In response too Revdex.com Complaint ID: ***
We have refunded *** *** the Retainer as due process
Although she was contacted prior to this complaint about her ready to sign Tax Return
We did in fact reply to her regarding her completed tax return a week later then promised, because of internal challengesOnce we were notified, (Via Revdex.com) we were more than happy to return the retainer and her documents
We regret any client having a less than perfect experience and regret she felt she needed to request her information via the Revdex.com than to us directly

In response to the complaint received from the Revdex.com, on behalf of *** ***, dated July **, with the ID of ***
____________
Complaint Synopsis:
From what I
understand from the letter, in summary, *** *** is claiming failure to execute mutually agreed upon services in regards to the completion of his personal income tax return and his non-profit filingAdditionally he is claiming a failure in customer service and communication and is asking for half the fee, $262.50, returned back to him
Response provided:
Contrary to *** ***’s claim, I DID NOT invoice nor bill him for the preparation of the non-profit filingThere was no engagement letter and a verbal agreement was made between *** ***, *** ***, his girlfriend, and myselfThe reason I bring her up is to establish that my fee to *** *** did not include an entirely different filing for a separate organization and is in fact in-line and customary with my standard fees for tax preparation
Both parties came in to my office on 3/**/*** ***’s tax return was prepared and filed on 4/**/14, while *** ***’s individual tax return was prepared and filed on 4/**/The were actually rushed as a first time courtesy and because we felt there would be a tax liabilityAt the time of filing is when I charge the client the feesI do NOT collect the fees ahead of time except a small $retainer to hold a meeting during tax season to ward off no-showsThat $was applied to *** ***’s return preparation feeFrom the attached invoices and proof of payment, it is clear that my charges were relatively similar between the two except for the fact that *** ***’s was slightly more involved predicating the additional $over what *** *** paid
However, I did agree during our initial meeting and in subsequent communications that I planned to file the non-profit return after extending because I made it clear it was a lower priority than some of the other clients who needed their individual filings completed as soon as possibleI am also attaching proof of extension and acceptance by the IRS giving the organization an extension to file the return until August **, Please note, unknown and misguided, most taxpayers fail to understand that once an extension is filed, you have until the extended deadline to file and are therefore not late or delinquent on filing unless that extension date has passedSo in the respect, up until the point of *** ***’s complaint, I was not out of compliance nor delinquent
In regards to the poor communication and customer service, I would like to first apologizeEven if just a note, I understand that communication is importantI do try and keep a certain standard here and the process broke down during this filing seasonThe fact of the matter is that I had the best intentions of completing the return in May but fell upon my illnessI have *** *** and over the last months, my illness has caused many missed calls and emails, including the July *** conference callAt the point, *** *** filed a complaint with the Revdex.com in regards to his dissatisfaction with the work to be done on the second filing he wanted me to complete for the non-profit
So in summary and defense, was the original work on the personal returns prepared perfectly, quickly and to the praise of my clients? Yes they wereWas I planning to prepare the other return by the deadline? Yes I wasWas I lax in the communication to *** ***? I am afraid to say my health caused a breakdown .However, the refund for services performed for *** *** were completed and fairly charged and for that product, I believe *** *** does not merit a refund of 50% of the feeThere shouldn’t even be a penalty or fine because the non-profit still had time to be completed, he just decided after the initial wonderful service, that the lack of communication was not for him and he decided to move on and file a complaint
Thank you for your time and understanding in this matter

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.
Sincerely,
[redacted]

Review: [redacted] of Rayner CPA failed to execute mutually agreed-upon services after being fully paid for said services. In [redacted]h 2014, [redacted] agreed to file my personal income taxes as well as my non-profit organization taxes in return for $525. My personal income taxes were eventually filed on or about April **, and I was billed $525, which I paid in full. I agreed to check in on the filing of the non-profit tax card in the coming weeks as [redacted] claimed he needed additional time for this service. On May **, I emailed [redacted] inquiring about the filing status of the tax return, as the IRS deadline was May **, and I had not heard from [redacted] nor received any indication the card had been filed. I received an automated out-of-office email response saying he would be out of the country until May **. The response also noted that he would respond to everyone upon my return and get all returns completed at the end of May and during June. I then emailed another Rayner CPA representative, [redacted], to inquire about the status, but I never received a response from [redacted]. On May **, I emailed both [redacted] and [redacted] once again inquiring about the status, and once again received no response from either individual. Throughout June, I made repeated phone calls and messages to Rayner CPA in regards to this matter, but I was never contacted back. Most concerning, on June **, I emailed and called [redacted]. He did not return my call nor my email, but I was able to schedule a phone appointment with [redacted] for June ** through his assistant. However, on June **, [redacted] did not join the scheduled call, and his assistant told me that while the call was still on his calendar, she was unsure of his whereabouts and unsure of why he was not responding to her repeated attempts to contact him. I emailed [redacted] asking once more when he would be available, but he did not respond. By July 2014, I still had not heard from [redacted], nor any of the representatives at Rayner CPA, so I sought outside counsel and also completed the tax return.Desired Settlement: I am currently seeking a refund of $262.50.

