Review: I entered into an agreement Rancho Santa Fe Motors to purchase a 1971 Mercedes-Benz 300 SEL for $49,000. The vehicle was advertised as having 51,015 original low miles, original key, tools and service records. I was asked to pay a $10,000 holding deposit as the dealer would need to hold the vehicle for an extended period of time until it could be certified, paid for and shipped. I made this payment on 28 May 2014. I planned to travel to the USA to inspect the vehicle before completing the transaction. I travelled to the USA during the month of June. I had repeatedly asked for copies of the service records and evidence verifying the mileage on the vehicle. This did not occur and when I travelled to the dealership, I discovered that the vehicle had more than 100000 miles, and the inclusions that were supposedly available were not. I also discovered that the vehicle was not owned by the dealer, which I was led to believe, rather it was a consigned vehicle. I have made an offer to settle for a reduced amount which has been ignored.Desired Settlement: I would like my deposit back.

Response:

Good Morning,

Sorry for the delay in response! Yes our Customer [redacted] acquired about a rare 1971 Mercedes 300SEL we had listed for sale on ebay.com that he saw out-of-the-country in Australia.

We discussed the car in detail and Mr. [redacted] wanted us to hold the vehicle for approximately two weeks until his arrival in the United States on business. We agreed on a $10,000 non refundable deposit (Signed and Documented on the Bill of Sale) and pending inspection from a independent Mercedes mechanic.

In addition the Mercedes passed the mechanical and visual inspection and on 6/16/2014 Mr. [redacted] flew into the United States and gave us a visit to visually see the car for himself and take it for a test drive. After the test-drive Mr. [redacted] spent additional time with the car going over it with a fine tooth comb. It wasn't till 3-4 weeks later while we were waiting for authorization to import the vehicle into Australia that Mr. [redacted] decided he didn't want to move forward anymore with the sale.

In conclusion we instructed Mr. [redacted] that he signed a Bill of Sale on 6/16/2014 that stated NOTICE: THE DOWN PAYMENT OF $10,000 IS NON REFUNDABLE and that we had the car not listed for sale from the dates 5/28/2014 through 6/16/2014.

I do not know what changed his mind about the car especially after having it inspected and visually seeing the vehicle for himself and even signing a Bill of Sale that was highlighted non refundable deposit but Rancho Santa Fe motors should not be held accountable.

Review: Sorry, I do not have a good English.10/12/2015. I purchased 2009 Land Rover Range Rover Sport from Rancho Santa Fe Autos. At that time, Seller does not tell me this car had a accident history. Even when I asked about accident he answered to me "no accident". Seller never show me any history about this car. after purchased, I saw the CarFax report at sellers website.10/18/2015. I asked to seller that I want to return this car. because seller did not give me a right information about this car. and so many problems. but seller did not accept. This car had so many problems. handle shaking when I brake. cd player does not work, driver's seat does not move. I did a easy work first. I replaced broken spare tire winch and had a all wheel tire balancing because handle shaking when running. and repair rear left door rubber sealing because rubber did not attached at the door, lift door hinges because lot of noise. and many things. so, I asked seller if it is no possible to return, please repair brake, cd player. but seller did not answer.I think at least seller have to repair brake, cd player and driver's seat. it is most important thing to drive. What is the right way?Desired Settlement: I will happy if it is possible to refund. If not, I want to seller repair brakes, cd player, Driver's seat.
