RevDex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. [To assist us in bringing this matter to a close, we would like to know your view on the matter.] What [redacted] has said in his most recent response makes absolutely no sense to me. He is merely trying to evade giving me my $650 refund. [redacted] should just make the refund payment and the matter will be resolved. Does he really need an attorney to do that? Why not use the money being paid to his attorney to make the refund payment to me. I would like his attorney (if he really has one) to contact me and give me the reason why he is advising [redacted] to withhold my refund. I think that this is just another ploy by [redacted] to avoid making the refund payment to me. Sincerely, [redacted] ** [redacted]

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]
Dear Revdex.com:
[redacted] performed inadequate services on four occasions, which are explained in detail below:
1. Plowed the garage drive, but did not plow the circular drive, in early December.
2. Returned the next night at 10:30 pm to finish the job and plow the circular drive. Damaged the lawn with his snow plow. He agreed to no longer use the plow in the future, but would use a snow blower instead.
3. Used a snow blower, as promised, on the garage drive and the circular drive on 12/15/13. Did a good job on this one occasion.
4. Arrived at 3 am on 12/17/13 and used a snow plow again on the garage drive and the circular drive, instead of the snow blower, as had been promised. Damaged the lawn again.
The next snow event was on 12/22/13. [redacted] did not  show up, but phoned on 12/24/13, which was two days after the snowfall had stopped. By then, our neighbor had already removed the snow for us as a favor, since we needed the driveway cleared for the Christmas holiday. I told Steve that I was extremely dissatisfied with his breach of contract and would like a refund of my $650 advance. He admitted that he could not perform his services in a timely manner because he had taken on too many clients and he graciously agreed to refund my $650.
On December 27, 2013, [redacted] called and again said that he had over-extended himself with his business commitments and that he could not adequately perform the contracted  snow removal services for the 2013-2014 winter season, for which he had already been given a $650 advance payment by me. At that point, I thanked him for his frankness and we mutually agreed to a cessation of the contract and full refund of my money. He again apologized for his poor performance and said that there was no excuse for his terrible service. He again promised to refund the $650 advance payment within 30 days, which he said was his legal right. He has not performed any additional services since 12/16/13.
No meeting was ever attempted to be scheduled between [redacted] and myself or my wife. All of our conversations were by telephone. At this point, what would have been the purpose of a meeting? He had said that he could not perform the duties of the contract; and he said that he would refund my money. What else was there to discuss? I had asked Steve to send a bank cashier's check for the $650 refund to me as soon as possible.
I told him that I would file complaints with the Milwaukee County District Attorney, the Wisconsin Department of Agriculture, Trade and Consumer Protection and the Wisconsin Revdex.com if he did not send my refund within the promised 30 day period.
After waiting the 30 days, I called Steve on 2/4/14 and left a message requesting my $650 refund. I did not receive either a response or the promised refund payment. of $650. I therefore filed the aforementioned complaints as promised. Why is Steve still stalling on the repayment? We have already agreed on the refund. I am not a part of, nor do I have any interest in, his other legal entanglements.

Regards,
[redacted]

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]
What [redacted] has said in his most recent response makes absolutely no sense to me.
Sincerely,
[redacted]

I have forwarded the response over to my attorney.  The [redacted]’ involvement in any legal proceedings is not in my hands, nor is it elective.  I am not attempting to withhold a refund from them, I am however doing everything under the advisement of legal council on any/all issues that reference or were influenced by actions being taken against me and my business.  I stated in my previous response they will receive a refund, which they will, when I am told to go ahead and do so.

Mr [redacted] and I have been in contact.  The [redacted]' received multiple snow removals at the beginning of the season and were not happy with the timing of the removals.  Mrs. [redacted] contacted me cancelling service, with a follow-up contact from Mr. [redacted] confirming.  Both contacts drew...

heavy reference to internet research and current situations surrounding another complaint currently open with the Revdex.com.  I attempted to meet with the [redacted]' and meeting was refused.  I wanted to explain the situation to them, which they did not care to hear.  I gave them a brief explanation over the phone and Mr. [redacted] advised me he would be going to the District Attorney.  At this time, I ended the conversation and referred the matter to my attorney who is working on the other situations mentioned.

Mr. and Mrs. [redacted] will in fact receive a fair and equitable refund as soon as I am advised by my attorney to process it.  As their situation is now a part of the investigation, I do not have an exact time frame on that refund.

My complete and total intention was to work with them and end this situation amicably,  however that became impossible once the intention of bringing the matter to the District Attorney, combined with their reference to strong influence to the current situation of open complaints which I have said from the beginning are frivolous, fraudulent, and criminal.

Again, they will receive a refund at such time I am able to give it.  I am not going to compromise my position relates to full investigation of this entire situation as the current situation has and continues to hurt me on both a professional and personal level.  I will bring this complaint to the attention of my attorneys and ask again their position on a refund.  It is the best I can do right now.
