I am rejecting this response because: Permission was NOT given for our Norway Maple to be cut on 8/28/ Rainbow Treecare was informed at that time that the neighbors are doing so to intentionally harass us as they have done for years We did not give express permission for our tree to be cut and I told them that I was very upset to have my tree cut Our tree is over years old and now has white fungus on its branches, the proximate cause of which is Rainbow Treecare's negligence and aggressive pruning I have many photos from and early that shows the tree healthy with no white fungus I have never received one phone call from Rainbow Treecare expressing an apology or a phone call to resolve this issue My phone number is ###-###-#### and I have no messages from Rainbow Treecare on it There are several large branches still dangling precariously from Rainbow Treecare's aggressive pruning in September I have a year old girl that could be seriously injured as a result Rainbow Treecare is liable for any and all injury that may result and needs to come to my property ASAP to remove those branches My husband has called in September and requested someone to come out and to date, no one has He also informed the arborist of this issue and he said "he wasn't able to do it at that time." I am requesting that Rainbow Treecare fertilize and treat my tree for the next months to restore my tree to complete health at no cost to me or my family Their acts have caused me and my family emotional distress and my tree looks very bad I REMAIN VERY UPSET WITH RAINBOW TREECARE AND THEIR NEGLIGENT AND RECKLESS EMPLOYEES!!!!!!!!!!!!!!!

Dear Revdex.com, In response to the complaint filed on February 8th, 2018: Rainbow Treecare was first contacted regarding this dispute by [redacted] on 6/24/She expressed to Rainbow's finance team her upset regarding the expectations for pruning work she had hired Rainbow to complete [redacted] provided partial payment for the work until a further resolution could be reached Consulting Arborist Charles [redacted] and the Rainbow finance team attempted to reach [redacted] numerous times following her initial statement of complaintRainbow Treecare was contacted by Ivan [redacted] (the independent contractor who had referred [redacted] to Rainbow) in August of Ivan was told that [redacted] needed to contact Rainbow to resolve the disputeThe complaint filed through the Revdex.com is the first contact Rainbow has received from [redacted] since June of Rainbow takes these sorts of complaints very seriously - Rainbow is a company that is founded on accountability, honesty and integrityWhen these situations occur it is critical that a Consulting Arborist visit the property to evaluate the work so a resolution can be reachedRainbow Treecare is interested in having a follow up conversation with [redacted] regarding this issue, and requests she call Rainbow Treecare Customer Service Manager James [redacted] at ###-###-####

Respond to Complaint [redacted]   Dear Revdex.com,   On May 29th, 2016 a claim was filed toward Rainbow Treecare related to a product issue.  It was reported by [redacted] who allegedly purchased a fungicide named Alamo on August 14th, 2014 (21 Months ago).  ...

The complaint suggests the product froze causing the contents of the bottle to leak.  The product Alamo is an EPA registered fungicide labeled for treating trees.     First, Rainbow Treecare has no record of this purchase or anyone with this name or address.  The address leads to a UPS store in Cn Rapids, Minnesota.  Also, we also have no voice message from Mr. [redacted] attempting to reach Rainbow Treecare.   We are unsure if this product was obtained directly from Rainbow Treecare or a distributor and if Mr. [redacted] represents a business, a government entity or was intending to use it for private use.   Rainbow Treecare is a distributor of a fungicide labeled for use in trees called Alamo.  The fungicide carries a label that is approved and issued by the U.S. Environmental Protection Administration which does direct that the product be stored in a cool, dry place.   The chemistry of Alamo does not allow for freezing at 0 Celsius but one would need to expose Alamo to extreme temperatures of below –20 Celsius.  Even at these extremely low temperatures Alamo does not contain ingredients that would expand when frozen causing the package to crack.  The label states for the product to be “Stored in a cool dry place".  Rainbow admits that the EPA does not instruct the user on how not to store the product , but rather informs the user on how to properly store the product, which in this case may not have been followed.   Rainbow has had no other complaint related to Alamo leaking from a cracked container.   Rainbow Treecare has always stood behind our products and services but we lack critical information about the storage of the Alamo and the transaction with Mr. [redacted] to make any determination on what happened.  We do suggest Mr. [redacted] contact Rainbow Treecare Scientific Advancements by email at [email protected] and include any information related to how he purchased the product and the photos Mr. [redacted] has taken.  On additional option is to call ###-###-#### between 8am to 5pm and request to speak to a customer service representative on our Scientific Advancement team.   Rainbow Treecare

