At approximately 10:35 am, Tuesday January 19, I received a call from a RE/MAX representative who identified himself by name and that he had sold a house in the neighborhood. I was too ticked to record his name. I stated (in a clear LOUD voice) that I was on the No Call List. I'm elderly and have health issues. I need the land line for health problems and emergencies not for answering unsolicited sales calls.

Working with this Realtor was far and away the worst consumer experience I've ever had. The realtor we worked with, [redacted], was incompetant. He made errors on the paperwork multiple times. We had to re-write the offer three times when we made no changes to our offer he'd just made errors. He assured us he was experienced with HUD sales but you wouldn't have know that from his lack of knowledge. We walked him through, line by line, the requirements to complete the paperwork. He didn't know what documentation was needed from us (copies of both Social Security Card and driver's license). He assured us that we would be able to walk away from the deal with earnest money refunded if anything critical was found during the inspection. He had the utilities turned on as requested, but opened an account in our name. I was assured by WE Energies that this is not allowed and that the representative at WE thought she was speaking with my husband as he provided his social security number. I was told that realtors often have utilities turned on but they do it in their own name and get reimbursed afterward. When the contractor used by HUD went to turn on the water to the house they told us they couldn't because of the condition of the pipes. We were unable to have a complete inspection. At that time we told our realtor we were no longer interested in the house. He told us to write a letter explaining why and that we should get our earnest money back. That was not the case. When further research was done we were informed that the bank had to deny our loan in order to get the earnest money back. After much time and paperwork was done, we were told our earnest money would be returned. According to the HUD paperwork, they had 5 days to complete this transaction. When I called the realtor after 7 days and asked about it. He didn't know what I was talking about. I forwarded the email that he and I both received from HUD back to him and highlighted the 5 day stipulation. After 2 weeks, I called again. He said it seemed as though HUD sent the check to the wrong title company. Later, he changed the story saying that HUD lost it altogether. Regardless, I spent an hour at the bank getting the cashier's check cancelled. I suggest you stay far away from Remax on Oklahoma!

Review: On the morning of 8/5/13, I received a phone call from [redacted], a real estate agent with the business establishment in question. Prior to this date, I have never had contact with this individual. [redacted] made a cold-call to inquire about my house, which was recently for sale and taken off the market with another company. He began to ask me pointed questions regarding my interest in listing with his agency. During the course of the conversation, I felt [redacted] was starting to become pushy and rude. I politely declined his offer and said we were not interested in his services. [redacted] began to ask several pointed questions regarding our house sale. I told him that I felt he was pressuring me and that I do not want him to call again. The call was then ended amicably by both parties.

About 90 minutes later, I received another phone call from [redacted]. He began the conversation by asking if he had called already. I responded by saying that he did, and that he pressured me during the last phone call. In addition, I reminded him of my wish to not be called again. The call was then ended amicably by both parties.

During the morning of the next day (8/6/13), I received another phone call from the same phone number. I answered the phone; the caller instantly hung up the phone. I called the phone number back immediately after the initial call; [redacted] answered the phone. I stated I received a phone call from this number. [redacted] stated that it was a wrong number and the phone call ended.

Later that day, I contacted the manager of the business establishment via phone to state my concern and displeasure regarding the behavior of [redacted] and his business. I stated that I understood the rationale of cold-calling for clients, but to be repeatedly called by the same agent (who engaged in a pressuring sales pitch) after being told not to call again was simply unacceptable. The manager agreed with my viewpoint and ensured that this would not happen again.

Two days later (8/8/13), I received another phone call in the morning from [redacted]. I answered politely and [redacted] began the same sales pitch he presented to me on 8/5/13. It was apparent that he ignored my clear intention of not being interested in his business services, as well as my repeated request to not be contacted again. I asked if this was [redacted], and he got upset, stating that he was sure that he "deleted my number from the system." I stated this was not acceptable and immediately called the manager at the business establishment. After about an hour, I received a phone call from the manager, who stated that [redacted] claimed to not know he was calling the same number again and that his agents make multiple calls. After stating that I understand the nature of phone calls from a real estate agency, I stated that it was unacceptable to be harassed four times by the same agent in a roughly 48-hour period, especially after stating repeatedly that I was not interested in his services, asking numerous times for him to not call again, and to receive a phone call from [redacted] where he hung up upon hearing my voice. I stated to the manager that if my family were to elect to sell our house, we would never do business with his establishment and that further phone calls would result in contacting the proper authorities.Desired Settlement: I would like to ensure that repeated and harassing phone calls from this business end not only for myself, but other potential sales leads.

Response:

I have spent some time chatting with [redacted] and

reviewing the complaint and [redacted]’ written essay of what

occurred. As I am sure you see in many of these situations all the

details are not exactly the same. I will, however, say that the basic

information from [redacted] and from [redacted] is the same.

[redacted] has a system which notifies him of listings that

have expired from other companies. It is not his intention nor the

intention of our company to badger or harass any home seller. That of

course would be very detrimental to our business. We have very specific

procedures and guidelines in place for those sales executives that choose to “cold

call.” [redacted] does follow those procedures. In this type

of business plan the sales executive makes many calls in any given day.

They set aside a certain number of hours each day to do just that. That

is why the numbers are deleted as they go. However, if they were to come

up again, they would not seem familiar.

That is what happened in this case. [redacted] has

stated that he was quite sure he had deleted [redacted]’s number each

time he reached him. The last time it happened, he shut the system down

once again, double checked the system and hung a note on his wall highlighting

the number so as not to make the same mistake. Additionally, we have

corporately added the number to an internal “do not call list.”

Over and above that I do apologize to [redacted].
