[thus our name), andthat's why we are continuously working with you now to make sure everything thatyou expected gets resolvedWe understand that our help doesn't stop at the closingtable and that its only the beginning in helping you get set up with your utilitytransfers, changing of schools, etc.In regards to your experience with us, we also want to make sure not onlythe buyers are aware of the process of buying a home but we make sure that allparties are involvedImmediately, after ratification of a contract we send a chainlink to all parties who are involved and request that they continue to use that sameemail link or at least to incorporate the important parties (lender, title company,agents, etc.)Now in regards to your experience with us, we can understand yourfrustration with the appraisalPer the contract, the appraiser [a third party) is sentout to review the comparables around the property and establish the evaluation ofthe property's valueAll parties had agree that the sales price of the home to be$127,(contract which ratified on May 26th 2016th) The appraisal reportcame in on July 17th, and it stated the following (Please see attached theappraisal report)The appraisal had an evaluation of $131,which was morethan great because that indicated that the buyer would have $in equityButbecause you had decided to do a renovation loan [which is perfectly fine) the value of the house had to come in lower so that the repairs could be incorporated in. After reviewing that the appraisal situation would take a little longer than anticipateespecially to figure out the adjusted numbers/repairs need to be done, Re/Max EliteServices acted proactively and communicated with the listing agent to obtain anextensionThe extension would be extended till the July 28th, The issues of therenovations took time to be resolved by the buyer and the loan officer to calculatewhat renovations [and the amount) were going to be conductedThus our companycomplied with a second extension until August 22nd, The fact of the matterwas that the appraisal had indicated a value of the property that was not favorableto the buyer because it would limit her repairs and obviously the seller had intendedto correspond with the value that was mentioned in the appraisalIdeally the valueof the house needed to be a $115,as discussed with the loan officerRe/MaxElite Services acted in good faith to the buyer and send the buyer to sign anaddendum lowering the sales price to $115,so that all her repairs could beincorporated inObviously by doing so the sellers would be losing a net of$12,($127,sales price minus $115,requested sales prices sothat the buyer could do her renovations) At the end, Re/Max Elite Services hadnegotiate the with the sellers to reduce the sales price to $120,to make thedeal work for the buyerAs closing was a few days away, the buyer decided to reachout ask for additional creditsOne of the credits was to see if the could reduce thetitle company's fee [no specification on a certain amount) and if they wouldn'tcomply with reducing their fee the buyer would back out of the contract without alegitimate contingencyPer the contract we had a total of three contingencies thatinvolved the home inspection, appraisal and financing which all of which had expiredWe managed to speak with the title company to see what the title companycould do for the buyer and there were back and forth discussions what the amountwould beAt the end the buyer received a credit for the title company of $Inaddition to the title credit, the buyer had expressed that she would like 1%commission cut from realtor's commission due to her experience of a renovationtransaction and everything that had transpire with the appraisalWe, in good faith,acted as such to reduce the realtor's commission to 1% as promised for the buyer.We obviously have the Closing Disclosure that demonstrates our commission beinglowerdMomentarily, we are trying to obtain the buyer's 1% commission of$as it shows very clearly that we lowered the commission so that the buyeris completely satisfied.Here at Re/Max Elite Services we are honored to uphold our company'sname by providing only best level of service and we try to make sure all clients aresatisfied beyond beliefObviously, in a purchase of home many things may transpirebut at the end we try and help everyone obtain their ideal homeEven thougheverything had transpire we are happy that you obtain your goal and we providevarious help in terms of closing cost negotiated from the sellers, credits provided bythe title company, and us providing 1% commissionHopefully we can help assistyou in the future for any other purchasing needs you might need.RE/MAX Elite Services *** *** ***, North Bethesda, MD *** Office ###-###-#### , Fax ###-###-#### [email protected], www.remaxelitellc.com Each Office Independently Owned and Operated

We have received your letter describing your experience and post thoughts on working with Re/Max Elite ServicesWe understand you are upset and frustrated in regards to the loss of your Earnest Money Deposit (EMD)It is frustrating when expectations are not metHowever, as we explained when we
initially met and again continually throughout the process there are three legitimate contingencies in place to remove yourself from the contract with no penaltyThe first being the home inspection contingency, in your instance we were able to negotiate some repairs as well as a home warrantyThe Second clause is an appraisal contingency, in the purchase of this property the determined value by the appraiser came in over sales price, meaning you would have had instant equityLastly the financing contingency; the lender had approved your loan with a strong outcome for you as a purchaser your debt to income ratios were incredibly lowAs we indicated you could have moved onto settlement without issue since you were well qualified and had moved past all three contingenciesUnfortunately after reviewing your finances personally you decided the purchase would impact your lifestyle too greatly and was not worth pursuing as you did not want to change what you had become accustomed toRegrettably this is not a viable reason to contest the deposit or partial deposit to be returned to youAlthough we did attempt to recover your funds, the sellers cited the legal verbiage throughout the contract that reflected you the buyer was past your legal right to cancelWe understand that it must be disappointing to lose your earnest money depositHowever the legally binding agreement, which you signed, clearly details all the above listed contingencies as well as the purchase price you offeredWe pride our self on providing the best level of service and would love to help you in your future home search should you decide to continue looking at any point

Following the appraisal of the property, my realtor was informed that the price came in much lower than the seller's had expected Thus, I received a communication stating that the price had been dropped to $115k Unfortunately, the seller nor the sellers agent had any knowledge of any this Apparently, this number was arbitrarily given and later I was informed that this is a standard practice in this situat
