RE/MAX Leading Edge acted ethically and properly in representing our client, the seller in this transaction. The buyer has forfeited his deposit as a result of not acting with the contractual dates. attorney) we will continue to hold the money in escrow until we receive instructions as to how it should be distributed as per the agreed upon contract between the two parties. RE/MAX leading edge cannot release a deposit without the seller's permission as per the purchase and sale contract. Furhter, according to our ethics training, as well as our legal counsel, the listing agent and office have no obligation to disclose the existence of a sex offender because it is public record to anyone who wishes to know. The buyer was represented by his own agent and attorney who should have advised him of such. As a matter of fact, the buyer did discover the information on his own and told our company about the existence of the sex offender. The buyer had time to do any and all investigations that he felt to be important to him before signing a contract and making a deposit. Further, the purchase and sale contract that the buyer signed does not allow him to be released from the contract under such circumstances. The seller is under no obligation to release the deposit. The seller was left in a precarious position just days before the closing date, leading to increased carrying costs and the inconvenience of having to re-market and sell his home. A few days later the buyer then notified the seller that his bank had denied him financing , but only after his contractual finance date had passed. Thus, again, the seller has no obligation to release the deposit if the buyer allows the finance date to pass. Of mote, is that the seller was aware of the situation, has young children, and is moving to the house next door, and according to MA state law has no duty to disclose such matters.
