March 30, [redacted] or whom this may concern: This letter is in response to a written complaint from a client of Real Esales, [redacted] ***Mrs [redacted] signed up, paid $and started on our program January 26, for a term of monthsAlthough we guaranteed we would actively market in her area we did not offer any guarantee or promises of how many leads she would receive or whenOur company markets each real estate agent in their prospective area and utilizes our same proprietary methods and efforts with eachLike every marketing program, it's impossible for us to actively project when an agent will start to receive leadsWe have delivered EXACTLY what [redacted] signed up for and was informed of everything the program entailsShe clearly has ideas and information of our business that has been fabricated in her in own mind.Every Realtor that signs up on our program is given the expectation that the first lead/appointment could take up to 10-weeks due to the fact we verify every contact and only send clients that are ready to meet with an agent right awayIn order to start generating and assigning appointments to each agent we must have the Terms of Service electronically signed and returned back to usAfter attempting to reach her via email and by phone three separate times (twice by phone and once through email) regarding the TOS document in February, we received the signed contract on February Since she missed out on a significant amount of time on the program, we graciously extended her program for the lost timeIn the last week of February, [redacted] called in the office numerous times, harassing our employees and claiming we were “one big scam"She also went to the extent of calling other clients of ours in different states to continue to bad mouth our companyWe are not working with any other Realtors in Long Island,NY contrasting her accusations of similar stories from other agents in her areaPer our Terms of Service, we reserve the right to terminate a realtor on our program at any timeAlthough this is our last choice in the course of action, we have contacted our attorneys about this matter and are planning a defamation lawsuit if she continues to slander our companyWe have attached our terms and conditions which [redacted] agreed to when she signed up and all email communications between her and our companyThank you [redacted] CEO

*** *** signed up on 6/28/for an annual membership to receive referrals for motivated buyers and sellers from our companyAlthough there is no guarantee on when an agent will receive referrals or how many will be sent throughout the year, every agent is given a timetable based on the average
times we see it has been taking in their areaWhen an agent joins our program they are sent a welcome package that contains a terms of service contract they must sign before going forward on the programThis creates liability for the agent that when we send a referral and they have success with it, we are owed the fees listed in the termsWe have attempted to send this to *** several times but because she has her email through an exchange server, our domain is more likely than not blacklisted on their end as well as the contents of the emails containing links that is picked up by spam filters thus not allowing it to go throughI attempted to work with *** and her internet provider to get this issue resolved, please see attached emailsAfter we both agreed to resolve the issue in this manner, I followed up several times to get in contact with Comcast as well as gave her my contact info for them to reach out to meI didn't get any response from *** and still have no correspondence from her other then this complaintI agreed to give her a full refund if she was to remove her negative reviews on our social media sites that had nothing to do with our lack of fulfillment rather technical issues we were willing to resolve with herShe said she would think about it and I never heard backWe have attempted to resolve this issue with her and at this point there is nothing we can do because she already filed a credit card dispute and currently going through the review process

We have filed a lawsuit in the State of California against our client, *** *** for defamation, slandering, falsifying and creating a fake online Yelp Profile of our business Real Esales LLC*** signed up in June to receive referrals but failed to get us the formal contract back that triggers us sending referralsAfter many attempts and even going as far as to offer to speak with her internet provider to assure the emails would be delivered she wasn't willing to resolve this issueIn addition, she filed a credit card dispute today, October 5th for her $purchaseThis was after I proposed she remove any defaming and statements she had made online and I would refund her in fullAttached is the Yelp profile that she falsified.

