In [redacted] Report she stated that we had them pay us a builders deposit of $25,plus there earnest money of $and then asked for another draw of $25,000.This was not our choice we always get earnest money from all clients this money is used through out the construction process if the clients go's over there budget or to add any upgrades ...This money is to be refunded back to the clients at the end of the construction closingAs stated in the contract that they signed this deposit is non refundable if builder is fired from the job for any reason..As for the builders deposit we only ask for 10% it was [redacted] who wanted to do his draws in $25,payments he wanted no paper trails only cash no checks or cashier checks..After the Demo of the existing house inside the already existing Metal building we started framing the outer interior walls with 2xstuds as stated in our contract[redacted] called yelling and screaming that we were not framing with 2xstuds and that this was on his plans NO it is not!We only frame with 2xstuds on the exterior framing on New Construction and 2xinterior studs ...We tried to explain this to [redacted] and he wanted to hear nothing we had to say as to why we build that way and how using 2xstuds in the interior part of this already existing building would be a waste of square footage and make for very unattractive window seal..Although we knew it would not look right [redacted] told [redacted] we would do it his way...After agreeing that would be fine a called back said he would rather just have all his money back and find a new contractor..We did nothing that was not on our contract with [redacted] and [redacted] *** ?

This is the most evil crook imaginable
Ripped me off and lied straight to my face.
Was told I would be given shares in a barn company. I have documentation to support but this thief is nowhere to be found. Reason to believe he is now in Monterey, MX suburb of San Pedro Garcia.

I am rejecting this response because:
I have provided proof in pictures and floor plans that this home was not being built to suit what the plans called forI even called the designer, who *** *** set me up with to confirm that the floor plan she designed called for 2xstuds on the exterior shell of the inside. The designer came to the location of the home to look through the existing structure during the planning processShe was told as well as *** was told about how soundproof we wanted those wallsIn the plans she drew them out with 2xstuds as per her own words today when I talked with her on the phonePull the attachment and zoom into those interior shell wallsShe stated that even the main plumbing walls should have 2xstuds as they did in the design she sent final copies ofIn the sheet that *** and *** attached with a bid, as you can tell, there are not any 2xstuds listedWe are brand new to building a home and we did not catch this, as we went over this sheetHowever, we did pay much attention to that sheet because to be honest it was a very poor in detailed, as far as pricing and exact amount of materials goesNor did the builder who was on site, have anything to do with the sheet *** and *** providedThe builder was going by the blueprints only, and he also sided with us on the fact that it called for 2xstudsHe was fired about the same time we fired ***, a few days before, I believeI had went over there on Friday evening and he told me that *** had fired him, but he did that little bit of framing that *** expected him to do, just to let *** see how quick he could frame once he had materialsHe had a small pile of 2xonly lumber that *** had trucked down, all put up in one dayThat was the one and only day they framed on the houseWhen *** came home later that evening and saw that it was framed w 2xhe called *** first, the builder*** agreed that our plans called for 2xbut said that *** told him to use the 2xSo he did as he was toldThat's when things went south*** then had the heated discussion with *** tried to say that what's in the plansthe problem is we are talking about two separate plans*** is referring to his NOT SO Detailed BID that he attached, and we, the homeowner, the builder, and the designer are all referring to the actual drawn out and scaled floor plan ( final copy that was on site in the builders handsThat's the actual plan the builder was using to remodel and build our new home, not that detailed list, that's not very detailed at all on cost and amount of material planned to use
So, after sitting on that heated discussion a day or two and pulling out written contract to see what rights we had, we found other flaws in the contract that raised even more red flagsUnder the Builder Signature line he has his name and Business Name: Rau Builders, LLC, Then he has a Certificate of Registration Number ***We decided to pull this number in the TX Dept Of Licand Reg website and come to find out it is not even registered to a Rau or Rau Builders, it cam out to be registered to a *** ***, a tow operator in Austin, TXSo, of course at this point we have read over the contract and know we will not be getting our $earnest money bc we are planning to fire himSo we call him Monday and let him know that we are DONE! We tell him just give us $40,and we will go on down the roadHe states that he has to go home and figure the numbers and he will get back to usFor a week we hear nothing from himThat when *** left a voicemail that he would be coming to his house to get his moneyNo physical threats at allThey are blowing that part out of proportion and they have no proof even on voicemail of physical, bodily harm threats at allJust if you don't give me some sort of response I will come to you face to face to get my moneyWe really thought there was no way that they would just keep $55,for just the demolitionBut as you can see, in the final email, that was their intentionI was as nice as I could be the entire time, I even did the conversating in the end with text through ***We fired them because we could not trust that they were going to do as the plans stated and *** was not home to make sure they were doing it correctlyWe have never once not said we should receive our earnest money, bc yes we did break that part of the contract, but we do deserve the part they are claiming to have paid out, but cant prove that with receipts, and the builders profit, because as u can tell in the pics they did not even get 20% into the jobIn the period from June 29, contract day, to August 25, firing day, I logged what days workers were present on my propertyThey were only there for days from of June to July10tyhDemo was pretty much completed at this point, just needed lots of interior sweeping and floor nail pulling clean upThey left the job from July 11th-25thCame to site on 26th and did a small bit of cleanup to haul to dump26th-13th of August they were present but still no material on the job so they were just doing small cleanup that was left over here and thereMaterials were never brought to the job site until August 13, late in the evening, and you would laugh at the small pile that was brought to frame a sq ft home*** had material trucked down on a small trailer because he claimed that he got it so much cheaper than our local Mcoys, or Home Depot would give it to himYou have to think this is a 2.5-hour drive, it really cant possibly be that much cheaper once you buy the fuelSeriously! Mcoys would have brought the lumber in one load, all at one timeI have pics of that lumber pile to, but not enough space to attach themThen the materials sat there for several days because *** and the builder *** were having issues and drama between the two of them over him not paying ***, and *** calling us about it
After all this went down and I got the final email, which stated NO MONEY BACK,I went searching the internet for review sitesThat's when I wrote to you guys, Revdex.com, and I also wrote on several other review sites, one being Rip-Off Report.com, Since then I have had others contact me to let me know that they were scammed by Rau Builders LLC as wellOne in *** named ***, and another one named ***, whom *** was currently still building for, going on two years on a month project, but would not respond or answer any callsIm sure there are several more who have just not spoke up yet, but I feel if keep moving forward, along with my attorney and local PD detectives help, I can bring both *** and *** down, because she is just as involved as himThey both work the business together. Best part of all, I had one of *** and ***'s very own family members find my report through Rip-off report and contacted me through face book just to tell me to keep pursuing my case bc these two have even scammed their own family over several times. There is a law in my favor and I am hoping to prosecute them under the Deceptive Business Trade Act and make them own up to what they have done to me and my familyI have even more attachments for more proof but it would not let me attach any more so if you would like more info or more proof just let me knowPictures and documentation are worth more than anything that can be said because they state the facts, I will never get my money back, because they do not own a single thing in their name for this very reasonSo , since they don't own anything and I have made their name known through Rip-Off, it has made it easy for them to drop their rent house and up and move their family to HoustonThey recently changed their website to "Now serving the HOUSTON area" Houston people you better read your reviews before you give these two any money, because they are out there nowUnfortunately, when I hired them, no one had ever come forward and wrote about their scamsHopefully the next person to hire them will do their researchI mean, what GENERAL CONTRACTOR, who claims to have built 100s of custom homes , doesn't already own their home at years old, *** ***, that's who! THERES YOUR SIGN!
