Complaint: [redacted] I am rejecting this response because:This business in my opinion is practicing advertisement techniques wherein their mailings area confusing and misleadingThe mailer they attached is what I received and as you can see in big bold letters at the top it states "Complete this survey within 48hrs for a complimentary gift card"The above statement makes it seem as though this is a one step process and after completing the survey you will receive a $Amazon gift cardThe bottom portion which the business highlighted for ease of seeing is not highlighted on the actual mailer and does not state what a "short study" isAs a consumer I assumed the short study was the survey I had takenIn the businesses response they claim businesses wouldn't give people a $gift card for taking a short survey which is not only bu it also focuses on assumptionIn the highly competitive business world knowing your client gives you an edge over your competitors and thus it is not a far stretch to assume a business would be giving a $gift card for a survey in order to get to know its customers better than it's competitors and gain an edgeFurthermore, nowhere on this card does it say the name of this business, the return address says "front range research" which, only after a google search, I was able to find out is the name of this company's advertising armI assumed this was a short survey by a research company within my area trying to find out more about its residentsWith that being said, giving away a $gift card which is clearly stated at the top of the mailer in exchange for information about residents is not a far stretch at all and seems very reasonableThis company is trying to confuse people with this advertisement Sincerely, [redacted] ***

Regarding the concern from *** *** on 02/23/18, Rainsoft of Denver responds asfollows.The original installation date for their water system was 03/11/After receiving aconcern that the system was not performing to their satisfaction they were upgraded from anECto an ECconditioning
system (times original capacity) at no charge withsubstantial cost to the companyThis resolution and the resulting water quality provided by thenew system were deemed acceptable by Mrand Mrs***.In December of they called expressing a concern that the system had stoppedworkingOn 12/15/a technician performed a full diagnosis and regeneration at no cost.Furthermore, the technician arrived for a follow up inspection on 12/20/16, finding the systemperforming as it shouldThe customer, again, incurred no cost.With nearly a year gone by without incident, the customer was contacted for an annualinspection and filter replacement and scheduled for 10/20/Since the previous visit thecustomer had switched from well water to water provided by the cityDuring this transition thewater treatment system had been disconnected at no fault of Rainsoft of DenverAfter astandard filter replacement on the customer’s reverse osmosis system *** *** was informedthere would be a fee to reinstall the whole house conditioning systemThe customer not onlyrefused payment for the finished filter service, but also deferred the technician to her husbandsaid payment and payment for the re-installationThe technician attempted to contact *** on his cell phone the same day with no answerA message was left on the customer’svoicemailAfter no response from the customer it was assumed they did not want to pay the feeto have their system reinstalled[See attached file]While Rainsoft of Denver does not accept returns after business days (right of rescission, per federallaw), the offer still stands to reinstall the whole house conditioner at the going rate at a mutuallyagreed upon time and date

"Front Range Research" is our properly registered trade name for our marketing department, d.b.aas Front Range Water Treatment as well as Rainsoft of Denver, all properly and legally registered with the StateThus logically all three trade names have the same mailing address, as we never intended
to hide anything. The exact wording of the mail piece might not be to the liking of this particular consumer, however, it has been reviewed by our attorneys in detail and as legal as can be. The consumer is under no obligation to respond to this mail piece and therefore never bothered by usNo harm done, all perfectly legal with proper registrations of trade names

First of all Front Range Research is a properly and officially registered d.b.aof RainSoft of Denver's marketing departmentThe text of this mailing has been thoroughly reviewed by our attorneys, so it can not be misconstrued by anyone, if all the text is read by consumer. The assumption of
this particular consumer is that we had received the postage paid part of the question survey cardOur records do not reflect that we ever contacted this consumer by phoneThat might be because we never received the completed card or the phone number was omitted on the card and we had no way to contact consumer. Even if we would have received this card back in the mail, it would not have taken us almost a year to respond by getting in touch with the consumerAttached is a copy of the front and back of the card in question that was sent outAs you can see from some of the highlighted (yellow) parts, it states right below consumers signature that this is "for homeowners only" and no purchase is necessaryIt further states quote "Returning this questionnaire constitutes the authorization for survey sponsors to contact you by telephone" unquoteIt also reads "See back of card for terms and conditions"The back of the card reads "MINOR RULES APPLYHomeowners over who participate in a brief in home study of our whole house environmental systems will receive a $gift card". Therefore, no one gets $to mark answers to questionsThe $are for homeowners (if married, both have to be present - no in-home water treatment system of any kind installed yet) that allow us hour of their time in their home to demonstrate our product and in exchange for their comments and opinions earn the $gift cardThat's a fair hourly rate and not everybody either qualifies or takes us up on the offerIf this consumer is willing to set up a time for an in-home presentation and meets all the minor rules that are posted at our office and would have been disclosed to the consumer, if we would have been able to contact him/them by phone to explain the program, we have no problem delivering the $gift card, provided the terms explained herein are met in full

