Review: We signed a contract for a new home with [redacted] on May 25, 2013. In that contract we agreed to finish the optional 3rd floor with a "separate HVAC" as stated on page 8 of the contract. Just before completion of the home in August 2013 we discovered that the 2nd and 3rd floor were tied into the same system and so only included 2 HVAC units. Upon confronting [redacted] we were told that the contract was a mistake and it should have only been 2 systems. We were told that they would make sure it worked for us and maintained a consistent temperature on both levels. Due to the timing and the fact that we had to be out of our old house we moved forward with closing.
Starting in the spring of 2014 we noticed that it was significantly warmer on the 3rd floor compared to the second. I purchased two identical digital thermometers and found that the 3rd floor would get up to 10 degrees higher - reaching 85 degrees on numerous occasions. [redacted] sent out the HVAC contractor who installed the system and they checked it and told us it was working properly and there was nothing they could do. Since that time we have asked and complained about the temperature on the 3rd floor repeatedly and have reached a point where they will not return my calls or emails on the subject. The finished 3rd floor space has become unusable for most of the year.
It should be noted that the contract was signed and initialed several times by [redacted], my wife and myself, and his real estate agent.Desired Settlement: We would like the money to have a system installed on our own. I received a quote from an acceptable contractor for $4500.