I am rejecting this response because:
The label for the Alamo product in question clearly states that "the  buyer and user accept it, subject to the foregoing Conditions of Sale and Warranty, which may be varied only by agreement in writing signed by a duly authorized representative of Novartis" The label as attached that came with the product is what governs this matter.  Clearly the label does not in way provide for a dated shelf life nor does it say to store in above freezing temperatures. No where on the label does it say to use by a certain date or discard.  The label clearly states the conditions of sale and warranty and further state if before use of the product if I disagree with the terms of sale and warranty I may return the unopened container. There is no time frame listed on the label anywhere that I must return it by.I disagree with the terms of sale and warranty thus I request to return it per the written warranty and terms of the sale as stated on the label.

Dear Revdex.com, In response to the filed complaint on September 15th, 2016: Rainbow Treecare was hired by the homeowner residing at [redacted] to prune the Norway Maple located at [redacted] to prevent branches from growing over the tops of crabapple trees located on...

their property. This work was completed on 8/28/15. No cuts were made on the 4909 side of the property line – as is in line with MN state law (property owners are able to trim encroaching branches or roots up to the property line at their own expense). Prior to this work being done, Rainbow Treecare Consulting Arborist Jeff [redacted] met with [redacted] (homeowner at [redacted]) to inform him about the pruning Rainbow was going to perform on his Norway Maple tree, and was not met with complaint.   Rainbow Treecare was again contracted to prune the Norway Maple located at [redacted] S on 9/15/16 (no cuts were made on the 4909 side of the property line). On 9/19/16 [redacted] & [redacted] contacted Rainbow Treecare to schedule an appointment with Rainbow Treecare Consulting Arborist Jeff [redacted]. On 9/21/16 [redacted] & [redacted] contacted Rainbow Treecare to reschedule the appointment from 9/22/16 to 9/26/16. On 9/26/16 Rainbow Treecare Consulting Arborist Jeff [redacted] met with [redacted] to inspect the Norway Maple that was pruned on 8/28/15 and 9/15/16. Mr. [redacted] suggested that the pruning performed by Rainbow Treecare was causing branches in the Norway Maple to turn white and die, then fall from his tree. Rainbow Treecare Consulting Arborist Jeff [redacted] inspected the tree, and informed Mr. [redacted] that the white growth is a fungus that grows on dead branches, and that large dead branches were falling out of his tree because it was in need of Crown Cleaning to prune out dead branches. Using his daylight laser, Mr. [redacted] highlighted where there were other large dead branches throughout the inner canopy of the tree, and explained that Norway Maples are shade-intolerant – the inner canopy branches will die due to shade from the outer canopy. He explained that white fungus grows on a branch only after it has been dead a year or more. Mr. [redacted] appeared to be satisfied with this explanation, and Mr. [redacted] informed him that we will refrain from pruning the Norway Maple moving forward. After receiving the complaint filed on October 12th, 2016, Rainbow Treecare Customer Service Manager James [redacted] immediately attempted to contact [redacted]. Mr. [redacted] attempted to contact Mr. [redacted] on October 13th, 2016 and left a message. Rainbow Treecare has not heard back from [redacted] or [redacted]. Rainbow Treecare is interested in having a follow up conversation with [redacted] or [redacted] regarding this issue, and requests they call Rainbow Treecare Customer Service Manager James [redacted] at ###-###-####. Rainbow Treecare Consulting Arborist Jeff [redacted] has offered to visit with [redacted] and [redacted] if they would prefer a face to face discussion.
