Complaint: [redacted] I am rejecting this response because: As God as my witness I was told quote"we are Giving You this money as a down paymentthe warranty insurance from the prevois car was never...never mentionedBoth the salesman and finace rep were misleading on several accounts...but I am fighting this issue because the only reason I continued with the purchase because they told me quote unquote We are giving you this moneyI asked the general manager and the chance manager to look at the video and they have yet to do itBut at the point I do not trust any of themoverall o got a bad deali request hat they send you the tape fir review, as well as send me a copyI do not want to walk in this estalishment againi already told the salesperson he lied through his teeth and he just hung up on mei can't understand why they went out of their way to give me such a raw deal except for the fact I complained so much about the first car being a lemonother than the fact sorry but having a hard time typng this on my phoneI don't know how this salesman can sleep at nightSales must have really slow., [redacted] ***

I, *** ***, GM of Ancira Kia have spoken to *** *** and have explained to her that the cancelations of her warranty and gap from her trade in vehicle has gone to down payment on the purchase of her new carI have offered her several times to watch the video of her transaction in
finance with her clearly showing the disclosure of her cancelations being used as down payment and the forms that were signed to direct the funds to the down payment*** has stated to me that during the transaction she was not paying attention and just signed, we are a reputable dealer and will always try to do the right thing for our customers but giving *** a check for what was used already to pay down the balance of her car and her initial payment will not be an option

Mr***, as discussed yesterday we have set you up with someone to fix your issue, I apologize for the confusion on our part but as discussed you and our salesperson both were under the same impression that the car was equipped with the option because it had the button on the radio for the
function, after looking into the issue we resolved the misunderstanding the same business day as soon as it was brought to our attention, we appreciate your patients and your business and please in the future let me know personally what I can do for you, any questions feel free to give me a call

The day that Ms*** was in my office reviewing her concerns I offered to review the video with her at the time she declined saying that even if it was on the video of the multiple papers she signed to apply the cancelations as cash down towards the purchase of the new car her exact words were that she was not paying attention anyways, based off of the situation she then moved to tell me that she was going to picket our dealership if she didn't get her moneyI told her that it was her right to do that but would not suggest such a thing because the money had been applied on a contract as down payment towards the new vehicle it did not go to our dealership so there is nothing to returnI then noticed after she escalated her attitude and breathing heavy that she had a strong smell of alcohol and asked how she arrived at our dealership and was she driving, she immediately ran out of the store and tore out of the parking lot and at that moment I contacted *** *** police deptand filed a CASE # *** and Ms. *** is longer allowed on our propertyI had hoped it didn't come to that but based off of the events that had occurred the steps were followed accordingly to protect my staff from threatening phone calls of harassment and vulgarity

I am rejecting this response because: This issue is still not resolved.  The response from the business does not specify who responded.  I'm ASSUMING it's General Manager [redacted].  [redacted] had already told me in writing & on the phone, they are not refunding me any of my unnecessary expenses.  So why should I reach back out to [redacted]?  For him to tell me No again?  This is my reason for reaching out to Revdex.com.  Anyway, today I reached out to [redacted] and he has no clue why I would be calling him.  I explained this Revdex.com feed and he said [redacted] is out on vacation and would not be back til Tuesday.  He will let [redacted] know that I called and he will have him call me back on Tuesday.