Consumer signed a contract on 4/14/2016, including Financial terms and was given the obligatory 3-day right of rescission (from date of transaction, not counting weekend and/or holidays), which was 4/20/2016. The installation was set for 4/20/2016 and everything was installed as ordered. Consumer...

was under the impression that cancellation date was 3 business days after date of installation. Felt misled that sales rep allegedly did not disclose that there were any finance charges at all and thought that finance contract had no interest charge at all.  As consumer cancelled on 4/21/2016, one day after the rescission date, we were under no obligation to rescind the transaction, as we incurred installation costs and other expenses including, but not limited to having a system returned that was registered with the manufacturer the minute the system was installed and right of rescission over, thus we would not have been able to re-sell that water purification system with an original manufacturer's lifetime warranty for the first purchaser at retail, but only a dealer warranty, which devaluated the entire system for re-sale. I commend the consumer for keeping an open communication and we talked several times to come to a mutually agreeable solution. The consumer was given at time of sale all the paperwork and she reviewed her copies, where it read right above the consumer's signatures quote "The sales representative has shown me in print, and I have read, understand and agree to, and have received a copy of the financial terms. These terms I have read and understand include written agreements regarding payment starting date, interest rate and the date interest begins to accrue. I have received a copy of the three day rescission notice. To protect both parties, I understand there are no other agreements, written or oral" unquote. The consumer was bothered by having to pay 13.99% APR interest charges. In order to resolve this matter in a professional manner, I paid for a finance company promo in order to reduce the original 13.99% APR to a 9.9% APR (lowest possible term on a revolving charge account) instead. The consumer will keep the water treatment system and I personally will always be there for them in the future in case of any concerns or questions later on. We appreciate the consumers willingness to keep communication open and we are extremely pleased that we resolved this matter in an amicable way and in the process of it gained a valued new customer. We pride ourselves that we have an A+ Accredited rating with the Revdex.com with over 32,000 customers. As this example shows, any company can be great when everything goes great. However, when there is a problem, it truly shows the character of that company in the way they resolve an issue with a positive end result and ultimately everyone is a winner. The consumer with a quality product that will bring joy and peace of mind for a lifetime and us, the company with a valued customer that we cherish.

Front Range Research is a properly registered name with the State of Colorado for our marketing division. Rather than going back and forth on this subject over a $20 gift card we will send the consumer the $20 gift card in the mail in the next couple of days in order to settle this matter.

The assumption of this consumer is that by answering/circling 7 questions he would be eligible to receive a $20 amazon gift card. however, if one reads the entire mailer it states on the bottom of the orange part (see enclosure) the following: "Colorado homeowners over 21 who PARTICIPATE in a brief...

study of our whole house environmental systems will receive a $20 gift card". The entire text of this mailer has been thoroughly reviewed by our attorneys, so it cannot be misconstrued by anyone, if ALL the text is read by consumer. As consumer stated, he declined to participate in the study and therefore disqualified himself from receiving the $20 gift card. One can imagine that no one gets a $20 gift card from any establishment/business for just marking 7 questions. The $20 are for homeowners (if married, both have to be present and no in-home water treatment system of any kind installed yet) that allow us 1 hour of their time in their home to demonstrate our product and in exchange for their comments and opinions earn the $20 gift card. That's a more than fair hourly rate and not everybody take us up on this offer or qualifies for the offer. If the consumer is willing to set up a time for an in-home presentation and meets all the minor rules that are posted at our office and have been disclosed to the consumer when we called (and he declined), then we have no problem delivering the $20 gift card, provided the terms explained herein are met in full. There is no attempt to sell anything, unless the consumer asks us after the 1 hour to tell them more about our products. The consumer may call us at [redacted] and speak with [redacted] regarding a good day/time to participate in the water test and delivery of the $20 gift card.
