I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.Again, this response has not answered my previous replies requestAlthough it is great to see a payment arrangement, I do not see any payments made, which is what was requestedAlthough I see a receipt for carpet, I do not see where it was installed at this address, much less the pictures showing damage to the carpet to back up this purchaseI am also waiting to see where the carpet was sanitized and cleaned after the sewage backupTherefore, since it was not cleaned and sanitized after a sewage backup, the condition is to no fault of our own and therefore, we are not responsible for its replacement costI have also requested a copy of the certified return receipt for the security deposit disposition letter that was required when we moved outStill not being producedThe citation they claimed was issued, but then said wasnt issued is still in question as well.As for a gas and electric billI'm confused as the utilities were in our name and transfered with us when we movedAs for curtains "due to smoke damage", this was a smoke free home, therefore, not sure why they were cleaned but it wasnt due to smoke.In closing, Remax failed to follow the [redacted] Revised Code in regards to security deposits, and has not provided the information to which they have claimed to have "proof" of, as it has still not been providedRemax will continue to argue mute points to avoid being penalized for their mistakes in upholding [redacted] tenant landlord laws and should be required to reimburse the security deposit times two, as stated in the law as well as providing a reference to their own failure.Regards, [redacted] ***

I am enclosing a copy of the lease that clearly gives instructions on what needs to be done prior to vacating a property. A copy of a signed document showing that...

RE/MAX Crossroads was never in receipt of the tenants security deposit. Lastly, I am enclosing the document that she agreed to have the carpet's professionally cleaned prior to vacating the property.
On or about March 7, 2016 the tenant came to our office to drop off her rent. She spoke with Challi, who works on my team, and said she would be giving a 30 day notice with her next month's rent. Challi informed the tenant that would be fine and that she must turn in a written notice with the following month's rent. She later in the month contacted our office stating that she was in fact moving in with friends at the end of March and that she had already given notice. I was currently out of medical leave, I had a major knee surgery on march 22 from an injury that I was unable to walk on since March 16th. At all times there was at least two other agents that could answer the calls. The tenant was told on several occasions that her notice must be given in writing and it had to be 30 days prior to vacating the property. I, in fact, also spoke with the tenant while off and explained the same information.
In reference to service issues, a gas stove was installed in April 2015 after being notified that there was an issue. In May of 2015 Portage City Pest was sent out due to a complaint of ants.
In closing RE/MAX crossroads nor Jody was ever in receipt of the security deposit for [redacted].

I was contacted for a reference in regards to the tenant applying for housing. I was asked specific questions of which I answered honestly and only the questions that were asked of me. The questions asked are the following
 I was asked if they rented from specific timeframe which I answered...

YES.  However there was NO notification from either lease holder that they were moving.  It was not until the owner called saying that he was notified they left during the night. It was confirmed by me and one of my field people the next day that indeed they were gone.
I was asked if they paid their rent on time and I say 98% of the time YES.  They did not pay the last month rent they were there. They as well had a few months that they were late in paying. 
I was asked if they paid their utility bills in full and I responded NO they left a very large amount due on a water bill. 
I was asked if there was anything I wanted to add – my response is NO I would think this is enough to make your decision.
As for giving a signed consent to provide the reference, the tenant provided consent when they gave my name and number for a reference.  Therefore that is consent!
As for security deposit, the deposit was not refunded due to the following
Last month rent – not paid – owner has mortgage to pay
Utility bill totaling over $1,000 not paid – owner had to pay
Violation of lease regarding pets – one dog approved, two resided at the residence
Trash out of items left in the house after they vacated – owner incurred the cost of trashing out.
Security deposits are not refunded until a walk through is conducted, all keys and remotes are returned and all rents and utility bills are paid in full. This was not the case with these tenants.