Additionally he is claiming a failure in customer service and communication and is asking for half the fee, $262.50, returned back to him.

Response provided:

Contrary to [redacted]’s claim, I DID NOT invoice nor bill him for the preparation of the non-profit filing. There was no engagement letter and a verbal agreement was made between [redacted], his girlfriend, and myself. The reason I bring her up is to establish that my fee to [redacted] did not include an entirely different filing for a separate organization and is in fact in-line and customary with my standard fees for tax preparation.

Both parties came in to my office on 3/**/14. [redacted]’s tax return was prepared and filed on 4/**/14, while [redacted]’s individual tax return was prepared and filed on 4/**/14. The were actually rushed as a first time courtesy and because we felt there would be a tax liability. At the time of filing is when I charge the client the fees. I do NOT collect the fees ahead of time except a small $50 retainer to hold a meeting during tax season to ward off no-shows. That $50 was applied to [redacted]’s return preparation fee. From the attached invoices and proof of payment, it is clear that my charges were relatively similar between the two except for the fact that [redacted]’s was slightly more involved predicating the additional $75 over what [redacted] paid.

However, I did agree during our initial meeting and in subsequent communications that I planned to file the non-profit return after extending because I made it clear it was a lower priority than some of the other clients who needed their individual filings completed as soon as possible. I am also attaching proof of extension and acceptance by the IRS giving the organization an extension to file the return until August **, 2014. Please note, unknown and misguided, most taxpayers fail to understand that once an extension is filed, you have until the extended deadline to file and are therefore not late or delinquent on filing unless that extension date has passed. So in the respect, up until the point of [redacted]’s complaint, I was not out of compliance nor delinquent.

In regards to the poor communication and customer service, I would like to first apologize. Even if just a note, I understand that communication is important. I do try and keep a certain standard here and the process broke down during this filing season. The fact of the matter is that I had the best intentions of completing the return in May but fell upon my illness. I have [redacted] and over the last 2 months, my illness has caused many missed calls and emails, including the July [redacted] conference call. At the point, [redacted] filed a complaint with the Revdex.com in regards to his dissatisfaction with the work to be done on the second filing he wanted me to complete for the non-profit.

So in summary and defense, was the original work on the personal returns prepared perfectly, quickly and to the praise of my clients? Yes they were. Was I planning to prepare the other return by the deadline? Yes I was. Was I lax in the communication to [redacted]? I am afraid to say my health caused a breakdown .However, the refund for services performed for [redacted] were completed and fairly charged and for that product, I believe [redacted] does not merit a refund of 50% of the fee. There shouldn’t even be a penalty or fine because the non-profit still had time to be completed, he just decided after the initial wonderful service, that the lack of communication was not for him and he decided to move on and file a complaint.

Review: I met with [redacted] in his office with my husband in on April [redacted] to file our taxes jointly for the first time. I paid a $50 retainer fee on March [redacted] that was supposed to go towards the cost of filing. He filed an extension for us the same day and informed us that our taxes would be done around mid-May. May [redacted] comes and I email him but no response. I also try to call and the secretary informs me he will call this evening or tomorrow. I email again June [redacted], this time he responds and says the taxes will be done by the end of the week. We don't hear anything again despite our emails and calls.

The last correspondence we had from the company was from his office assistant via email on July [redacted] to say our extension was coming to an end and our taxes would be done by the end of the week. Both my husband and I have emailed them and called numerous times since then and have heard nothing at all.Desired Settlement: The $50 retainer fee that was charged to my bank card.
