RE/MAX Gold and its associates work hard to provide the best possible service to buyers and sellers of real estate The information below is in response to Mr***’s complaint Although it is most unfortunate that Mr [redacted] was not satisfied, I understand that both Joe Herbert, the associate, and Allen Zarou, the Manager of the office, addressed his concerns over the telephone in December In reviewing our documentation, the Earthquake Hazards Booklet was transmitted electronically along with the Commercial Property ID report This report clearly states the location of the property as it relates to earthquake faults and zones The file also shows that although Mr [redacted] chose to waive any home inspection, he received a Buyers Inspection Advisory which included information about possible investigations relating to earthquake safety Lastly, the Trust Advisory document in the file states that the seller, under this transaction, was exempt from having to provide the seller disclosure mentioned in the complaint Hopefully this statement provides more clarity to the conversations by the associate and the Manager in December, Bev [redacted] RE/MAX Gold Executive Vice President Broker of Record BRE # [redacted]

Although it is most unfortunate that Mr. [redacted] was not satisfied, I understand that both Joe Herbert, the associate, and Allen Zarou, the Manager of the office, addressed his concerns over the telephone in December.
 
In reviewing our documentation, the Earthquake Hazards Booklet was transmitted electronically along with the Commercial Property ID report.  This report clearly states the location of the property as it relates to earthquake faults and zones.   The file also shows that although  Mr. [redacted] chose to waive any home inspection, he received a  Buyers Inspection Advisory  which included information about possible investigations relating to earthquake safety.   Lastly, the Trust Advisory document in the file states that the seller, under this transaction, was exempt from having to provide the seller disclosure mentioned in the complaint.

Review: I am being represented by a broker in ReMax group in Davis, California. I have tried to phone and email the manger several times but he has not returned my calls. The players involved are two agents employed by ReMax. Details: I have been going through a very difficult situation involving the sale of my home, which is currently in escrow. To be brief, I feel that my interests have not been represented, and that I have been financially compromised. My perception is that the agents within this brokerage firm of ReMax -Davis are making deals with each other (XZ and ZZ), and I feel that the price on my house has been undercut for the purposes of an inside sale to ZZ. Specifically, ZZ, serving as her own agent, has made an offer on my house that is 40K lower than my original asking price. My agent (XZ) told me her asking price was comparable to other homes being sold but did not show me the comps of very recently sold homes which were more in the original range (760K). I trusted my agent, but only later found out on my own, and after I signed the escrow papers, that a paraticular key comp sold for my original asking price and I had specifically and repeatedly asked for this information. When I complained, my agent, XY told me that if I wanted somebody to work for my best interests, then I should get a lawyer.Given the situation, I have expresssed my concerns in writing and have asked for an in person meeting with the manager (name withheld) but he is not responding so far. I would think that a reputable firm would want to know the client's perspective, particularly when their home is on the line to be sold to somebody within the company against the client's wishes. I have now gone back and looked at their website and I could find absolutely nothing there about client satisfaction so perhaps this is no surprise and there is nothing to complain about, but the Revdex.com might see this differently.Desired Settlement: I would like to meet with the manager, at Davis ReMax so that I can express my concerns face to face. I would also like the sale stopped, but legally there is nothing I can do if the buyer won't back out. I cannot afford the thousands of dollars in legal fees to fight any of this.

Review: Remax Gold Agent [redacted] and [redacted] listed the property for sale at address 24 and 30 Vine Street located in Vacaville California 95688. Houses were constructed in 1900 and fall under the State of California 2005 (Replaces the 202 edition) Homeowner's Guide to Earthquake Safety and Seller Earthquake Disclosure Form. This guide was developed and adopted by the California Seismic Safety Commission as required by assembly Bill 2959, Authored by Assemblyman [redacted]s (Chapter 1499, Statutes of 1990), and Assembly Bill 200, Authored by Assemblyman [redacted] (Chapter 699, Statutes of 1991)California State Law requires the seller to Deliver a copy of the earthquake hazard booklet to the buyer if the home was built before 1960 and deliver in a timely manner the Residential Earthquake Hazards Report. Broker did not deliver said items in timely manner and changed the Natural Hazards Report from Commercial to Residential after close of escrow threatening the buyer to sign it. Broker also threatened buyer to sign Residential Earthquake Hazards Report after close of escrow. Recent Earthquake in Napa reached City of Vacaville and Real Estate Disclosures have not been disclosed to buyer violating state of California Law. Significant Repairs will need to be made to both said structures to make safe for human occupancy. My Home are a a complete loss because the Broker did not disclose Seller Earthquake Hazard Disclosure form to buyer before close of Escrow as required by state law.Desired Settlement: Repair of earthquake retrofit for both structures for non disclosure of State of California Earthquake Hazard Seller Disclosure Forms and Homeowner Guide to Earthquake Safety.