I am rejecting this response because:Reply to Business…Ancira Kia – Bandera Kia, San Antonio, TX 78250I read the response from the General Manager and I want to start by saying several things he wrote in his response were incorrect OR IN SOME CASES LIES.  …basically made up.When he asked about reviewing the video I said that I had asked the sales manager and then had asked him to review it and they did not.  Because of that I believed that they did not really care if I was right or wrong they had already made of their minds to disregard my concerns…. While I had originally followed the chain of command there was no follow up on their part.When I realized I was a fighting a losing battle with the dealership… I told him I was going to picket his business.  He said you don’t want to do that because a lot of bad things could happen to you… I will have law enforcement get involved.  I got up to leave and said well you have left me no choice.  After I opened the door I looked at him and said this is bt.  He said that’s it, you are getting belligerent and you smell of alcohol and he picked up the phone.  I just glared at him and left.  I DID NOT RUN OUT OF THE BUILDING OR SPEED OUT OF THE PARKET LOT.  After everything they put me through… I do not think my saying “this is [redacted]” crossed the line to me being belligerent   In my defense I want to say that one of the chronic illnesses I have is diabetes and sometimes people suffering from diabetes are mistakenly thought to be drunk.  One of the identifying factors is profuse sweating which I do and I was that day…. I was also probably emitting a fruity sweet odor which diabetics will do …  a few years back I was almost denied a plane boarding pass because the attendants thought I was drunk.  I told them I was diabetic and I was disoriented and having a hard time finding my insulin.  They immediately stopped everything to help me find my insulin and once I took it, they put me in a wheel chair and rolled me to the plane.  They realized they made a mistake and corrected it. that’s what customer service oriented companies do. …..  The airline was Southwest Airlines…. the best in US air travel as far as I am concerned.  They don’t make excuses they correct problems.Anyway, I felt I was scammed from beginning to the end and I did sign some things that I should not have signed.  However, I know I was told at least a half dozen times “WE ARE GIVING YOU THE MONEY (ABOUT 4,000) DOLLARS AS A DOWN PAYMENT ON THE NEXT CAR”.This is how I see it…I initially went to the dealership to buy a cheap hail damaged car and I wanted to keep the payment around 200.00.  Well I got that … but both my husband and I did not realize that we had paid almost 3,000 for a warranty that we were led to believe was already included in the price of the car.  In this case, they even got over on my husband.After only driving it 150 miles…. I was driving on a hot day and the vehicle was driving hard and loud.   Out of nowhere it stopped abruptly and made some horrible grinding sounds…after this occurred the vehicle would not move.  I was stuck in after work rush hour traffic and no one in their right mind would have helped me move it out of the line of traffic. So at that point I pushed on the gas and clutch as hard as I could and it moved about 4 feet It was at this point and for the first time and only time I smelt the clutch burning. I explained this to the service department but they failed to tell this to the warranty department and it took me two weeks to get them to pay for the damage incurred as they claimed I was negligent in my treatment of the car.  So yes, in the end the clutch was burned but it was due to safety reasons and not neglect.  Two people I talked to who were experts in manual transmissions agreed with me.  One said even if you were dogging the clutch even a Kio rio would last more than 150 miles, the other said the same thing and said to ask for an itemized list of what was fixed…. right, like they were going to give me that. Over all I felt they had treated me like bt through the whole process and let them know that and for this reason I believe they were more than happy to roll me over.   At one point they asked do you want to exchange it….and I said I would consider it.  After that someone or the other would call me relentlessly from the dealership telling me to come in so they can help me trade out.  For the most part I had more important things to think about like my health so I ignored them for a while.  During that time, I went to the emergency room twice and had two hospital stays.  The doctors were having a hard time determining what was wrong with me… since this was the case, before I ended up in the hospital again I decided to go to the dealership to trade it out … I did not want to wait any longer.The second time I went to the dealership to do the trade, they knew who I was and sat me down and told me all the wonderful things they were going to do for me.  Specifically, the salesman [redacted]. In the end this is how it turned out.They took the money from my warranty on the first car and the gap insurance … about 4,000 and used it to apply to my new car…they did not “GIVE ME THE MONEY”.They did not give me much on the trade either even though it only had less than 200 miles on it so the shortage amount on it was about 4,000 …which was rolled into the price of the car at the very end of the contract. So the total amount of the car came out to be about 21,000 for a kia rio without electronic keys or doors…. finally, after finance charges (9.6%) I end up paying 27,000 with a car payment of 365.00 a month.Okay so I really screwed up… but I am a very trusting person and I kept listing to their words instead of paying attention to what really was going on.  At one point my husband ran over to the dealership … looked at the contract and said leave now they are they are going to screw you over.  I said to him with the salesman looking on… “they are trying to help me… they are going to give me 4,000 for a down payment and they are going to take care of the financing so it is just a matter of getting it done.  My husband ended up leaving believing I was leaving.  As soon as my husband left the salesman said to me…” he’s telling you what to do when he is driving a Mercedes… also, “he was too mad to listen to what you were saying.”  I don’t know what this had to do with the price of tea in China but his words did egg me on to continue with the transaction along with the major factor being that the salesman, [redacted] had told me ‘WE ARE GOING TO GIVE ME 4,000 FOR A DOWN PAYMENT FOR THE CAR.” And he sat there and heard me repeat this to my husband.No matter what happened in many ways I do not have a leg to stand on as far as the contract goes… I mean I did sign it. But as God as my witness at no point was the use of the originally warranty and insurance ever mentioned…. To include the warranty, they snuck in on me on the second car. I did however, with full knowledge ask for GAP insurance on the second car.I am a very smart and determined person but I have been suffering with some cognitive functions problems which I told them a couple of times during the sale …. Which I guess gave them free reign to manipulate the numbers any way they wanted to. The salesman [redacted] applied deceptive practices all the way through the sale.  When I was with the financial agent… the sales man was also there for a bit of time and they did what I call tag teaming … talking and asking questions and keeping me from really looking at the contract… and between their questions and niceties they pushed papers in front of me to sign.The salesman knows what he did and I don’t know how he can sleep at night.The general manager is just as bad because he really did not give a bt how it all turned outAnd he only tossed his accusations my way, first after I threated to picket and then again after I asked him to make an appointment for my husband and I to view the financial transaction.  He said he filed a police report on me and it stated I was no longer could step foot on the premises.  Wow! What an A**.When I talked to this man all he kept saying was … we can’t give you the money…we already applied it to the car…The dealership did not get the money…so we CAN’T GIVE YOU THE MONEY YOU ARE ASKING FOR. Well frankly I don’t give a damn where the money went or where they now get it from.I want the money from the originally warranty and insurance…  I want some justification for what they set me up for. A  27,000 loan on a basic model of the kia rio with a $365.00 payment.They saw my act of telling them I was going to picket as a threat… well they can see it that way… they can say what they like about me… they can decide not to give me the money…  Yesterday a law suits financial office told me if I wanted to sue they would give me the money to do so at 1.8% interest. If this were the route I would take, the charge of “Slander” on their part would also be included.  Unfortunately for me they can rest easy as my health would not allow me to follow through on it.What they do not know is that they picked the wrong person to run over. While I have cognitive functions problems from time to time I am still one hell of a writer… and as I told the general manager in reference to my picketing is that I have the right to free speech….  And his response was to file a police report against me for being belligerent.And here we are again today…  him saying a bunch of negative things about me (which amounts to slander) …  and writing an elaborate story and making false allegation’s because they do not want to relinquish the money owned and do the right thing.My stress level due to my health problems and now this car situation is through the roof…. thanks Ancira kia for making my life a living hell.The General manage, [redacted], had bragged to me that they had a 4.8 review rating…  my response is whoopy… it is a well-known fact that MOST people who are dooped or scammed are too embarrassed to report it.  Well I can’t afford to be embarrassed.I have nothing more than say except that I hope my story goes viral…. If it does the loses they will incur will be nothing compared to the monies I am asking for….
