The customer that complained was actually an independent contractor that used to work for us.   Realtor's are independent contractors that are 100% commission based.  Realtor's will have expenses that include fees associated with their business such as MLS fees and advertising, some Realtor's may list a foreclosure home where they are responsible for paying the utilities, or other misc. expenses.  If an agent doesn't want to pay them outright, they are allowed to put them on their expense account, with the understanding that these expenses will be withhold from their next closing where they earn a commission check.  Sometimes this may result in a Realtor not actually receiving a commission check because their expenses are more than they earned.
That is the case in this particular closing.  This individual earned a commission for this closing and his entire check was kept to pay for the outstanding expenses on his account. He was provided with a copy of the check, which was $0.00, and a copy of all the expenses that were withheld from this commission at the time of closing.  This closing date was 12-4-09.   The expenses that were withheld are a variety of expenses, including real estate fees, and some utilities that he had the company pay on his behalf and put on his account, along with some misc charges.  If an agent is having the company pay the utilities for a foreclosure property and we are reimbursed by a third party for these expenses, they are not charged to the agent.  We have no record of any of the utility charges being reimbursed by the third party.  The lady that he mentioned that worked here at the time of the closing no longer works for us and I can't say why she would tell him that these expenses were reimbursed to us when they ran into each other when in fact they weren't.
I did not work here in 2010, when he said he contacted our company the first time.  I did work here last year (2013) when he called our company.  I did email him proof of all his earned commissions and a breakdown of all the expenses at least 5 times.  He continued to call our company 5-10 times a day and contacting our owner at his residence in the middle of the night.  We have phone records of all the calls he was making to our office and the owners residence.  I had asked him to show us some kind of proof that these utilities had in fact been reimbursed and he couldn't provide any.  I asked him to quit calling our company and emailing our company after I had emailed him all the evidence he was looking for numerous times and finally gave him our lawyers name and telephone to contact, since we were not going to be harassed by him any longer.  Our lawyer told us to refer him to the lawyer and to no longer talk to him.  I told this individual this many times and when he continued to call, our lawyer told us to just hang up.  When he continued to call, we contacted the police to talk to him about calling us (we have all the phone records showing all the phone calls from him) and the police told him to only contact us through our lawyer.  We have not heard from him since, until this complaint came in the mail.  By the way, he never contacted our lawyer.
This individual left our company on bad terms.  He had a lot of personal problems that was affecting his work and after being talked to about his behavior and having these incidents noted in his personnel file, he was let go.
We don't believe there is any reason why he would be able to file a complaint against us to the Revdex.com.  He is a disgruntled past independent contractor that is now questioning a closing from 5 years ago all because he ran into someone who used to work here at that time that chose to tell him some untruths.
I would appreciate your help in helping us maintain a great rating with the Revdex.com.  Please let us know what happens at this point.  Thank you.
