Dear *** *** and/or Representative Revdex.com:This letter is in response to complaint ID *** Everything that we do here at *** *** *** is per our lease agreement that was signed by both parties.We prefer that the residents are present for the move-out inspection so there are no
misunderstandingsPer the lease agreement the resident would simply need to notify us in writing that they wish to be present for the final inspection and it would be scheduledThis resident did not notify us that they wanted to be there for the inspectionBy not being present for the inspection the resident agrees to our assessments of charges for damages and cleaningPlease refer to section of the lease agreement below."MOVE-OUT INSPECTIONYou should meet with our representative for a move-out inspectionOur representative has no authority to bind or limit us regarding deductions for repairs, damages, or chargesAny statements or estimates by us or our representative are subject to our correction, modification, or disapproval before final refunding or accountingIf you wish to be present when we make the inspection, you must so advise us in writing, and then we will provide you with written notice of the time and date of our inspection of the apartmentYou will have the right to be present at our inspection of the apartment for the purpose of determining the amount of security deposit to be returnedWe will provide you with notice of the time and date of the inspection at least ten (10) days before the date of the inspectionThe inspection will be made within three (3) days (excluding Saturdays, Sundays and holidays) before or after termination of occupancy and removal of all your personal effectsIf you attend the inspection, we will upon completion of the inspection give you an itemized list of damages to the apartment known to exist at the time of the inspectionWe suggest that you do accompany us during the inspection to help resolve any problems that may ariseFailure to do so will Constitute a concurrence by you in our assessment of charges for damages or cleaningAfter inspection by us, appropriate charges will be assessed by us for any missing items, damages or repairs to the apartment, or its contents (except for ordinary wear and tear)."The resident turned over the keys and apartment to *** *** ***We cannot after the final inspection turn the apartment back over to them to fix the damagesThe damages are to be fixed before the apartment is returned to us or we have to charge for the damagesIt states in the lease agreement that the apartment must be returned in the same condition it was on day one of occupancyUnfortunately, when we got the apartment back the walls were dirty throughout and required additional coats of paint, above and beyond the one coat we take care of free of charge accounting for wear and tearAdditional paint charges were $There was also a brown stain on the carpet that required professional removalThe cost to remove the stain was $Please refer to Section and of the lease agreement outlined below regarding the Security deposit"SECURITY DEPOSIT DEDUCTIONS AND OTHER CHARGESYou'll be liable for the following charges to the extent permitted by applicable law, including but not limited to: unpaid rent; unpaid utilities; unreimbursed service charges; all repairs or damages, including stickers, scratches, tears, burns, stains, or unapproved holes; replacement cost of our property that was in or attached to the apartment and is missing; replacing dead or missing smoke-detector batteries; utilities for repairs or cleaning;..."“DEPOSIT RETURN, SURRENDER, AND ABANDONMENTProvided that you have satisfied each of the following conditions, we shall return your security deposit to you as provided in the lease:(a) You must completely vacate the entire Premises at the expiration or other termination of thislease or when any subsequent month to month tenancy is terminated.(b) You must pay all Rent required under the lease, up to and including the date of expiration ortermination of the lease or month to month tenancy.(c) You must thoroughly clean your apartment including all kitchen appliances (refrigerator, oven, range, dishwasher, baths, closets, storage areas, patios/balconies, etc.) so that your apartment and such appliances are in the same condition as they were in on the beginning date of the initial term of the lease, except ordinary wear and tear.(d) There must be no defects or damages to the apartment, caused by you, your family, guests,invitees, agents, pets, or otherwise."Each of the conditions were not met and there were deductions to the security depositThe resident is responsible for all repairs or damages they causedI feel that we were as fair as we could possibly beAs noted on the residents move-out inspection there was a very strong smell/odor in the unitWe had to do additional treatments and deodorizing in the unitWe did not charge the resident for this or lost rental due to holding the unit for additional daysWe also did not charge utilities for repairs or cleaningI'm sorry the resident does not agree, but they should have been there for the inspectionWe have a legally binding lease agreement to help avoid misunderstandingsIt is outlined in detail what is expected of both partiesAs per his request, we cannot refund any additional money to him.Respectfully, -*** ***Assistant Property Manager

I am rejecting this response because:  They never prompted us to remain present at the time of Inspection.  Everybody knows the lease agreement is so lengthy that nobody is going to read that and note down the points mentioned in it.  I would have really appreciated if while turning on keys, one of the apartment associate would have suggested us to remain present at the time of inspection.  The way they mentioned that walls had so bad stains is totally not accepted by me.  As I mentioned earlier, I had 1 adult kid and another enough grown up kind to understand that we have to return this apartment after the end of lease and should not make it dirty.  From the day one we were taking much care of the apartment and were using it with utmost care and responsibility.  I totally disagree with the apartment claim and would still ask for refund of $ 100.00.
