The customer initially stated that this was a gift for a man in a hospital The size of the watch would make it a watch appropriate for a lady, in my opinionI wonder if the customer was experiencing buyers remorseHe states that it is "obviously a fake" yet he had the watch for several weeks before he contacted us again. That said, we really try to have satisfied customers and consignorsWe are willing to offer a settlement of $75We represent items to the best of our ability but in this type of sale, an auction, everything is sold AS IS and without any guarantees or warranty, and we can not issue a refundThis is the nature of this type of saleA purchase from a retail jewelry store would likely come with a guarantee that would be refund eligibleThe downside is that the consumer would expect to pay $2,to $9,for a similar itemAs an auction house we are merely facilitating the sale between the owner and the buyerThe attachments with this response are the terms and conditions that were agreed to upon registration for the auction The auction where this item was sold had over 3,different lots, all from unclaimed bank safe deposit boxesThe bank is paid for all items within a week of the auction We cannot possibly know the history or authenticity of these itemsWe recommend that people personally inspect the items before bidding on them Again, we apologize for your [I have reviewed the response made by the business in reference to complaint ID 1***, and find that this resolution is satisfactory to me This is not buyers remorse as it took a few weeks for my watch man to confirm the watch is not realThank you for your settlement and I will await your check

Attached are the some of the photos showing damage to doll not described on the auction nor discussed in the phone conversation with the owner/manager of the auction house.I will also forward our emails to each other in another email to youI will need to send a few emails with photI include them all, they are returned with a 'maximum message size exceeded' message. Thank you so much for your assistance

I am sorry that the customer was unhappy with the doll they purchasedI have attached the terms and conditions of our saleBy bidding on the doll, they agreed to these terms. I have reviewed the description that was with the doll on the bidding platformI have posted our description
below.14" SCHOENAU HOFFMEISTER CHARACTER BABY ~ BISQUE SOCKET HEAD, MARKED AS SHOWN GLASS SLEEP EYES WITH LASHES, SOME MISSINGOPEN MOUTH WITH UPPER TEETH AND ANTIQUE HUMAN HAIR WIG FIVE PIECE COMPO BABY BODY SHOWING WEAR AND REPAINTHAIRLINE FROM FORHEAD TO EYE (NOT VISIBLE TO NAKED EYE).It is an antique doll, and with a doll that is roughly years old, one would expect wear and cracking on the bodyThat said, we DID describe the body as "showing wear and repaint." The wig would have been off of the doll because we always remove them to do a full inspection to find any damageThe "fine black dust" that she refers to is likely a residue from the dolls wigThis is very typically found on antique dollsThe dust would wipe right off of the bisque. At this time, I would be willing to have her send the doll back, and once it is received,( in the same condition that the customer got it) I would refund the purchase price and buyer's premium

I have reviewed the response made by the business in reference to complaint ID***, and find that this resolution is satisfactory to meI will continue to keep the complaint I registered with the Ohio Attorney General's office until I receive my refundThe doll will be shipped to Apple Tree by Friday, Feb13,

I am rejecting this response because:I was told by a member of the auction house right after the sale, because I was concerned on the authenticity, that each watch was examined by their inhouse specialist and that their was no reason to expect it to be a fake. If you saw and touched the watch you knew immediately it was a fake and did not have the Cartier markings on the watch was not shown in the pictures.  What the auction house is saying is buyer beware because we do not examine the item for even a reasonability test, when the item is an obvious fake.

We are sorry to hear of your dissatisfaction. I can assure you there was NO intentional misrepresentation on our part. We are a full service auction company and have been in business for over 30 years. We sell about 100,000 lots in the course of a year and have thousands of satisfied customers.We...

This is the nature of this type of sale. A purchase from a retail jewelry store would likely come with a guarantee that would be refund eligible.
