Review: After discussing a performance enhancement for my car, and reviewing and arranging what would be needed, an email was received by myself from [redacted] advising the parts required a deposit, and as soon as the money was received, arrangements to perform the job would commence immediately. I followed the email instruction to wire the amount of $12,800 ( Twelve Thousand eight hundred) to there bank account to which I complied in October 2013. At this point, no service has been done, no parts been shown, no date for the job ever arranged. I've requested my money be returned, only to be stalled by promises.Desired Settlement: Return my money in the amount of $12,800.IMMEDIATELY

Response:

The performance work planned for [redacted] was originally planned with the premise of the major component still being under the research and development stages. No definite time was arranged and the client was informed about the situation. All other parts were ordered at the time of payment and have been on the shelf awaiting installation, as soon as the major components (in this case a twin turbo kit) was ready. Client agreed to the arrangement, rather than have his vehicle kept in our facility during the testing stages of the turbo kit. There has been conversations with the client along the way, though not as often as we would have preferred, and client had no problems after each conversation. More recently, as of last week, there was an agreement to abandon the turbo project and switch over to a supercharger kit that is currently available in the market. The part has been paid for and we are awaiting a confirmation signature from [redacted] before the part can ship out, as per the manufacturer's policy. To this date, all of the paid parts have been accounted for and just the actual labor work / charges are the only outstanding on the invoice. Our policy is to collect labor charges only after performing the agreed upon work to limit any financial commitments to any our clients. Parts are asked to be paid in advance so that when the call is made to bring the car in to perform the job/ work, there would not be any wasted time and the job can be started/ performed the same day as the vehicle is dropped off.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here]When I met with [redacted] representing RAD, I was told then of project that was "just about to go into production" barring any final problem using the mule test car. I informed the team I would return in October of the same year, and I advised him at that time to have at least ONE YEAR of R&D. I was told that most of the kinks were out. Fast forward to October, 2013, I and my son of 23 years sat with [redacted] and went over the particulars of this project. He assured me that by December of that year the car would be in and be worked on.

I explained to him that I was making this a project car and I wanted everything in place for a showing by the spring of 2014. [redacted] assured me that there would be no problem with that amount of time. Subsequent emails in October instructed me to wire funds for "parts" to their business account and I complied using the information providing the routing number and account. I requested that constant contact be maintained as this was the first dealing with RAD. I was assured that this would be done. Not only has this not been done, but contact made with RAD was precipitated by me, and the usual line was the car was going to be worked on "soon". I've attempted to have my money returned to me on 2 occasions, only to be met by salesmanship. I am not a disruptive person by nature, but I am exasperated by not seeing parts, not seeing receipts for money spent, not having work done, etc. I would NEVER agree to such an arrangement such as the one in the reply as this is the first time I dealt with RAD, and not knowing their business would NEVER have knowingly gave them money!

At this time, I have been contacted directly by Real Automobile Dynamics regarding complaint ID [redacted], however my complaint has NOT been resolved because:

[redacted] continues to claim that he does not have my deposit, and that he wants to do the motor work. I made an offer to him to return one-half of the amount, $6,400, then I would allow RAD to do the work, leaving them with $6,400 being paid to them. That offer was in essence, rebuffed. Claiming not to know "where the $6,000 is coming from", [redacted] continues to ignore my requests for the return of my deposit in its' entirety, the amount of $12,800. I have since gone to the District Attorney of Nassau County, and I am about to give them pertinent information pertaining to the situation. Unfortunately, I do not have them completed at this time, as I am responding to the email.
