On October 11th, 2015, Mr*** *** came in to purchase a truckAs part of the agreement, Mr*** was to put $10,down
However, he never didHe claims that he left the $10,in an envelope on a desk at the dealershipHad we received the down payment from Mr***, we would have written him a receipt and he would have had to fill out cash reporting paperwork for the IRS, which is necessary any time $10,or more is received from a customer
Mr*** has no receipt, and no IRS paperworkThat's because Mr*** never gave us the $10,he was supposed to give us as down payment
Because we never received the down payment, we could not process the loanWe made several attempts to contact Mr***, to no availBecause we have ten days to finalize the paperwork or rescind the contract, we were forced to rescind the contract
After several months of trying to get in touch with Mr***, he finally showed up wanting to pay the balanceI spoke to Mr*** and told him we would accept payment in full for the truck, but the contract that he originally signed had been rescinded two months prior
After over three months of hiding the vehicle and avoiding contact with us, Mr*** finally agreed to allow us to come get our truck
He claims in his complaint that we continued to run his credit and send his loan out to different banks which in turn hurt his credit scoreThat is simply not trueWe did send his loan out immediately after he took our truck, but once we determined that he hadn't given us the down payment and didn't intend to, we stopped shopping his loanAny decline letters he received would have been from our initial round of contact with the banks when we were trying to find a bank to approve his loanAny inquiries on his credit associated with our dealership after the rescission letter was sent would have been inquiries to determine his whereabouts in the process of trying to find our property, the truck that Mr*** was hiding from us
I've discussed with Mr*** his options to resolve this matterHowever, he insists that he wants us to give him $10,that we never collected, never receipted, and never reported to the IRSWe simply cannot return what we never had

***'s complaints which are at times confusing and miss-leading we accept no responsibilityAt no time did anyone from Razzari Dodge sabotage Mr*** vehicle in any wayMr*** brought his vehicle to Razzari Dodge requesting a fuel pump replacement at his own diagnosis as his vehicle was already not running properly stating that his vehicle would at times "shut off"At that time he presented a copy of an extended warranty policy of which he purchased when he originally bought his vehicle from different used vehicle dealership and informed our staff that he expected the repair to performed at no charge to him per said warrantyWe accepted Mr***'s vehicle promising only to report back the cause of his vehicle concern, estimated cost to repair, time to complete the repair and as to whether or not his after-market extended warranty company would cover the associated costOur expert technicians were able to determine that his vehicle actually needed a fuel tank replacement and not a fuel pump and that his warranty company was contacted and they declined to cover as the failed part was not a covered component and more importantly the terms of his warranty had expiredWhen Mr*** was informed of the true cause of mechanical failure, the cost to him to repair and the denial of coverage by his warranty company he refused to authorize any repairs what so everAt Mr***'s request we arranged for him to pick up his vehicle after hours from our sales staffFurthermore as a gesture of goodwill and customer service Razzari Dodge waived the $Mr*** agreed to for diagnosis of his vehicle's failuresRazzari Dodge did not replace ANY part on Mr***'s vehicle, did not disassemble any part or system and certainly did not sabotage his vehicleMr***'s vehicle was returned to him in exactly the same condition that it was in when he brought it to us for repairTherefore Razzari Dodge is declining Mr***'s request for a "Check" so that he may have his vehicle repaired at no charge to him

Refund check was personally delivered to customer by sales consultant in Fresno and cleared our bank on 1/21/16.

The title and registration were issued on 9/29/16. We were missing a necessary DMV document stating the declared weight by the customer which caused the delay. Ally Bank is the Lienholder and a paper title will not be issued to them as they require a paperless title. The license plates and...
