Real Life Response: We strongly dispute the above allegations by Ms [redacted] for the following reasons: Photos were taken of Ms [redacted] 's child, proofs were created for her to view online and she was to send an orderback to the gym to purchase by a prescribed due date2/client sent email that she wanted to purchase but due to snow storm and classes canceled at the gym there was a delay2/Real Life (RL) responded that we would pickup orders again on 03/so client was late ordering03/client still had not ordered and she emailed to ask about cost and how to make out the checkWe responded back the same day03/client emailed that she was bringing order to gym that evening03/RL responded backRL had picked up orders several times and those orders were already in productionAt this point the client order is considered lateMany photographers do not accept late ordersWe are happy to do so but we can't guarantee delivery time since our lab ordering process is in batch and we wait to get a pre-determined amount of work to justify an order04/client emails to ask about orderSame day RL responds back that we had enough orders to send a lab order and that we anticipate about weeks for delivery back to our studio(Not considered in this timeline is that orders are returned ' back to the main gym for distribution to the satellite gyms which we have no control over) 05/RL emailed individual images to Ms [redacted] of her daughter05/ [redacted] answered back that she received the images and we answered back that the print of the class image was at the gym, which was correct05/email from [redacted] asking about the class printShe said Mother's Day had passed which should be of no consequence since she only ordered one x print and because of copyright should not entertain making copies to distributeShe also asked for a refundShe paid $37.00, $for the digital files and $for the 5xprintShe had already received the digital files so $was the greatest refund she could possibly expectHowever, we did delivere the print to the main gym and again, we have no control over delivery05/RL emailed back that we delivered the print, we were so rry and explained the difficult deli very process, much of which we have no controlWe also reminded her that we did not receive her order until 4/05/client emails asking us to send her check backShe believes delivery was taking too long but we have email confirmation from her on 05/that she received the digital images05/RL responds back that we had delivered all orders but we would contact the gym and try to help herIn this email we misspoke when we said that we emailed on 5/because in doing this research I see that we have email confirmation from client on 05/that she was in receipt05/during another email confirmation we offered to resend the orderWe offered to re-send the email but it was 7:p.mand we were in and out of the studio on the '" 05/client emails that she would like us to re-send email and not sure why she did not get the first onesObviously 05/was Friday and we were preparing for the holiday weekendWe believe Ms [redacted] may be confusedI will forward each of the emails as described above and since she confirmed that she received the email on 05/we know that she had the digital images at some timeIf she deleted her email and lost the images we would be happy to forward the original email to herWe photographed over 15,youth last yearWe have photographed team and individual pictures for the [redacted] [redacted] since We wou ld be happy to refer you to [redacted] ***, Team Coordination, Trade Road, ROGC( [redacted] She can verify the number of athletes we have photographed and the length of time we have worked with them without any allegation as the one recently made by Ms [redacted] It is clear; from the emai ls I can produce, that client made her order late, that we responded the same day each time she contacted us and that she verified receipt of the digital filesThe one thing that we can improve upon is the delivery delays experienced between Real Life and the gymWe have addressed this with Carol (team coordinator) and Denise (champion coordinator) and we are exploring options going forward, but again, this has nothing to do with this complaintDeborah F*, Managing Partner Real Life Photography & Events, LLC

We responded back the same day. 4. 03/22 client emailed that she was bringing order to gym that evening. 03/22 RL responded back. RL had picked up orders several times and those orders were already in production. At this point the client order is considered late. Many photographers do not accept late orders. We are happy to do so but we can't guarantee delivery time since our lab ordering process is in batch and we wait to get a pre-determined amount of work to justify an order. 5. 04/14 client emails to ask about order. Same day RL responds back that we had enough orders to send a lab order and that we anticipate about 2 weeks for delivery back to our studio. (Not considered in this timeline is that orders are returned ' back to the main gym for distribution to the satellite gyms which we have no control over) 6. 05/06 RL emailed 3 individual images to Ms. [redacted] of her daughter. 05/06 [redacted] answered back that she received the images and we answered back that the print of the class image was at the gym, which was correct. 7. 05/09 email from [redacted] asking about the class print. She said Mother's Day had passed which should be of no consequence since she only ordered one 5 x 7 print and because of copyright should not entertain making copies to distribute. She also asked for a refund. She paid $37.00, $25.00 for the digital files and $12.00 for the 5x7 print. She had already received the digital files so $12.00 was the greatest refund she could possibly expect. Review: On March 22,2016, I sent a check for 3 digital poses of my daughters pictures and 1 group pose. I have yet to receive anything and my check was cashed on April 22nd. My check was for $37. At this point I am going back and forth on email and still have no pictures while this photography studio has my money. I am frustrated and have missed all the holidays and events that I needed the pictures for. I have no idea when I will get these pictures. I asked for a refund and was told that she already sent the pictures. I asked her to resend and that is the last I have heard from her and that was a week ago.Desired Settlement: I want the pictures that I paid for. It should not be difficult since all that is needed is an email with a send button. As for the group photo, I just need the pictures taken to [redacted] so I can walk in and pick them up.
