Hello [redacted], Please see my responses to [redacted]'s complaint in ALL CAPS below.  I have attached supporting documentation.  Please let me know if you require anything further.   1.  For one I did ask her  to do a walk through and ask if we where going to take before pictures of house?   HOW COULD I HAVE DONE A WALK THROUGH WITH HER, WHEN SHE HAD NOT FINISHED MOVING OUT OF HER HOUSE UNTIL AFTER 6 PM ON SUNDAY NIGHT, THE DAY THE TENANTS WERE SUPPOSED TO HAVE BEEN GIVEN POSSESSION?  I TOLD HER WE WOULD TAKE PICTURES BEFORE MOVE IN.  SHE HAS BEEN GIVEN COPIES OF ALL PICTURES.   I think it was my mistake for letting her know it was my first time renting my house and I didn't know anything I feel like she is bulling me due to me being naive.  ALL I DID WAS HOLD HER TO THE STANDARD THAT IS REQUIRED OF ALL LANDLORD/OWNERS.   2.  It seem she was willing to answer any question and call me back immediately before I hired her once I signed contract I felt she just push me a side even though I discussed with her my financial struggle and me trying o be out the house by December 1.  SHE HAS NEVER BEEN PUSHED ASIDE.  I HAVE DOCUMENTED TEXT CONVERSATIONS WITH [redacted] ON THE FOLLOWING DATES: 11/4,11/5,11/6,11/7,11/8,11/9,11/12,11/13,11/14,11/15,11/16,11/18,11/20,11/21,11... ,  (SO BASICALLY, I HAD CONTACT WITH [redacted] AT LEAST 22 DAYS OUT OF THE 30 DAYS ... FROM THE TIME I FIRST LISTED THE HOUSE ON THE MARKET, THROUGH THE DATE OF MOVE-IN.  PLEASE LET ME KNOW IF YOU WOULD LIKE ME TO PROVIDE FURTHER PROOF.) 3.  Since it was getting closer to end of month I decided I would help out. So my friend and I listed my home on Facebook  due to the fact only 2 people had looked at my house, and she had told me prior to me hiring her that a lot of people where looking in my area to rent and that my house would rent fast that I shouldn't stress on having it rented by December.   After listing my home on Facebook I was being messaged  by numerous of people trying to look at my home well they had stated my property manager wasn't calling them back?  Im not sure if she was mad cause I was doing her job. because from that point on she was acting very rude towards me.   PLEASE SEE ATTACHED COPIES OF TEXTS DOCUMENTING AT LEAST 10 OF THE SHOWINGS THAT TOOK PLACE.  THE TWO PEOPLE THAT CONTACTED ME THROUGH THE AD THAT [redacted] PLACED ON FACEBOOK WERE NOT QUALIFIED.  SEE ATTACHED. 4.  I also told me my house is move in  ready talking about how nice it was?  PLEASE SEE EMAIL DATED 11/5 ATTACHED HERETO INDICATING THAT THE PROPERTY WAS NOT "SHOW READY" AND WHERE I ATTACHED A CHECKLIST OF THINGS SHE NEEDED TO DO TO GET THE HOUSE READY. 5.Im not sure why the tenants that seen the home prior to moving in why they would rent it and than had so many complains about the home if they didn't like paint Im not sure why they rented it. I never stated I would have my house to be remodel for a 1 year lease renter? I think she is telling the tenants one thing and than getting upset with me when I say no my house is not going to painted cause I will be moving back n this is just temporary so I can catch up  on my bills.   THE TENANTS WEREN'T EVEN ABLE TO SEE THE MASTER BEDROOM WHEN THEY FIRST SAW THE HOUSE.  THE HOUSE WAS PACKED FULL OF PICTURES AND FURNITURE, SO IT TRULY WAS NOT CLEAR AS TO THE CONDITION OF THE PAINT UNTIL [redacted] HAD FULLY MOVED OUT.   The money I want to approve or at least give me the option of finding something cheaper.  1st month she issues me $343 dollars out of 1895$ 6.  800$ her fee   OUR LEASING FEE IS $800, SHE KNEW THIS UP FRONT WHEN SHE SIGNED THE LEASE LISTING AGREEMENT  7.  100$ her fee   OUR PROPERTY MANAGEMENT FEE IS $100 PER MONTH, WHICH SHE KNEW ABOUT WHEN SHE SIGNED THE PMA     8.  350$ cleaning service that is over 200$ without my approval - TENANTS WERE ALREADY 1 DAY BEHIND ON BEING ABLE TO GET KEYS.  WHEN THEY GOT THE KEYS THE HOUSE WAS FILTHY AND NOT READY FOR MOVE IN ON A MONDAY, HOWEVER THEY WERE SCHEDULED TO LEAVE OUT OF STATE TWO DAYS LATER ON EARLY WEDNESDAY MORNING.  THE TENANTS WERE EXTREMELY UPSET, AND THEY NEEDED TO BE ABLE TO MOVE THEIR BELONGINGS INTO A CLEAN HOME.  SO, I HAD TO MAKE THE DECISION TO IMMEDIATELY CALL ONE OF OUR VENDORS, WHO BROUGHT 5 OF THEIR CLEANING PEOPLE TO THE PROPERTY FOR THE RUSH CLEANING.  