The bow in the pool is not a structural issue and was reported to Viking on August 14th. A Viking representative called and spoke to Donnie after the technician visited and stated that the technician was not correct in his assessment of what occurred and how it happenened

it wont accept my attachment.Can I email it to a direct email?

IBI inspected the pool today ( 9-2-2016) and everything passed ... as expected we needed to point out that the lights are 12 volt LED lights and re-attach the cover on the outlet that had hinges for the cover but no cover was on at the time of the previous inspection.  We will set a meeting to review the concrete and what steps need to be taken to move closet to satisfaction

We contracted for Epoxy paint ($200 per gallon plus prep and paint) and partial tile... We updated the contract to have ALL tile replaced... That was our contract...$3300 was the price quoted for painting with epoxy.... We were NEVER told or approved painting with acrylic paint ($49 per gallon with only TSP prep) which would have been 25% of the price quoted AND PAID... Immediately upon filling the painted pool the new paint started to come off (8-6-2016)... we requested a touch up (drained the pool a second time) which was completed (8/20/2016) We used the pool for one month and then closed it for the winter.  Upon opening the pool this year, we again emptied the pool so paint could be touched up again (5/17/2017) which was agreed upon by Aquamarine.  While emptying the pool the paint started coming off everywhere.  We requested Aquamarine to come out and see for themselves and were told by them if we wanted to see everyone involved email pictures of pool and come to them !  We refused !  The two owners finally came to see the pool and they told us "the paint had failed" !  They offered us to paint in acrylic which was first time we even knew they had painted with acrylic or redo with rubber based paint.  It was our choice.... After saying we would want rubber based paint, Aquamarine said WE would have to do ALL the prep work if we wanted the paint changed even though we had contracted for epoxy and their son told us the day he painted that we had rubber based paint and he would use that !! HE NEVER ONCE TOLD US THAT THEY WERE USING ACRYLIC !! At this point, the company has lied from the beginning about the work we contracted AND paid.... They also will not redo the pool with rubber based paint which is what our pool was painted the last time. Acrylic paint is ONLY recommended for commercial use when a pool will be painted annually.  From our perspective, the ONLY resolution is to get a full refund of $3300 for the painting of the pool

[redacted],  I'm not sure why you go back to the bow in the pool issue ... #1 it was not there prior to concrete so I am assuming the concrete folks compacted next to the pool and pushed the walls in ... #2 If you saw that the pool had a bow in it and you feel it was our fault then why in the world would you tell your concrete crew to move forward .... you looked at the pool for 2 weeks and never said a word ... you called and instructed your concrete crew to move forward ... why would you do this if you had been looking at a bow in the pool for 2 weeks.Regarding the electric, we are allowed to do that is several counties but not all. The electric wire running to the pool equipment should and will be set in conduit and we will contact when we can get the electrician out there.  If you are truly concerned about safety then I would suggest you turn the circuit breaker off so there is NO power running to the pool equipment ... Thank you

The final electric inspection was scheduled and the pool electric did pass ... as explained to [redacted] I scheduled the final inspection and did not realize that ibi had put a review fee ( $25.25) on our bill after the inspection delaying the transfer of completion to the building department ... it has been paid and the final has been scheduled.

[redacted]  The caulking around the pool has been completed, it looks terrible but at this point we are over it, [redacted] did request that they caulk however he also stated that if you have not done this before and are not good at it, please don't do it.  We will live with it at this point. The electric inspection has not been signed off on.  I am not sure why it's taking the electrician so long to complete his portion?  I believe from Ole's response below there are just a few things that need to be addressed and it will be complete, it's been a few weeks since they came out so I would assume this will be done soon. Thank you

[redacted],  As you have done each time you have had an issue you add in items that are absolutely not true ... you know full well that we have multiple photos of the pool shell prior to your concrete folks putting concrete around the pool and the sides are perfect ... we have discussed this several...

times and you have agreed that they ran a compactor next to the pool even though we told you to not let this happen.  The issue with electric is a matter of the inspector requesting additional items which is fine and we have it scheduled to get done

Above is a few pictures.One it shows curve in pool.Two it shows concrete being poured and you can see there was no compacting around pool and you can also see the curve in the side of pool while pouring concrete.It also shows the exposed wire they put in after the first under ground electric went bad due to it not being properly installed.There is also a picture of part of the hole/trench dug for the original under ground electric.

