R.C. Renovations

We signed up with Ron C. in April for a fence and deck that was to start in May. Ron insisted on a 1/3rd the cost on signing and 1/3rd on the day the work starts. He accepted money by cash or email money transfer only. We transferred the funds. Up until this point Ron had been very responsive, never missing a phone call or a text.

Then, when work was supposed to start, we were never able to get a hold of Ron. He would not answer for days. Then we would call from a different number, and he'd pick up. He's apologize and say that "his phone was out of battery" or he didn't respond because he was "busy trying to schedule us" and "didn't want to return our call until [he] had an answer".

Then he said he would show up to place the marks for the posts and unless we paid him the second installment per the contract, he would NOT send in his crew to dig the posts. So, he showed up, painted markings for the posts, collected another $2000 and walked away never to be seen again!

Then it went on again for weeks. He wouldn't answer our calls or return our voicemails or respond to our texts or emails. He said that we had to now apply for a permit at the city but he would build the fence in the meantime. He gave us three dates, at each time, never showing up and never even extending the courtesy of a phone call to say that his crew is not coming.

When I finally connected with him again, he agreed that it was a mess and agreed to refund the cash. He never did. Then a week of unanswered phone calls, and messages later, he responded back by text and said that he needs a registered mail for cancelling the contract. When I brought up our verbal agreement to refund the cash since the work has not been done, he said "things change".

We are now taking this to court.