THEY WERE THERE CLEANING FROM 3-8 PM.  THEIR FEES ARE CONSISTENTLY ALWAYS MORE AFFORDABLE THAN ANY OTHER CLEANING VENDORS.  WE HAVE USED THEM FOR YEARS. 9.  200$ she holding for screens - THERE ARE MULTIPLE SCREENS THAT ARE TORN, MISSING OR HAVE HOLES IN THEM.  CONTRACT ALLOWS US TO HOLD FUNDS FOR NECESSARY REPAIRS. 10.  100$ carpets that I had done just a week prior and spent 150$     ON DAY OF MOVE-IN, WHEN CONDITION OF HOME WAS DISCOVERED, I ASKED HER THREE TIMES TO SEND ME THE CONTACT INFO OF HER CARPET CLEANER, AFTER SHE TOLD ME SHE ALREADY HAD IT CLEANED.  SINCE SHE DIDN'T SEND ME THAT INFO, I HAD TO RUSH TO SCHEDULE THE CARPETS TO BE CLEANED.  SEE EMAIL DATED 12/5 WHEREIN [redacted] STATES "CARPETS I HAD CLEANED 2 WEEKS AGO 120$..."   [redacted] DID NOT EVEN START MOVING HER FURNITURE UNTIL THE WEEK OF DECEMBER 1ST.  SO IF SHE HIRED A CARPET CLEANER, THEY COULD HAVE ONLY SPOT CLEANED IN THE ROOMS.  ALL BEDROOMS HAD BEDS, DRESSERS AND FURNITURE IN THEM. my carpets are 9 years old they seen them prior to move in I never said I was putting new carpets in for renters.  WE NEVER ASKED HER TO PUT NEW CARPET INTO THE ROOMS.  THE FRONT BEDROOM CARPET WAS FRAYED AT THE TRANSITION AND WE ASKED HER TO STRETCH AND INSTALL A TRANSITION PIECE AS IT WAS A TRIPPING HAZARD. so that 600$ spent without my approval  Than I thinking how am I going to pay rent I just spent all my money on fixing things for house. approval.  The terms of our Property Management Agreement clearly state that we are allowed to effectuate necessary repairs that are less than $200 without the owner’s consent.  I think this stems from [redacted] being angry that we authorized a pest control service to go out to eradicate the ants that invaded the property within a few short days of the tenants moving in.    Due to the horrible condition of some of the wall paint inside the home, the tenants have asked the owner to pay for a portion of the costs involved in painting the home.  She has agreed and admitted to being responsible for painting one of the bedrooms that was a total disaster.  Negotiations for painting need to still take place as tenants are extremely unhappy.  [redacted] was constantly texting me for every little question.  Not only during normal business hours, but early mornings, nights and weekends.  Here is a list of just those text days/times that fall outside of my normal Mon-Fri  8 am to 8 pm time frame for answering business calls and responding to texts.  10/16     7:49 am 11/2     7:25 am Sunday, 11/5    7:40 am Sunday 11/5      5:13 am Saturday 11/11   7:08 am Sunday 11/12   8:14 am 11/16     6:35 am Saturday 11/18   7:59 am Sunday 11/19    8:17 am 11/28     7:07 am Saturday 12/2   11:05 pm 12/4      5:32 am I did not even include all the texts that I received between the hours of 6 pm and 10 pm that I received from her.   Once the tenants moved in I told her that my office management would now take over the majority needs of the property.  And that, other  than emergencies, she would need to call the office and/or email the office for any needs that she had regarding the property.  Our office is open Mon-Fri from 9am to 5pm.  All along I had told her that the property needs to be in “move in” condition.  Clean and ready to go.  The tenants were supposed to get keys and move in on Sunday, December 3rd.    We were not given the “go ahead” for tenants to move in until Monday the 4th.  When we arrived, the house was filthy, carpets weren’t cleaned and there were still several items left behind in garage, side yard, and dog poop all throughout the backyard.  She never asked me to do a walk through with her on the property prior to the tenants’ occupation.  After I gave her a list of ALL the things that the property needed so that the tenants could actually move their furniture in, she then said “why didn’t you do a walk through with me before this so that I could know what I needed to do?”  Here are just a few of the pictures documenting the condition of the property on the day I gave keys to the tenants.  I had to request a RUSH cleaning of the property, as well as a carpet cleaning, which was obviously not done.   Please let me know if you need any further clarification.    Sincerely,    [redacted], Broker RE/MAX Diamond [redacted] Rd., Suite C [redacted], CA  [redacted]
