Complaint: [redacted] I am rejecting this response because: The agent continues to state that we have had some communication, “contact.” We have had noneNot with her, nor the anyone in the agency, nor anyone in the franchise When the contract to sell was withdrawn, after one month I requested that the keys we gave her were to be returned to us This was ignored until we filed this complaint with the Revdex.com After one month, she sent some keys, but these are not the keys we sent to her.The issue of keys to the property remains unresolved as she has decided to keep the keys although she, nor anyone within the agency nor franchise, have our permission She has no contract with us, so why is she keeping the keys? No communication of any sort since she sent those unknown keys This situation was started in April, now it is seven (7) months later and still unresolved! This is getting “olde!” Regards, [redacted]

This is a summary of the response from Her.1st some background, this Seller (person complaining) was listed and under contract back in May of with Her as the Seller's Realtor, and in the middle of the under contract process (with another real estate firm as the buyer's agent for the buyer), the Seller decided to stop returning calls and emails to Her When She finally reached him after a couple of weeks of no communication from the Seller, the Seller said he wanted out of the contract She was able to convince the Realtor working with the buyer to terminate the contract without suing the Seller, and then terminated Her listing with the Seller.The Seller called Her again in February of wanting to list and sell their property once again, and it was reiterated that He couldn't back out of another contract, that He had to promise that he wouldn't 'disappear' again and that He would return calls and communicate The Seller promised She sent Him a listing agreement, and He disappeared again for a few days, then resurfaced and signed the agreement She decided to contact Him one last time to reiterate that the signature of the Seller's stood for what He really wanted and that was to sell this time, She questioned herself for taking the listing during, at least, a week that went by before the Seller return the phone call---She was guessing at the timeframe, because it seems like alot longer He said yes list it She told him that She needed to retrieve the photos and started the process This is a process that does take time It seems like a long time--but She wanted to make sure He was serious this time and really wanted to sell.The property went on the market and another real estate firm brought an offer for $150,after days, there wasn't any other comparable properties on the market at the time helping to bring in a strong offer, and after receiving the offer She drew up a counter at full price, $169, She had difficulty getting the Seller on the phone, but after a few days He called Her back, and signed the counter at $169, It went under contract on 3/31/15.After that time, She sent the Seller required disclosures to sign and requests for HOA information, to which He did not respond She called him a couple of times/day, the disclosure deadlines passed, She finally got the Seller on the phone and was able to extend the disclosure time, then the Seller never signed the disclosures She called him times in one day....still, He wouldn't pick up or return communications.The buyer's agent bypassed the disclosure date and waived the need for them; then the buyer's agent conducted an Inspection Meanwhile, She was concerned that She wouldn't get ahold of the Seller for any inspection issues either, so She kept calling him The Buyer's agent brought an objection to the Inspection, and She still couldn't get the Seller to call Her back or email Her The Seller finally called Her the week of the 15th of April, and they argued She told Him that He had promised that he wouldn't disappear anymore, and He accused Her of not returning the Seller's calls He claimed that He had called Her 6-times and that She never returned the Seller's call(s) She told him, and She doesn't think She should have, that She didn't believe him He accused Her of renting the Seller's condo during the listing and never putting it in MLS He also said that the property was underpriced at the contract and list price even after He agreed to everything.She denied the accusations and told Him when the property was put in MLS, (the date) sent Him the full agent detail report as well as the sold comparables again that She had sent previously The Seller is, in fact, $over the last comparable sale He won't speak to Her, and is threatening a lawsuitThat was Her responseThe Seller did talk with our Managing Broker on the phone and discussed the issue to no conclusion.I would like to add that the Seller is under contract and should consult legal advice as to his actionsAlso, I have attached a recent correspondence from Jeannette to Gus.Thanks,***

Complaint: [redacted] I am rejecting this response because:I thought the Agent was to work for my interests That is what the agency contract stipulatesI do not know what to do, and the Agent is not doing anything other than making misleading accusations rather than attempting to resolve the problem How sad Claim that I had "disappeared." Well, I did not respond to her phone calls quickly because of illness However, I could not find our real estate on any listing of property for sale I could not find a listing of our property for sale I had phoned her at least times I was always shunted to "her direct line." That would ring about times, then instructed to leave message I did But, no response from the agent I did find others that were similar, but not oursI asked about that, specifically, on those calls Claim of $over comparables? Send something to verify that; better yet, give information where that can be found Show me "Renting it." a claim by the agent: I did not Fact: I noticed that the utility bills show some use beyond that as vacant Not enough to claim renting, but was more than just a few lights on My concern was that something was turned on that should not be Something that is "on" may indicate some problem, or may lead to a problem I asked the Agent about this, and she said she would check No response("Not return calls...") 2. “She was given keys to the unit plus several common area keys.” 2.1 She was given two keys; one for the common area, one for the unit itself. No reason to have several common area keys.3. “the common area keys did not work” 3.1 If the common area keys did not work, how could she show the property? She certainly would have notified us immediately, and 3.2 The property was shown, and a contract was signed, but seller’s financing did not finalize. Obviously, she had a “Common Area” key.4. “The HOA rekeyed several common area doors after (the sellers) gave our associate access keys” The HOA has never rekeyed any door. If the HOA had rekeyed, how could the property be shown? Refer to Number 3, above.5. This, the most recent response to our Revdex.com statements, is, supposedly, from some sort of manager at this franchise. I spoke with someone who claimed to be something like that at the beginning of this ordeal, April, 2015. He was definite; he had no interest in the disagreement we had with this agent in the franchise.Summary: We received a phone call from her that the buyers financing did not finalize, the afternoon before the day of closing. I am sorry Mr *** feels we have not cooperated with his requests, but our associate has in fact returned all the keys so there is nothing more we can do to resolve this situation to his satisfaction Our associate was given keys to the unit plus several common area keys - the common area keys did not work (the HOA rekeyed several common area doors after Mr *** gave our associate access keys) - the associate returned ALL THE KEYS SHE HAD, including those that didn't work
To those at the Revdex.com, this is our last response, as mentioned above, we cannot return keys we no longer have in our possession

I am sorry Mr [redacted] feels we have not cooperated with his requests, but our associate has in fact returned all the keys so there is nothing more we can do to resolve this situation to his satisfaction.  Our associate was given keys to the unit plus several common area keys - the common area keys did not work (the HOA rekeyed several common area doors after Mr [redacted] gave our associate access keys) - the associate returned ALL THE KEYS SHE HAD, including those that didn't work.  To those at the Revdex.com, this is our last response, as mentioned above, we cannot return keys we no longer have in our possession.
