For your reference, details of the offer I reviewed appear below.The condition of my engine is not relevent to this repairI am aware that it is not in new or optimal conditionHowever, it runs and starts, and I am driving it every day with the A/C even, since I had the GROUND WIRE GOING TO THE FUEL PUMP REPLACEDAgain, I hired this company to repair my truck because it would not startThey towed it into their shop on 05/I was told by them the problem was my fuel pumpI was told it was ready and I picked it up after hours on 05/and only drove it the couple miles or so homeI paid $for that repair.It struggled at times to start on 05/20 the morning of 05/it would not start at allI went to their shop and requested they come to my home and get itThey it would not start at all and it needed a new motor and quoted me the $5500.00. On 05/26/I paid them and additional $275.05 fee for services and declined the new motor repairI paid $to another company to have it towed to Mike Swango765-343-2282. Ultimately, he discovered the problem to be the GROUND WIRE TO THE FUEL PUMP and I have no problems with it since. My complaint is I paid this company and incurred additional expenses due to a bad repair. Perhaps my truck did need a fuel pump and the ground wire to the fuel pump was not properly connected during that repairI don't knowPerhaps, I did'nt need a fuel pump at all and the entire problem was the ground wire to the fuel pump, I don't knowEither way I paid this company for a bad repair and it cost me valuable time and moneyThat is what I want refunded for. allegations. I am very familiar with this customer and he is not stating all of the facts in this matter. I will try my best to summarize this case for you. Mr. [redacted] contacted us in late October/early November wanting an estimate to replace his oil cooler in his semi and he would provide the parts. We gave him a price quote for labor and scheduled his truck in for the requested replacement of the oil cooler. Mr. [redacted] rescheduled his appointment three times and continued to drive his truck knowing he had coolant in the oil and oil in the coolant. This causes damage to the bearings which in turn causes damage to the crank. Mr. [redacted] finally made his appointment and we brought the truck in and diagnosed that he did in fact did need his oil cooler replaced. The truck also had a severe knock to the motor. We installed the oil cooler provided by Mr. [redacted] on 12/5/14. Upon installation of the provided oil cooler we called and discussed the severe knock in the trucks motor with Mr. [redacted]. We had noticed when we drained the oil from replacing the cooler there were metal shavings in the oil. We called and discussed this matter with Mr. [redacted] and he gave us permission to pull the oil pan in order to diagnose what further mechanical defects he had with his motor. We determined that his crank had severe damage, more than likely because he continued to drive the truck knowing he had coolant in his oil and oil in his coolant. Like I stated this causes internal damage to the bearings which in turn causes damage to the crank. We replaced a crank shaft and clutch in this customer's semi 12/5/14 with customers approval. The semi had a coolant light on when the semi was brought to our shop to replace the crank shaft. The customer stated that it needed a sensor and he would install the sensor himself. I would assume to keep down the cost of the crank shaft/clutch repair. The customer complained over a month after the crank shaft was installed that his coolant light was still on. I explained to him that he had stated that he was going to replace the coolant sensor himself when we did the crank shaft repair but in order to try to satisfy him I installed a coolant sensor on his semi at no cost to him. The coolant light was still on. I explained to the customer that he obviously had a wiring issue or some other defect and it was not the sensor itself. Keep in mind, this customer had this problem before we replaced the crank shaft. Mr. [redacted] continued to complain and stated that we had caused the wiring issue causing his coolant light when we installed the crank shaft even though the light was on before we ever worked on his truck. Again, trying to satisfy Mr. [redacted] I brought his truck in several times and had my mechanics check all the wiring trying to firitthe cause of his coolant light. Again, at no charge to Mr. [redacted]. I explained again to Mr."