charge this fee it was never processedIt wasn't until I emailed her to inform that yes I was going to send her account to collections because her payments were declined and herbalance was past dueI am willing to disregard sending her account to collections if she pays the membership cancellation fee ($250.00)This will terminate her membership.EARLY CANCELLATIONAny early cancellation of a membership agreement you purchase from Impact Ultra Fitness, LLC d/b/a Monkey Bar Gym Milwaukee is subject to a $cancellation feeAny early cancellation of this Agreement must be submitted in writing to MBG management days prior to the next scheduled membership paymentAny payment within your day notice to cancel is required to be paid in order to fulfill your membership cancellationAbsent any provision in this Agreement to the contrary, if you wish to cancel during the term of this Agreement, you shall be required to pay a $early termination fee, and shall be current on all other amounts owed under the terms of this Agreement

Thank you for providing me all the email recordsI keep very accurate records of all my communication with clients, and have copies of all the attached filesAs for the reason why she was only charged the $and not the $cancellation fee on 9/1/is because she did respond to my confirmation email regarding specifically charging the $membership cancellation fee.This fee is not charged to the clients card/account at the same time as the monthly membership paymentThese are both charged separate, as in two separate transactionsThe membership payments are set up for automatic withdrawal from a credit card or an ACHBecause the client never confirmed that I should charge her card the $to actually cancel her membership, her membership was not actually cancelled outAnd her monthly membership payments continued on as scheduled for the term of her ori***l membership agreement contractBecause the client "stopped payment" with her bank for the ACH transactions, all her payments after 9/1/were declined.I understand that the client believes that she should not have to pay the cancellation fee to terminate your agreement, but unfortunately that's the only way to do itJust because a certain amount of time has lapsed, does not release her of the responsibility to the contract/terms of service, including the cancellation policy she agreed to when she signed the contract.If the client does not resolve her defaulted membership by 7/14/by paying the membership cancellation fee, then I will be sending her account to a collections agency and she can settle her debt with them.The only way to resolve this is for the client to pay the $membership cancellation feeIf she declines again, then her account will be sent to collections on 7/14/Thank you

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Attatched are the last three emails sent between myself and the owner of Monkey BarAs you can see my first sentence was "I would still like to cancel" and as you can see his last words were "ok,sounds good" In the previous email the owner explains that $will be withdrawn on 9/1/I accepted and asked to still continue with the cancellationI do not believe I should pay the $when the business failed to withdrawal the amount at the appropriate timeIt has been months since the cancellation and you can see from the last attached email, the owner claimed to have recollection of me even trying to cancelI should not suffer months later for Monkey Bars error

And the client did not respond to my email requesting to confirm the payment for the cancellation fee. I made it more than clear to the business owner that I wanted to cancel my membership. It is apparent that Monkey Bar gym has poor business practices and doesn not keep accurate records of communication. This should have been resolved almost one year ago. I am extremely disappointed at the lack of accountability taken by the gym. I would never recommend this gym to anyone and I will be leaving several reviews on this incident.