*** is getting off topic*** is weighing everything on this e-mail. I called Comcast and they don’t have a “blacklist” nor do they have a filter. They stated that if I was able to receive all these emails from them, then why not the packet? *** states it’s because he sends the packet HTMLWhich packet is he referring too? Per *** there is no contract? *** states during our recorded call that *** did say I would receive a few leads “at least one!” in the first few weeksI was advised they didn’t have any leads yet, they were working them…The continue to contradict themselves over and overThey debit my account with my permission, but under the agreement I was going to receive leads, a contract and a welcoming packet. I was under the impression Real Esales was Revdex.com ACCEDITED!This was a big reason I signed up with them in the beginning. Then I found out that was not true but they still have the logo on the bottom of their page. They also have they are 5star with Yelp when they are only 3star. All advertising. As you can see in this email chain, per *** there was no contact with me after our last contact. Today 9/26/*** posted a bad review on my Realtor page on Facebook (screen shot attached) then I started replying to his review with the other complaints from other agents, he then removed his review. What *** did on my realtor page is slander because he was never my client. CEO *** *** sent me a friend request on Face book after sending me a threatening email that they are going to take legal action if I did not remove my review. So ***s comment is false. I just found out today that there is another realtor in my office who said I have permission to use her name Karen Modus who is having the same exact issueShe also put in a complaint with the Revdex.comAppraently *** threaten to put a bad review on her page also. This company is beyond unprofessionalPer *** said he was waiting for me to contact himHe said I told him I had to think about it. Yes I had to think that if I removed that review just for money that I was allowing him and his company to have control over me and be able to take advantage of other agents. I decided not to remove my review, so real esales removed their review link so no one has the ability to leave a review on their page. Several agents are more than willing to come forward. Everyone is mirrored from them leaving a review and then getting the threatening emails, then the company stating they will refund their money if they remove their review. It’s unethical and should be illegal. He said they work with over agentsI was advised they have people who work on leads by ***. How can so little people scrubbed leads for agents? Impossible! Scrubbing leads means someone has talked to them and verified they want to sell or buy a home and have been pre approved. That’s a scrubbed lead. He said during the call if we don’t see any success in months he would refund their moneySo I can let the other agents know he will refund all their money if no leads in months? Then on the other hand he says no guarantee. *** said they can’t send me leads until they get the contract back, but though they could debit my account. During the call he states it’s NOT a contract, now there is NO contract. We are just signing the terms and conditions. I advised *** I received an email from *** and he stated he has pages built out for me*** said yes we do but can’t send me any leads until I sign the terms and conditions. He said he was aware I wasn’t getting leadsI said you were aware and no one contacted me? He said they debit our accounts first before we can read “contract” I said so you debit our accounts before we get to read the contract. He said I knew the contract was coming immediately after my phone conversation with ***..He said the contract is right on the website. www.Real Esales.com *** said on the recorded call that the contract is not a binding contract it’s to protect them only… He said the terms and conditions is not for us..he said not a lot to terms and conditionIf you do list within days they are owed… he brought up twice to me first to weeks are slow.. maybe maybe zero..he said he can send me a copy of the call log. Then after asked for it in email (attached) he said it’s for internal use only. I asked why not have people go to the sitehe says its electronic signature, I said so? I asked why don’t you have people go to the site on line. It says sign below. He said it’s before you sign aaaaaa (he was getting ready to say…before you sign a contract) BUT he caught himself. I asked why would you remove a review off your pageHe said I had no right to write that review??? Bottom line, They are taking advantage of realtors. They are taking our money and not providing what they promiseThey know that most realtors won’t take the time I have. I want them shut down. I can provide approx other agents off the top that have the same complaints. One agent said she got a lead but didn’t accept? I said why not..They Live outside the COUNTRY and barely could speak english and said they wanted a home that was over an hours drive and outside the zipcode she purchased

They have not proposed any resolution or offered a refund. I would like to see a list of leads that they sent me.

[redacted] signed up to have us build her a website and run traffic to it to potential get him clients. He signed up for a 12 month membership and we are a few months in. He has been delivered his product and service and has failed to secure the clients which is out of our hands. We have sent him client...

referrals and leads that she has contacted and he has been working these leads and the follow up notes show the clients did not want to hire him. He did not convert the clients which is completely out of our hands as he is the real estate agent responsible for working with the clients and they choose whether or not to work with him.  Here is his website we built him: pro.topagentconnection.com/[redacted]
 
[redacted] signed up for our partner marketing program. It is not a lead service. What we do, is market, advertise and buy leads for people looking to buy or sell their home. The agent, [redacted] in this case, picks which zip codes they want us to market in or get leads from. We are both commission incentive in our business, so when the agent converts one of these into a sale, we both get a commission.
 
We have 100% fulfilled our service as described, in fact, in [redacted]'s account alone we have invested over$1600 in leads and advertising, we are relying on him converting these so we get our commission and we can see a return on our investment.