[redacted] that we had checked all the wiring and included checking wiring that we did not touch when installing the crank shaft trying to find the cause of the coolant light but was unable to determine the cause of the light. Mr. [redacted] took his truck to the dealer and found that the coolant light was on because of a faulty float in his surge tank. Mr. [redacted] called and emailed me a copy of the bill from the dealership. He stated that I could either pay the bill to the dealership or he was going to pursue legal action. I read the invoice from the dealership and determined that we were not responsible for his repairs. I explained to Mr. [redacted] that my shop was not responsible for the cause of his coolant light and was not responsible for any normal wear and break down of parts that we had nothing to do with. My shop did not touch nor was not responsible for a "worn out" float in his surge tank. The surge tank has nothing to do with the replacement of the crank shaft and or clutch. The bill also contained repairs for an exhaust leak, which is also another wear and tear part that we did not have anything to do with. I received a letter from his lawyer demanding that I pay Mr. [redacted] $21,012.30 for his repairs of his truck or they were going to sue me. I notified my lawyer regarding the matter and letter. Both my lawyer and Mr. [redacted]'s lawyer determined that my shop was not in fact responsible for Mr. [redacted]'s repairs and the matter seemed resolved. On 3/13/15 I received a phone call from my lawyer stating that Mr. [redacted]'s lawyer had contacted him and that Mr. [redacted]'s semi was broke down and Mr. [redacted] stated that his clutch had went out. I replaced the clutch on 12/5/14, so I sent a wrecker to tow Mr. [redacted]'s semi back to our shop to determine if the clutch was faulty. The clutch has a 1 yr warranty through the manufacture. Upon inspecting Mr. [redacted]'s semi we determined that the clutch was not defective. We determined that the semi had some kind of internal engine problems. We also found that Mr. [redacted] had removed the emission control/purification system from the truck and had welded certain lines to close the emission control system. Mr. [redacted] had also turned the horse power up over the specifications that Cummins sets for his motor. These modifications by Mr. [redacted] were performed after we replaced the crank and clutch. These types of modifications void any and all warranty through any shop and any parts manufacture. It is my understanding that it is a federal offense to bypass your emissions control on your semi. It is a fact that turning up the horse power on your motor past what the motor manufacture sets will cause damage to your crank and or motor. Both modifications will affect the performance of your motor and can cause damage to parts. I have attached some corresponding letters/invoices regarding this matter to prove the facts of my case. In closing, I would like to say that 1-70 Wrecker Service & Garage goes above and beyond to try and satisfy our customers and will continue to do so. In this case, the customer needs to take responsibility that his actions of making the above mentioned modifications caused damage to his semi not my company. I have spent countless hours and money regarding this matter which has already been determined from a legal stand point that his mechanical defects are not due to any type of negligence nor repairs that my company performed. This letter is in response to the complaint [redacted]. My company has...

worked on Mr. [redacted]'s box truck on several different occasions I believe for the last two years. We did in fact tow and replace the fuel pump on the box truck on 5/13/15. We towed unit for "no run". We found that the fuel pump was defective. We checked all electrical connections and fuses to ensure of our diagnosis. The unit was not running before we replaced the fuel pump and was running after the installation of the fuel pump. The unit would have never run after the installation of the new fuel pump, if in fact it did not need one and it was just in fact a ground wire. Mr. [redacted] paid and picked up the box truck after the installation of the fuel pump with no issues. Mr. [redacted] contacted us to tow his unit again around 5/21/15 for a "no run" again. We towed the unit back to our shop and found that the unit was 5 qts. low on oil, 3 gallons low on antifreeze, and down on compression on 3 cylinders. We had informed Mr. [redacted] in past repairs that his unit was in need of an intake manifold gasket because he was burning coolant and causing repeat failures of his distributor cap and rotor due to steam created by the leaking coolant in close proximity to the distributor. Mr. [redacted] always declined the repair. We informed Mr. [redacted] of our findings and gave him a quote to replace the engine since it was down on compression on the 3 cylinders. We charged Mr. [redacted] $275.05 which included a tow, labor, oil, and antifreeze. Mr. [redacted] had another company tow the unit to another shop. He came by my shop when I was not here and was very hostile with my secretary and shop foreman. He stated to them that his whole problem was a ground wire to the fuel pump and that he did not need a fuel pump and he did not need a motor. I made contact with Mr. [redacted] when I returned to the office and he also came by and we had a civil conversation regarding his concerns. He gave me a copy of the bill from the other