As the customer stated in their communication the pool was not an Epoxy Painted pool. The customer originally asked for a quote for Epoxy that can not go over the paint they had, so clearly we could not paint with Epoxy paint. That is why the quote submitted was not executed ( signed by either party). We then went through the process of determining what paint is on the pool. There are several layers of paint, Paint chips were submitted for analysis and the recommendation was to use Acrylic paint. The homeowner pressure washed the pool and patched area's  as agreed upon... the 5 gallon cans were on the deck and left on the deck until we were done with the two coats which was over a three day period. Furthermore half of a 5 gallon bucket was left out for them to have for whatever reason and is still on the property today!!  So, to state that they had no knowledge of the type of paint used either verbally, in writing or by seeing the large labels is less than accurate.  We did visit the property this Spring and stated that we would need to do some painting on the pool. we discussed painting with acrylic paint and they asked about rubber based paint and we said if its possible to paint over the current coat that is fine, but I clearly stated I did not believe that was an option. The customer then came back with not just a request but specific details on how we were to prep the pool and then paint with an intermediate coating and then come back and paint with rubber based paint. We pointed out that last time the customer prepped the pool and we painted and now they are asking for us to prep the pool, use an intermediate paint and then another coat or two as needed. Our response was " that's more cost and work than we originally did"  how about if you prep the pool ( as before) and we will paint ... communication of any civility stopped at that point.  I see no indication on the customers part to find a common ground solution.

They indicated I was told not to compact around pool before concrete which is 100% false along with the concrete people did not compact.They can testify to it.The pool has a bow and your welcome to come and inspect.The electric wont even pass inspection!!!The contract even says they would dig for electric as electric is supposed to be underground and it is not.You can call building inspector to verify that it wont pass inspection.The electric was originally underground but wasnt done proper so they had to redo.When they redone they ran above ground so they wouldnt have to replace all the concrete that I had poured.I welcome the Revdex.com to come and look at this pool.I paid my money as per contract but got a terrible job.A company that cared would take responsability.I spent alot of money and received a very poor job in return.I have pictures of bow and electric that I can send also.

[redacted]  The electrician is to come today as we received a letter form the city stating we would be fined in 15 days if it was not done. Once the inspection is done then an overall inspection has to be done. I am hopeful that this will take place next week.  Thank you for the follow up.

I would re-paint as we originally offered or consider a dollar amount payment .. However the customer decided to put out negative comments about us before we concluded  the conversation on what could /should be done. That is a cost for us and must be considered in any payment or restitution. We would consider $1,000 payment.

[redacted]  Unfortunately the homeowner is not able to call in an inspection on their own as we tried doing that twice, it must come from the contractor, the inspector did come out last week however there are things that are still required by Aquamarine to approve the inspection. For Aquamarine to stat you can't see the damage visually from standing on the pool deck is less than in accurate. It's very visible and noticeable. As of today 6/20 it continues to chip off and we have not heard from the concrete company as to when this repair will be taken care of.

Dear Ms. Prescott,We do not accept Aquamarine Pool Co.'s offer !!  Our counteroffer is as follows:Aquamarine Pool by offering $1000 has acknowledged responsibility for the shoddy paint job on our pool.  Whether or not they signed the contract, we did sign for epoxy pool painting for $3300... Aquamarine Pool cannot produce a signed contract for acrylic paint because we were unaware of this switch and would have never agreed to painting our pool with paint designed for commercial pools that are painted yearly.... All of the correspondence was with their son, [redacted] who had no prior business experience.  His mother confirmed that he was new to this business and could have been confused.  Obviously his business acumen is not our responsibility.  We counter that Aquamarine Pool Co. refund the entire $3300 for painting the pool and then we will remove our comments on any social media .... If they do not, we will sue them for the entire amount, use their $1000 offer as evidence of their responsibility for the lousy paint job, AND keep all of our comments on every media outlet and more to be named !!    Both principals for Aquamarine Co. confirmed, in person, that the paint job had failed !!   Sincerely, [redacted] and [redacted]
