Review: I emailed Veritext concerning a deposition that I was conducting where I needed a court reporter.

Veritext agreed and responded by making an appointment for the court reporter, etc.

I was told that the transcript of the deposition would be provided to me in 5 days after the deposition.

However, after the deposition I am now being told that they will not provide me with the transcript of the deposition until I prepay them.

That was not what I was told prior to them doing the deposition.

Had I been told that I never would have hired them and would have went with a different court reporting agency.

However, now that they are in possession of the needed transcript - they are now telling me that I need to prepay for it.

That is not what I was told beforehand.Desired Settlement: Provide me with the transcript as was promised in 5 days after the deposition.

Bill me like agreed.

They are holding a needed transcript of the deposition.

Response:

We are attempting to make concessions for Mr. Andersen in order to get him his transcript, but to no avail. He has not provided us his current mailing address info, nor accepted any of our attempts to offer him a discount. We are doing our best to resolve this matter. Thank you.[redacted]VERITEXT REPORTING[redacted]

-----Original Message-----From: [redacted]Sent: Thursday, April 07, 2016 4:47 PMTo: [redacted]; [redacted]Subject: RE: Deposition on March 30, 2016Mr. [redacted],We agree that we would like to resolve this matter amicably. We are willing to accept a credit card payment for 1/3 of the total costs now, as a deposit for the work to be done. Once the transcript is released to you, we would charge your card another 1/3 after 30 days, and the remaining 1/3 after 60 days. While I understand that this may not have been what was explained to you the time of scheduling, we simply cannot stray from our new client/pre-payment policy. I hope you can understand that this was an unfortunate matter of miscommunication, and can agree to this new solution.I have attached a new credit card form, which now reflects 1/3 if the total costs which I quoted you yesterday (including the 10% discount we offered). We will charge this amount now, and the remaining balance at a future date. In addition, please be aware that we cannot do any of this until we have a physical address for you on file as well. We are not able to enter you into our system (and therefore not able to get you a transcript) without that information. Please provide that when returning the attached credit card form.Thank you again,[redacted]Midwest Billing ManagerVeritext Reporting312.508.6072-----Original Message-----From: [redacted]Sent: Thursday, April 07, 2016 1:42 PMTo: [redacted]Subject: RE: Deposition on March 30, 2016Ms. [redacted]With all due respect, there is absolutely no way in which it could have been "assumed" that I was "calling" on behalf of [redacted] - none.I was asked for my name, [redacted], and the name of the case - [redacted] et al.I also informed you that [redacted] represented [redacted] - the person being deposed - and that is why it was being done at [redacted].Lawyers representing the deponent do not pay for the deposition - it is the person doing the deposition that pays for the deposition. So, again, there is absolutely no way in which anyone could have assumed anything other than I was seeking a court reporter for a deposition I was doing - none.As stated previously, I would very much like to settle this matter amicably. If not, I have filed a complaint with the Revdex.com - and am being told that you are in violation of the State of Wisconsin Deceptive Trade Practices Act and other consumer protection statutes.Once again, I am willing to settle is matter amicably - by agreeing to what was originally agreed - obtaining the transcript, being billed, and paying. Thanks as always,[redacted]--------------------------------------------On Wed, 4/6/16, [redacted] wrote: Subject: RE: Deposition on March 30, 2016 To: "[redacted]> Date: Wednesday, April 6, 2016, 12:11 PMMr.[redacted] asked that I reach out to further explain our billing process. It is, and has always been, our standard practice to require pre-payment from all parties who have not previously worked with Veritext. We apologize that this was not explained in detail at the time of scheduling, but it was assumed that you were calling on behalf of our existing client, [redacted]. When it was discovered after-the-fact that you were not associated with that firm, we realized that we would need to obtain pre-payment from you directly, as we do not have a history of working with you prior to this deposition. That being said, we simply cannot release the transcript to you until it has been paid for in full. As a courtesy, we would be happy to reduce the transcript amount by 10%. This would bring the total pre-payment required to $782.10. Please find a revised credit card authorization form attached. You may either complete & return to me, or send a check to my attention at the address below. Thank you again, [redacted]

Once you are in our system and have paid for this transcript, you will be a client and prepayment will no longer be an issue. Please send your address and phone number, and you can choose between filling out the cc form for us or COD. The transcript cannot and will not be sent without that. Thanks. I was told that I would have the transcript 5 days after the deposition - nothing regarding pre- payment was ever stated. As stated, if I had been informed that it would have to be pre-paid, I would not have fired Veritext and would have went with someone else. I need the transcript, time is of the essence - it can be paid for just like every other one - after it is received and billed. Thanks as always,[redacted]

If you had shared what assumptions or impressions you had with me, I would have been able to address them at the time of scheduling. I apologize for any inconvenience or confusion. I would have to check, but I believe we also can send the transcript COD, if that works better for you.[redacted] RayVeritext - Milwaukee414-651-3557 cell414-395-2641 directFrom: [redacted]Sent: Tuesday, April 5, 2016 11:45:43 AMTo: [redacted] RaySubject: RE: Deposition on March 30, 2016Hello [redacted]:I was under the impression that this was already being done and that I would have it within 5 days after the deposition of March 30, 2016.I was told that I would have the transcript in 5 days I was never told that I would be made to pre-pay for it.That is not how transcriptions work. Again, I expected this to be done. If I had known you would be requiring prepayment beforeyou provided the transcript, instead of payment after like every other, I never would have hired Veritext.Know, with all due respect, I expect the transcript and payment will be forthcoming after its receipt - as normal, and as I was planning on.I look forward to receipt of the transcript as soon as possible. Thanks as always,[redacted]--------------------------------------------On Tue, 4/5/16, [redacted] Ray [redacted]wrote:Subject: RE: Deposition on March 30, 2016To: [redacted]Date: Tuesday, April 5, 2016, 9:09 AMGood Morning, Dean! Your court reporter for the deposition of [redacted] would like to transcribe this deposition for you, if you'd like to order it. We do not have you in our system as a client, so we will need you to fill out this cc form before we can process your order. It's unfortunate we have to do this, but it is to protect the reporter and to assure that she will be paid. Please fill out the attached form and return it as soon as possible. Thanks so much for your understanding. We look forward to working with you in the future!