company where they replaced the ground wire to the fuel pump and did some other repairs. I explained to him that if it was just in fact a ground wire initially that the unit would have never run after we installed the fuel pump. I did tell him that I would look through his invoices including the invoices he provided me from the other company and would try to satisfy his discouragement with us. At that encounter I provided my cell phone number to Mr. [redacted] so he was able to make contact with me regardless if I was in the office. I reviewed the invoices and called and left Mr. [redacted] a voice mail. About a week and a half went by and I had never heard back from Mr. [redacted] so I called him again. He stated that he called into the office but I was not here. I have been away from the office a lot in the last few weeks and I explained to Mr. [redacted] that was the reason I provided him with my cell phone number. We talked and he stated that he had two additional tow bills that he had not provided me that he wanted me to take into consideration for reimbursement. We concluded that he would call my cell phone when he could bring me the additional tow bills and we would then sit down and come to a happy medium with each other. I informed him that I wanted him to call me to make sure I was in the office before he came by. This was last week. I have not heard from Mr. [redacted] since and I thought we were on the road to a resolution until I read the complaint this morning. I called and left a voice mail for Mr. [redacted] after reading the complaint and have not received a response at this time. I explained to Mr. [redacted] that his motor is down on compression on 3 cylinders and that is why my foreman gave him an estimate for a motor. I believe that my foreman should have gave him a more detailed explanation as to why his motor still ran but we could not give a time line as to how long it would run considering the low compression and the rings burned. I believe Mr. [redacted] is frustrated and feels that we were trying to replace his motor when in his opinion he doesn't think it needs replaced since its still running. A motor will run on low compression and burned rings; it's just a matter of when it will finally stop running all together. It will not perform as it should when you have those kinds of defects. My shop foreman explained to me that he made those statements to. Mr. [redacted] and Mr. [redacted] is telling me he did not. So, I was willing to side with Mr. [redacted] and possibly reimburse him for the last repair and tow bill minus the fluids that we installed in Mr. [redacted]'s unit to satisfy the possible miscommunication between him and my shop foreman. Mr. [redacted] has made the statement to me that we were trying to take advantage of him and replace a motor that was still running. Yes, his motor runs but like I explained it has extensive defects that will not let it run at peak performance. I have done my due diligence by trying to work with Mr. [redacted] and strongly disagree with his statement that he has had "no results" from me. I have been in business for 15 years and my goal is to always try and satisfy every customer. I am sorry for the possible misunderstanding of the explanation as to why my foreman gave him an estimate on a motor with possibly not explaining as to why we concluded that it was in need of a motor but that does not justify reimbursement for a fuel pump that he did in fact need and received. I will continue to try and make contact with Mr. [redacted] to get this matter resolved. I have been in contact with Mr. [redacted] at least 4 times and have made attempts to settle this matter since he initially made statements he was dissatisfied with our service. I strongly disagree with his disputed amount of $1,782.37 for a full refund. He is attempting to get a full refund on the fuel pump replacement on 5/13/15 and his 5/21/15 invoice for towing, diagnosis, and installation of oil and antifreeze when we gave him an estimate for motor replacement. I am willing to give Mr. [redacted] a refund in the amount of $190.00. This would refund all labor and a tow on his 5/21/15 invoice with us to compensate for the possible miscommunication or explanation as to why we priced him a motor replacement. The invoices he provided me from another repair shop are not the cause of anything my shop is responsible for. On 5/28/15 the other shop replaced a Relay to his fuel pump and on 6/4/15 they replaced a ground wire to his fuel pump. If either one of those parts were defective when we replaced his fuel pump, then his unit would not have run after the installation of the fuel pump. This unit has multiple defects that Mr. [redacted] has opted not to repair and so therefore he will continue to have mechanical problems. Mr. [redacted] is unreasonable to think that my shop should be responsible for those defects that he chooses not to address. Please call me if you have any more questions or concerns.
